ItisoftennotrealizedthatamongthecausesofKashmirprobleminclusionofplebisciteintheInstrumentof
Accession,referenceofKashmirtoUN,haltingIndianoffensivewhenitwaspoisedtodriveouttheinvaders
fromKashmir,Article370hasplayednolessapartinpreventingJ&Kfrombecominganintegralpartofthe
IndianUnion.NotmanypeopleareawareashowandwhythisArticlewasformulatedandincludedinthe
IndianConstitutiondespitegravemisgivingsofSardarPatelandindeedalargenumberofthemembersof
CongressWorkingCommitteeandConstituentAssembly.
Article370wasworkedoutinlate1947betweenSheikhAbdullah,whohadbythenbeenappointedPrime
MinisterofJ&KbytheMaharajaandNehru,whokepttheKashmirportfoliowithhimselfandkeptSardar
Patel,thehomeminister,awayfromhislegitimatefunction.HenceNehruisanswerabletoallactsof
commissionandomission,consequencesofwhichwearesufferingtilldateasfarasJ&Kisconcerned.

WhyshouldastateoftheIndianUnionhaveaspecialstatus?Itconveysawrong
signalnotonlytoKashmirisbutalsototheseparatists,Pakistanandindeedthe
internationalcommunitythatJ&KisstilltobecomeintegralpartofIndia,the
soonerArticle370isdoneawayisbetter.
WhileitwasMountbattenwhopersuadedNehrutotaketheJ&KissuetotheUN,itwasSheikhAbdullah,
who,drivenbyhisambitiontoberulerofanindependentKashmirandhishatredfortheMaharaja,persuaded
NehrutogivespecialstatustoJ&K.AmonghisreasonswereoccupationofonethirdofJ&KbyPakistan,
referencetotheUNandplebiscite.ThemostsinisteraspectofproposedArticle370wastheprovisionthatany
changescouldbebroughtaboutinitonlybytheconcurrenceofJ&Kassembly.NehruspromisethatArticle
370wasatemporaryprovisionandwillgeterodedoveraperiodoftimehasturnedouttobeachimera.The
firstthingthatSheikhAbdullahgotdonewastoabolishhereditarymonarchyandredesignatehimasSadare
RiyasatwhowastobeelectedbytheAssembly.TheaccessionofJ&KStateintoIndianUnionwasapproved
byJ&KAssemblyonlyin1956.

JawaharLalNehruThehandsomeHarroweducatedaristocratwhogaveupalifeofluxurytojointhe
freedommovement.Babuschooseheiranddarlingofthemasses,hehadafatalflaw.Hecaredfor
personalitiesratherthanissuesandinstitutions,beitselectionofLordMountbattenasthefirstGovernor
GeneraloffreeIndia,retainingaseniorBritishofficerastheCommanderinChiefofIndiaArmyorbacking
SheikhAbdullahtothehilthischoiceswereunfortunate.FinallytheChineseaggressionof1962shattered
hisimageofaworldstatesman.
SardarPatelTheIronManofIndiasilent,strongandpragmaticwithacompleteholdoncongressparty
organizationrightlycreditedwithcreatingaunifiedIndiabyintegrating565princelystatesinithe
wouldhaveincludedKashmiralsoinitifallowedtodosobyNehru.Theonlyblotonhimwastheinsinuation
thathefailedtoprotecthisbelovedBapu.ThesluronlyhastenedhisendinDec1950.

NehruspromisethatArticle370wasatemporaryprovisionandwillgeteroded
overaperiodoftimehasturnedouttobeachimera.
SheikhMohammedAbdullahCharismaticKashmirileaderwhoneverletgoofhisdreamofrulingan
independentKashmirevenwhilemasqueradingasasecularistarchitectofArticle370alongwithNehru.
HemustsharewithNehruthegraveconsequences.LionofKashmirbroughtNehruunderhisspellfrom1938
onwardstotheextentthatinMay1947whenhewasarrestedbytheMaharajaforsedition,Nehrurepresented
SheikhashislawyerandwasevenarrestedinJun1947bytheMaharajawhiletryingtoenterJ&K.Finally
NehruhadtoeatthehumblepiebyarrestingSheikhAbdullahforseditionon9Aug1953.
MaharajaHariSinghTheMaharajasawanopportunityattheendofBritishRajtokeepKashmirasthe
SwitzerlandoftheEast.TryingtorepeathistorywhenhisancestorsMaharajaGulabSinghandRanbirSingh
gainedhandsomedividendsbykeepingaloofduringtheSikhWarandGreatMutiny,HariSinghtriedtosigna
standstillAgreementwithIndiaandPakatthetimeofindependence,Pakistansigned,Indiadeclined.
Maharajadiedalonelyman,forcedtoabdicateandexiledfromhisbelovedland.
TheDramaUnfolds
HavingfinalizedthetextofArticle370withSheikhAbdullah,NehrubroughtinGopalaswamyAyyangar,
IAS,asaministerwithoutportfoliotohelphimdealwithKashmirportfolioandpleadthecaseofArticle370
intheConstituentAssembly.GopalaswamyAyyangarhadbeenprimeministerofKashmirforsixyearswith
MaharajaHariSingh.WhenSardarPatelexpressedhismisgivings,thisiswhatNehruhadtosayonDec27,
1947.
GopalaswamyAyyangarhasbeenespeciallyaskedtohelpinKashmirmatters.Bothforthisreasonand
becauseofhisintimateknowledgeandexperienceofKashmir,hehadtobegivenfulllatitude.Ireallydonot
knowwheretheStatesMinistry(SardarPatelsministry)comesintothepictureexceptthatitshouldbekept
informedforthestepstaken.AllthiswasdoneatmyinstanceandIdonotproposetoabdicatemyfunctionsin
regardtomattersforwhichIconsidermyselfresponsible.MayIsaythatthemannerofapproachto
Gopalaswamywashardlyinkeepingwiththecourtesyduetoacolleague.

