SEC. 3
SCOPE AND COVERAGE
GR: All issues arising from employer-employee relationship
shall be subject to the 30 day mandatory conciliation.
EXCEPTIONS:
1. Notices of strikes/lockouts or preventive mediation
cases under the National Conciliation and Mediation
Board (NCMB)
2. Interpretation and Implementation of the CBA and
the companys policies under the grievance
machinery
3. Applications for exemptions of wage orders with the
National Wages and Productivity Commission (NWCP)
4. Issues involving violations of:
a) Aliens Employment Permit
b) Private Employment Agency or License
c) Working Child Permit
d) Registration under DO 18-02
e) Professional license issued by the PRC
f)
TESDA accreditation
g) Other licenses or registration issued by the
DOLE or its attached agencies
5. Violations of the POEA rules involving:
a) Serious offenses and offenses involving the
cancellation of the license
b) Disciplinary
actions
against
overseas
workers
c) Complaints initiated by the POEA
d) Complaints against an agency whose license
is revoked, cancelled or delisted
e) Complaints categorized under the POEA
rules
6. Issues involving occupational safety and health
standards involving imminent danger situation,
dangerous occurences/disablimg injury, and absence
of personal protective equipment.
SEC.4
DEFINITION OF TERMS
1. Conciliation Mediation- Refers to the process of
facilitating a settlement of labor and employment
issues.
2. Labor Laws Compliance Officer (LLCO)- Refers to
DOLE officer authorized to conduct joint assessment,
compliance visit, occupational safety, and health
standards investigation, holds conciliation and
mandatory conferences.
3. Referral- Refers to the endorseent by the handling
SEADO of unsettled issues to the DOLE regional
Director.
4. Request For Assistance (RFA)- Refers to the
request for a conduct of a conlciliation-mediation
under the SeNA to assist parties arrive at a
settlement.
5. Requesting Party-Any aggrieved person
6. Responding Party Refers to any person (natural
or juridical) asked to respond to the request for a
conciliation-mediation under SENA
7. Single Entry Approach (SENA)- Refers to an
administrative
approach
to
provide
speedy,
accessible, inexpensive and impartial settlement
procedure of alllabor and employment issues through
a 30 day mandatory conciliation-mediation.

and by the SOLE, but in the case of attached

WHO MAY FILE
Any aggrieved person may file for an RFA. In case of
incapacity, any pf his/her immediate family, accompanied
with a Special Power of Attorney (SPA) and in case of death,
then his/her heirs.
SEC. 2
WHERE TO FILE
GR: In the SEAD where the Employer generally operates
EXCEPTIONS:
1. At the nearest DOLE office or attached agency in
case of a separated kasambahay or deployed
workers of service providers or subcontractors
operating in a region other than where it principally
operates.
2. At the nearest POLO of the country of destination or
embarkation in case of OFW or the nearest DOLE
office or attached agency of preference when in the
country.
3. DOLE office of registration in case of a union
representing a local chapter.
ACTION ON THE REQUEST FOR ASSISTANCE

REQUEST FOR ASSISTANCE THROUGH PERSONAL
APPEARANCE
The following are the duties of the SEADO:
1. Inform the requesting party of the objectives of the
conciliation-mediation proceedings
2. Help the requesting party accomplist SENA form 01
in 3 copies
3. Conduct initial interview and explore the initial idea
of settlement.
4. Assign reference number
5. Coordinate with the SEAD in case where there is no
need to co-conciliate-mediate.
REQUEST FOR ASSISTANCE THROUGH LETTER
The head of office through the SENA focal person shall
immediately respond by exploring the procedures of SENA and
require the apperance of the requesting party before the
SEADO.
SEC. 4
NOTICE OF CONFERENCE
Upon receipt of the RFA, the desk officer shall schedule a
conference using the SENA notice form. Service of notice may
be done through the following:
a) Personal
b) Registered mail
c) Electronic mail
d) Facsimile
e) Any other fast, economical mode of notifying the
parties taking into consideration the prevailing
circumstances in the SEADOs area of responsibility.

Initial Conference- Shall be conducted within 5


working days from the date of assignment of the RFA.
Succeeding Conference-The SEADO may hold as
many succeeding conference within the 30 day
period
Resetting As a general rule, resetting of schedule is
not allowed except in cases where there is a
reasonable cause. In which case, the conference shall
be rescheduled not later than 3 days from the
original schedule.
Extension-There can be an extension upon
agreement of both parties, but in no case shall the
extension exceed 15 calendar days.
