NOTICE OF DISAGREEMENT
Dear VA ...
Yesterday I received a Special Apportionment Decision (attached-1)
regarding an apportionment with which I profoundly disagree. This
document was not mailed to me by the VA, but rather, a person who
received Power of Attorney for this situation made it available to me.
The required relief is the immediate cessation of VAs collection
activities and the refund of incorrectly collected money.
The fundamental reason of my disagreement is the fact that the
veterans situation and hardship was not considered at all, and not
given credence, while the ex-wifes, not a veteran, was taken at face
value. In fact, the ex-wife grossly lied on the filed documents, which
were not investigated at all by Nancy Driesch, the adjudicator who
completed the form VA21-441.
Another issue is the collection of the apportionment mentioned AND a
debt generated by the same issue of child support, that reduces the
monthly benefit to $2,100 from the original $2,920. I have to support
my current wife, Victoria, who is 61 years old with many health
problems.
In fact, since the date this paper was filed, my situation has worsened
significantly, where at one point, we were owing $7,000 because the
VA issued a zero $ benefits check to us. In addition, it is over one year
since I filed (for the second time) to have my current legal wife
recognized as spouse and dependent by the VA.
I will address the issues next:
1) Artificially lower Claimants Other Income. At the date of filing,
Kimberly Skokin was emancipated, over the age of 18, AND had her
own income. Maybe Jack was working, also. This amount is not

reflected in the claimants monthly income. In fact, the VA should not

have allowed for Roxanne to file on Kimberlys behalf without a POA
because she is an adult now.
From sources in the neighborhood, Roxanne keeps a house of vice,
receives additional income from prostitution and sales of narcotics.
2) Claimant (non-vet) was unemployed and living off credit cards. She
does not have money to support her children (both in college, I
assume), so hardship is shown. Miss Nancy.
My wife and I (the vet), on the other hand, no work since 2011 (did not
file any Federal Income Tax returns since 2012 until now), no
unemployment, only VA benefits. Still trying to improve by studying on
a foreign government grant. Still living off credit card. Current Debt is
$5,000. Now our benefits are only $2,100 instead of $2,910 +$300
what it should be. Still, no hardship for the veteran, according to VA.

Let me explain a little bit about Jack and Kims education:

Both attended Charles Wright Academy in Tacoma, WA.

The total cost of keeping those two children in private high school is
$25,000 * 4 * 2 = $200,000
Kimberly attended and graduated from Syracuse University, as an outof-state student.

$21,720 * 2 = $43,440 + $5,000 (room) = 48,444 / year

4 years * $48,444 = $197,776 (conservatively)

Jack wanted to attend Texas Christian University, near Dallas, TX. He

completed just one year, failing miserably at all subjects.
Tuition: $42,580 per year + room and board = $48,000

Instead of going to public schools that were free, or low cost, they
chose to go to schools that cost a lot. At which point, this becomes a
discretionary choice that I cannot support.
And to top this all off, Roxanne is a university educated mathematician
she graduated with 3.92/4 from North Dakota State University in
Fargo, ND. It is beyond my understanding how can it be that such a
smart woman with such a good command of the English language cant
find any work at all in Seattle or Tacoma, a short commute away.
Yes, it is true, I refuse to pay these leeches any child support. Roxanne
is a gold digger who ruined my life and taught her children to be the
same way.
The reason why I cant support my adult children is because at divorce
time, my real current salary was disregarded, and instead, the salary
was IMPUTED, in other words, the judge decided unfairly what my
salary should be.

At the time, I just came out of jail for being accused but not convicted
of Assault-4 on wife, by throwing the wedding band at her from across
the room during the final dispute. I had no job at that time.

Roxanne does not mention the fact that she received the residence
100%, including everything that was inside. There was never a marital
division. And I was the breadwinner while she chose to be a stay at
home mommy.

3) Miss Nancy writes The veteran reported VA as sole household

income. He showed expenses that exceed the VA rate, and that he has
$600 in bank, depending on expenses, which is contradictory.
I (the vet), declared what I had in the bank halfway through the month,
I wanted to be honest and straightforward. The $600 are NOT savings,
they are living expenses that would be used up till the end of the
month.
She said, he provided no documentation. which is contradictory to
what the document shows,
the veteran provided 21-0788 right after that, showing bank balance
(checking) of $600 on the average.
continues I (sic) does not appear that the withhold will cause severe
hardship to him.
Well, Miss Nancy, thats so convenient to dismiss. I wonder if the VA
would reduce your salary by 1/3 if youd like it and suffer no hardship.
Not being able to support myself, always having to borrow money, my
wife of ten years getting sicker and sicker under my own eyes,
increase my depression to a point where I just cant handle it, even
with drugs. Now I have anxiety and I cant sleep at night, and I
developed heart problems because of your stupid decision making.
Next time you decide to go to war, dont call me, call my ex-wife and
my nogoodnik children. I did my part.
And, by the way, I have no record with Child Support in Seattle, WA.

So, DSHS is the sole state organization to collect child support in the
state of WA.
Roxanne chose to let DSHS to do this collection.

VA is not DSHS and DSHS has no problem with the veteran.

The VA is NOT responsible for the financial mismanagement and
collection on some expired lawsuit of a woman that has been divorced
from her veteran husband for 12 years.

However, the VA has a duty to the veteran, and at the very minimum,
that duty is to interpret the situation presented correctly, as to
preserve the veterans rights and benefits, which you have failed to do
in this case.

I am really tired of screaming at the walls.