ItspeaksvolumesofPatelsloyaltytoacolleaguethatdespitehisownandothers
misgivings,hemanagedtoconvincethemembersofConstituentAssemblyand
CongressPartyExecutive.ButtoVShankarhesaidJawaharlalRoyega.
TheSardarthereuponresignedandthematterfellinGandhijislaptobringthetwocolleaguestogether.
Duringthisperiod,VShankar,IASwasthepersonalsecretarytoPatelandhadmaintainedarecordofall
events.ItisclearfromtheserecordsthatNehrufinalizedthedraftofArticle370alongwithSheikhAbdullah
withouteveninformingPatel.ThereafteritfelltoGopalaswamyAyyangartogetthedraftpassedinthe
ConstituentAssemblydiscussions.TheproposalwastorntopiecesbytheConstituentAssemblyandalso
CongressPartyExecutive.
Nehru,whowasabroadatthetime,swallowedhisprideandrangupPatelandrequestedhimtogettheArticle
370approvedItspeaksvolumesofPatelsloyaltytoacolleaguethatdespitehisownandothersmisgivings,he
managedtoconvincethemembersofConstituentAssemblyandCongressPartyExecutive.ButtoVShankar

hesaidJawaharlalRoyega.VShankar,inhisrecordhasdescribedthemeetingoftheCongressExecutive
CommitteeThemeetingwasoneofthestormiestIhaveeverwitnessedbarringthepartymeetingwhich
discussedthepropositionrelatingtoRajajibecomingthefirstPresidentofIndianRepublic.Theopinionin
oppositiontoGopalaswamysformulawasforcefullyandevenmilitantlyexpressedandtheissueevenbrought
inthesovereigntyoftheConstituentAssemblytodrawuptheConstitutionwithoutbeingtieddowntothe
apronstringsoftheKashmirStateConstituentAssembly.InsuchasituationevenMaulanaAzadwasshouted
down.
ThePartywasinuproar.TheSardarhadtopleadthatbecauseoftheinternationalcomplications,aprovisional
approachalonecouldbemadeleavingthequestionoffinalrelationshiptobeworkedoutaccordingtothe
exigenciesofthesituationandmutualfeelingsandconfidencethatwouldhavebeenbythencreated.Oncethe
Sardarhadtakencharge,alloppositiontothedraftwassilencedAndhowNehrurespondedtothisgreatact
ofloyaltyonpartofSardar?On24July1952,afterSardarwasnomore,Nehrumadeadetailedstatementon
KashmirintheParliamentonslowintegrationofKashmirintoIndiaUnionandmentionedthatSardarPatel
wasallthetimedealingwiththesematters.EvenGopalaswamiAyyangarwasdismayedatthisblatantlieand
mentionedtoVShankarItisanillreturntotheSardarforthemagnanimityhehadshowninaccepting
Panditjispointofviewagainsthisbetterjudgment.
ConsequencesofArticle370
Article370hasbeenthebiggestimpedimenttointegrationofJ&KStateintoIndianUnion.Thatitwas
incorporatedintheIndianConstitutionbythemachinationoftwoindividualsShiekhAbdullahandNehruis
allthemoreregrettable.NehruhadtoeatthehumblepiewhenhehadtoarresttheSheikhforhisdivisiveand
antinationalstanceon8Aug1953buthedidnotletgoofhisconceptofkeepingJ&Kaseparateentity.In
1957,sometopleadersofNationalConferenceledbyMrQasimsplitthepartyandformedagroupcalled
DemocraticNationalConference(DNC).

