SECRETARIA DE LA CORTE

Messrs. Lebcfreund and J abbar:

Pursuant. to Article 35(1)(d) and (e) of the Rules of Procedure of the Inter-American Court of Human Rights,
Xam writing to inform you that the Inter-American Comrniss.ion. on Human Rights has submitted on June 23,
2006, io accordance with Articles 51 and 61 of the ,A.merican Convention on Human Rights, an application
against the Illuatzioua State of Barbados for adjudication by the Court, in the Case 12480 (B~,"e at al.)" The
original application '.'ras received at this Seccerariar, along with irs appendices, on July 10.20060

In its application, the Iurer-Amaclcan Cornrnissiora indicates that Barbados has unjustly sentenced Lennox
Boyce, Jeffrey Joseph, Fredrick Benjamin Atkins, and Michael Hrrggios to capital punishment as the
mandatory punishment for the crime of murder between 1999 and 2001. The State of Barbados's QtTt:,;scs
.t:l.gain rt tbe Person ~r'"1c't 1994 prescribes the death penalty as the automatic and mandatory punishment for
murder, such tha.t neither the trial court 004' the appellate courts in Barbados can evaluate whether the death
penalty is an appropriate punishment in the particular circurnacancea of the offender and his or her clime,
According to the Comrnissioo, the "savings clause" of '[he Barbados Constitution irnrrrunlzes pre-constitution
laws frorn constitutional challenge even if those laws nrc inconsistent with. fundamental rights and frecdcrns
enshrined in the cc ns druticri.
Likewise, the Corrrmission has submitted to the Court that the alleged victims have appealed thelr death
warrants to the Judicial Committee of the Privy Council and received temporo.ry stays of exccutiori, but the
Privy Council also ruled thttt while the mandatory death penalty is .ialrumac, degrading, and contrary to
fundnmentnl human rights. the "savings clause" immunizes the penalty from conatirutional challenge. The
Commission also argued that the alleged vlcrirns b ave been subject to overcrowded nnd inhumane person
coradicicrrs while awaiting the results of their appeals. In Apdl 2005 they were allegedly placed in a recnporary
prison whh unsanitary cells, inedible food, and unclean drinking water, and were denied the ability to see their
attorneys and to have their families tirncly Inforrned when the alleged victims had serious health problems"
Detention in such facilities, along with the reading of death warrants while appeals wece pending, has
allegedly caused them. serious psychological suffering and rnenml anguish. One alleged victim, Mr. Atkins,
passed away 'under the prison's custody, but the cause of his death is 'unknown.
