Ms. Gibson,
First and foremost I want to apologize for the delay in getting the answers that
you and the city of
Cincinnati are seeking. Since we last met there have been a few details that I w
ant to make you aware
of that is causing the slight delay. First in the past three weeks I have releas
ed all of my former office
employees for various reasons but mostly pertaining to the debacle that we see o
urselves currently in
regarding the eight and sycamore project, so I am training new staff while I am
working through this
mess that we created. Moving on from that I will answer some of the questions th
at you have sent
Mr. Tepe to the best of my ability until I complete the overall process of going
through the complete
accounting process of the job.
To let you know where I stand in this process. I have completed tying all the ch
eck registers to the
employees that have worked on the sight to the actual time on the project and th
e check numbers of
the checks that they have received. This was done with very little cooperation f
rom ADP. I have also
tied check numbers to pw make up checks in which we did through AP and not throu
gh payroll, but I
found them. I still have to correct all of the certified payroll showing the cor
rect wages paid on the site,
most of which were reported correctly but one or two on each report that were no
t. Then last but not
least the cancelled checks which is becoming frustrating because if you try and
retrieve to many at a
time only a certain amount come back and you have to do review find the ones tha
t didn t and do it
again so we are retrieving the cancelled checks at a very slow pace.
So with that I will answer to the best of my ability the following questions:
1. Are all R&R Steel employees paid via direct deposit, or are some employees is
sued hard copy
checks? Most employees receive an actual check. There are only a few on direct d
eposit.
2. Please provide a copy of all corrected certified payroll registers, direct de
posit statements, and

all canceled checks related to the remediation of underpayments made by the two
payroll
companies that were fired by R&R Steel. Please also provide a copy of the final
certified payroll
registers, direct deposit statements, and the final canceled checks documenting
final
resolution of the underpayments. In Process of doing so. Would ask that if I cou
ld provide only
the cancelled checks and pw make up checks for the employees that are in questio
n of being
underpaid. I can send you the check registers along with the spreadsheet I am pu
tting
together which will make it easier for you to identifiy these employees. It look
s as if there is a
total of about 6 employees that were underpaid two of which the information has
already
been provided
3. Please advise how often R&R Steel remits 401K deductions collected from emplo
yees weekly
paychecks to Mass Mutual Group; and advise as to what pay period/payroll date th
ose
remittances correspond. Since that time that we met another contribution has bee
n made to
the employees 401k which makes all the contributions current from January 2016 w
hen the
fund was started up until July of 2016. August of 2016 will be sent in on the fi
rst of November.
According to Mass Mutual and the plan we set up we must make the deposits within
the 90
day time frame
4. Please advise what process is in place to locate an employee who was subject
to a prevailing
wage under payment, but no longer works for R&R Ste el; in order to remediate th
e
underpayment? Most of the people that we I am seeing that were underpaid are sti
ll
employed by the company. Like I said some of the pw wages have been made up and
from my
investigation it looks as everyone after 3/27/2016 received the proper base pay
and benefits.
For those one or two that or two that are not, we have telephone numbers and add
resses in
which to reach out to get them paid
Again, I am sorry for the delay but it a much bigger job than I expected and I a
m doing it myself to
ensure that it is done correctly. Let me know if you need anything else until I
can complete this.
