Excellency:
Pursuant to Article 35(1)0') of the Rules of Procedure of the Irrcec-Arnecicac Court of Hl.1.Q1.an Rights, I have
the honor to .icforrn Your Excellency dun the Inter-American Cornrnissio n on Human Rights has submitted
on JUl.le 23,2006, in accordance with Articles 51 and 61 of the Acceclcan Convention on HUITlan Rights, an
applicariou against the Hlustrious State of Barbados, for adjudication by the Court, regarding Case 12A80
(Bqycc ot: aL).. The original application was received at this Seccecadar, along with its appendices. on July 10,
2006.
In its application, the Jeter-American C0111:o:Uss;on indicates that Barbados has unjustly sentenced Lennox
Boyce, Jeffrey Joseph, Fredrick Benjamin Atkins, and Michael Huggins to capital purdshccecr as the
ccandarory punishment 0'1: the ccirne of rrrurder between 1999 and 2001. The State of Barbado s''s 0ffilTJ'c.f
-r4gaimt fbe Person ...."1et 1.994 prescribes the death penalty as the automatic and mandatory pucdehmcnr for
murder, such tha.t neither the trial court nor the appellate courts in Barbados can evaluate whether the death
penalty is an appropriate punishment i11 the particular circucnstances of the offender and his or her crime.
According to the Commission, the "sayings clause" of the Barbados Constitution irnrrumizcs pre-constitution
laws 6':0111. coriatitutioraal challenge ev-en If those laws nrc inconsistent with fundamental rights and freedorna
enshrined in the constitution.
Likewise, the Cornrriiseioc has submitted to rhe Court that the alleged victims have appealed their death
warrants to the Judicial Cornrnittee of the Privy Council and received rernp orary stays of e..x ccution, but the
Privy Council also ruled that while the ruandatcry death penalty is Inhucnan, degrading, and contrary to
fundamental human ciglats, the "savings clause" .irramunizee the penalty Frocn constitutional challeogc. The
Cornrraieaion also argued that the alleged victims have been subject to overcrowded and inhumane prison
conditions 'while awaiting thc results of their appeals, In April 2005 they were allegedly placed in a temporary
prison wrtla uosanicery cells, inedible food, and unclean chinking water, and 'Were denied the ability to sec their
crtorncys and to lun.r. e their families timely Icfocmed when the alleged victims had serious health problems,
Deterrtic n in such facilities, aloog witb the reading of death warrants while appeals were pending, bas allegedly

In its application, the Commission requests that the Court declare the State responsible for the violation of
Articles 4(1), 4(2), 5(1), 5(2) and 8(1) of the American Convention, in conjunction with Article 1(1) of the
same, relating to the mandatory nature of the death penalty imposed on the alleged victims; Articles 5(1) and
5(2) of the American Convention, in conjunction with Article 1(1) of the same, relating to the alleged victims'
conditions of detention and the reading of warrants of execution to them; Article 1(1) of the Convention with
respect to the reading of warrants of execution to the alleged victims while their complaints were pending
before the inter-American human rights system; and Article 2 of the Convention, for failing to bring their
domestic legislation into compliance with the rights and freedoms protected under the Convention, Likewise,
the Commission requests that the Court order the corresponding reparations,
The President of the Court, pursuant to Article 34 of the Court's Rules of Procedure, has conducted a
preliminary examination of the application and has authorized the initiation of the proceeding of the case
Consequently, following his instructions, enclosed with this letter you will find a copy of all the
documentation received by the Secretariat of the Court, that is, a copy of the application and copies of the
appendices of the application Furthermore, you will also find enclosed a copy of our communication CDH12A80/005, whereby the Commission was requested to submit certain appendices that were either missing,
illegible or incomplete, which will be sent to you as soon as they are received at this Secretariat
As Your Excellency should be aware, in conformity with Article 62 of the American Convention on Human
Rights, Barbados became a State Party to the American Convention on November 27, 1982 and on June 4,
2000, Barbados deposited at the General Secretariat of the OAS its declaration of recognition of the
compulsory jurisdiction of the Court
Furthermore, pursuant to Article 35(3) of the Rules of Procedure, I request Your Excellency that, within one
month) your Illustrious Government designate an agent to act as its representative, In case your Illustrious
Government considers it convenient, it may also designate a deputy agent, in accordance with Article 21(3) of
the said Rules of Procedure Moreover, when appointing its agent and deputy agent, Barbados shall indicate
the address at which all relevant communications shall be deemed to have been officially received) pursuant to
Article 21(4) of the Rules of Procedure
Barbados has the right, in accordance to Article 38 of the Rules of Procedure to respond in writing to the
application of the Inter-American Commission and to submit observations on the written brief containing
pleadings, motions and evidence presented by the representatives of the alleged victims and their next of kin,
within a fixed period of four months from the date of notification of the application

Human Rights applicable to the present Case

Excellency:
I have the horiox of writing to Your Excellency, following the iristructiorrs of the President of the InterAmerican Court of Human Rights, in order to communicate to you that, based on Article 18 of the Court's
Rules of Procedure and Article 10.3 of its Statute, the Hluacrious State of Bacbndos has the right to appoint,
withiri 30 days of recedvicg notification of the petition, an ad hoc' judge to p acdcipnce in Case 12..480 (Bq)lc,: et
al.)
Article 104 of the Statute of the COUJ:t stipulates the following regarding the ad boc judge:
The right of nay state to appoint an ad hoc judge shall be conaidered relinquished if the
state should fail to do so within thirty days following the written request from. the
president of the Court.
Purs'uant with.. Arclclee 52 and 5504 of the American Convenulcc, on Human Rights) the ad boc judge should be
a juciat of the highest moral authority, with well-recognized competence in the field of Irurnan rights and
should rrie et the conditions necessary to exercise the highest judicial functions under the laws of the country
from which the judge pertains or of the State that proposes the judge as u candidate,
Likewise, I Inform Your Excellency that the ad hoc judge enjoys the scene diplornedc privileges nnd .imrnurritics
as the current judges on the Court during the exercise of his or her: functions (Article 15 of the Statute of the
COU1:t) and is subject to the incornpatibilities established in Article 18,1 of said Statute of the Court, which
states:

The pos!t1on of judge of the Inter-American Court of Human Rights is
incompatible with the following positions and activities:

Any other that might prevent the judges from discharging their duties, or
that might affect their independence or impartiality, or the dignity and
prestige of the office.
During the exercise of his or her functions, the ad boc judge will travel to the Court's headquarters, and will be
paid the for travel expenses and the corresponding fees, according to the standards set by the Organization of
American States"

The President of the Court, pursuant to Article .34 of the Court's Rules of Procedure, has conducted a
preliminary examination of the application and has authorized tile initiation of the proceeding of the case

It is my honor to address you in order to inform you that the application submirred by the InterAmerican Commission on Human Rights regarding the case of Boyce et al, (Case No. 12.480)
against the State of Barbados has been notified to said State and to the representatives of the alleged
