Republic Act 9262 - Anti-Violence Against Women and Their Children Act of 2004
SECTION 36. Damages. Any victim of violence under this Act shall be entitled to actual,
compensatory, moral and exemplary damages.

The court ruled that case law requires automatic award of moral damages to a rape victim
without need of proof because from the nature of the crime, it can be assumed that she has
suffered moral injuries entitling her to such award.

SECTION 216. Remedies for Infringement. 216.1. Any person infringing a right protected
under this law shall be liable:
(e) Such other terms and conditions, including the payment of moral and exemplary
damages, which the court may deem proper, wise and equitable and the destruction of
infringing copies of the work even in the event of acquittal in a criminal case.
In labor cases, jurisprudence also provided for instance where moral damages may be
awarded as held in the case of Nancy S. Montinola, Petitioner, Vs. Philippine Airlines, G.R.
No. 198656, September 08, 2014

The court ruled that illegally suspended employees, similar to illegally dismissed
employees, are entitled to moral damages when their suspension was attended by bad faith or
fraud, oppressive to labor, or done in a manner contrary to morals, good customs, or public
policy.