Article370,includedintheConstitutiononatemporaryprovisionshouldhavebeen
graduallyabrogated.Thishasnothappenedinsixtyyears.
IthadabrogationofArticle370onitsagenda.Nehruwouldnotbrookanyoppositiontohispolicyofkeeping
J&Kaseparateentity.Hetoldtheleadersthatanewthreat(China)isemerginganditisaninopportunetime
toraisethisissueandforcedthemtodroptheirdemand.NehruthereafterdecidedtowithdrawtheKashmir
conspiracycaseagainstSheikhAbdullah.ThiscasehadbeengoingonsinceMay21,1958.Theformalorders
howeverwereissuedbyGovtofIndiaon8April1964.
ItisoftenforgottenthatJ&Kstateisnotahomogeneousentity.ApartfromValleyMuslims,Jammuhasa
predominantlyHindupopulationwhileLadakhhasamixofBuddhistandMuslims.ThenyouhavetheGujjars
&Bakarwals.WhyisArticle370detrimentaltothefullintegrationofJ&KstateintoIndianUnion.Firstlythe
CentralGovtcanmakelawsonlywithconcurrenceoftheStategovt,practicallygivingittheVetopower.
Article352and360fordeclarationofnationalandfinancialemergencyrespectivelycannotbeappliedin
Kashmir.WhileacitizenofIndiahasonlyIndiancitizenship,J&Kcitizenshavetwocitizenships.Anti
DefectionLawisnotapplicabletoJ&K.NooutsidercanbuypropertyinJ&Kstate.
ThebeneficiallawssuchasWealthTax,GiftTax&UrbanLandCeilingActandintermarriagewithother
IndiannationalsdonotoperateinJ&KState.EvenArticle356underwhichPresidentofIndiacanimposehis
ruleinanystatecannotbeenforcedinJ&KwithoutconsentoftheGovernorwhohimselfisanappointeeof
thePresident.StateofJ&Kcanrefusebuildingofanycantonmentonanysiteorrefusetoallotlandfor
defencepurposes.
Article370,includedintheConstitutiononatemporaryprovisionshouldhavebeengraduallyabrogated.This
hasnothappenedinsixtyyears.Infactwheneversomeonementionsthis,vestedinterestsraiseanoutcrythat
legitimaterightsofKashmirisarebeingtrampledupon.StatedagendaofNationalConferenceisreturntopre
1953status.WhyshouldastateofIndianUnionhaveaspecialstatus?Itconveysawrongsignalnotonlyto
Kashmirisbutalsototheseparatists,PakistanandindeedtheinternationalcommunitythatJ&Kisstillto
becomeintegralpartofIndia,thesoonerArticle370isdoneawayisbetter.

TemporaryProvisionswithrespecttotheStateofJammu&Kashmir
1.Notwithstandinganythinginthisconstitution:
(a)TheprovisionsofArticle238shallnotapplyinrelationtotheStateofJammu&Kashmir.
(b)ThepowerofParliamenttomakelawsforthesaidstateshallbelimitedto
(i)thosemattersintheUnionListandtheConcurrentListwhichinconsultationwiththeGovernmentof
theState,aredeclaredbythePresidenttocorrespondtomattersspecifiedintheInstrumentofAccession
governingtheaccessionofStatetotheDominionofIndiaasthematterswithrespecttowhichthe
DominionLegislaturemaymakelawsforthatStateand
(ii)SuchothermattersintheSaidListsas,withtheconcurrenceoftheGovtoftheState,thePresident
may,byorderspecify.
1.Explanation.ForthepurposesofthisArticle,theGovtoftheStatemeansthepersonforthetime
beingrecognizedbythePresidentasMaharajaofJammu&Kashmiractingontheadviceofthe
councilofMinistersforthetimebeinginofficeundertheMaharajasProclamationdatedthefifty
dayofMarch1948.
(c)TheprovisionsofArticle(1)andofthisArticleshallapplyinrelationtothisState
(d)SuchoftheotherprovisionsofthisConstitutionshallapplyinrelationtothatStateSubjecttosuch
exceptionsandmodificationsasthePresidentmaybyorderspecify
ProvidedthatnosuchorderwhichrelatedtothemattersspecifiedintheInstrumentofAccessionoftheState
referredtoinparagraph(i)ofsubclause(1)shallbeissuedexceptinconsultationwiththegovtoftheState.
Providedfurtherthatnosuchorderwhichrelatestomattersotherthanthosereferredtointhelastproceeding
provisoshallbeissuedexceptwiththeconcurrenceoftheGovtoftheState.
(2)IftheconcurrenceoftheGovtoftheStatereferredtoinpara(ii)ofSubClause(b)ofClause(1)be
givenbeforetheConstituentAssemblyforthepurposeofframingtheConstitutionoftheStateis
concerned.ItshallbeplacedbeforesuchAssemblyforsuchdecisionasitmaytakethereon.
(3)Notwithstandingtheanythingintheforegoingprovisionsofthearticle,thePresidentmay,bypublic
notification,declarethatthisArticleshallceasetobeoperativeorshallbeoperativeonlywithsuch
exceptionsandmodificationsandfromsuchdateashemaynotify.
ProvidedthattherecommendationoftheConstituentAssemblyoftheStatereferredtoinClause(2)shallbe
necessarybeforethePresidentissuessuchanotification.
