TN-NLS Internal Moot Problem.

The PopatLals (parents, two school age children, and Pingalamma, the grandmother) are a
religiously observant family who live on Kejriwal Street in Vanankovil National Capital Region
(NCR) of Neverland though the region for all purposes does not come under the National Capital
Territory (NCT) but compensation cases for the balance of convenience have been entertained on
a case to case basis in the High Court of Neverland. The SamosaWalas (parents and child) live
directly above and have one son, Dahi, who is ten years old and has been blind since birth. In
2012 the Samosa Walas bought a partially trained seeing-eye dog named Bournvita for Dahi,
both to assist him and to keep him company.
The relationship between the PopatLals and Samosa Walass had been cordial up until that point.
However, when Mrs.Papdi Samosa Walas would drive Dahi to his special school, she left the dog
at home, and the dog would bark and run back and forth in the flat. The barking and running
greatly annoyed Mr. Pingu PopatLal, who worked from home for an overseas EDM company,
The Pakistani House Mafia. The PopatLals complained to the Samosa Walas multiple times
about the noise and disruption. After a particularly annoying week of barking and running, Mr.
Pingu PopatLal woke very early on Sunday, got the mop out, and began to beat against the
ceiling directly below the Samosa Walass bedroom. He continued for 13 minutes until he heard
the Samosa Walass wake up, and move about, and begin to complain.
That same afternoon, Mrs. Papdi Samosa Walas leaned over the railing of her balcony and
poured acid on the PopatLals prized Tulsi plant. Mrs.Pingalamma PopatLal (The grandmother) ,
who was not well, was sitting on the balcony reading, and the fumes from the acid gave her a
coughing fit that sent her to the doctor and to bed for the next 9 days. The Tulsi plant died
immediately.
The routine for the week was generally that Mrs.Papdi Samosa Wala would let Bournvita(dog)
out, on its own, for an hour before bringing the dog inside and taking Dahi to school. On
Monday when Mrs.Pinky PopatLal was on her way to work and carrying her Tiffin, the dog
followed Mrs. Pinky PopatLal to her car. When she put the Tiffin on the back seat, the dog
jumped in. She shut the door and drove away, with the dog barking loudly in the back seat. From
where he sat near an open window, Dahi heard the dog barking and a car being driven away. Mrs.
Pinky PopatLal let the dog out in the parking garage at her place of work, some 11 kilometers
away. The dog never returned to the Samosa Walass. Dahi suffered from post-traumatic stress
disorder (PTSD) and had to be put on special medication for three months. He was not able to
attend school for one week after the incident.
The Samosa Walass and the PopatLals both sue each other in the High Court of NerverLand,
Republic of Tomorrow Land, under OS No. 420/2014 and O.S No. 840/2014 seeking
compensation of Rupees 1,00,00,000/- and Rs. 1,50,00,000/- respectively. The Parties have
disputed jurisdiction by way of I.A. No. 1/2014 respectively and the same has been decided by
the Bench of the High Court of Neverland as to be taken up with the main matter. As counsel,
what would be your arguments/contentions for the Plaintiff and the Defendant on the violations
of the principles of appropriate civil laws and jurisdiction.

Rules1. Common law principles are applicable.


2. The laws applicable in Tomorrow Land are In Pari Materia with Indian Laws and High Court
of Neverland is same as Delhi High Court Rules.
3. Each side gets 20 minutes to present their case, which include the arguments for both the
counsels and the rebuttal.
