Hi Mary Ann,

I know, Im sure its hard to be waiting while we work through the process in the various federal
agencies! In terms of your question, Id like to be able to give you a denitive answer, but Im
afraid Im not an expert in what agencies can or cannot do. What I would say, though, is that
given the interests on both sides, it certainly makes sense makes sense to engage in a
collaborative dialogue over those interests and needs and we are currently exploring whether
there would be interest in that approach on the agency side. I believe I mentioned earlier that a
collaborative dialogue or resolution-seeking process is inherently voluntary, so we need to see if
the relevant agency leads are willing to go this route. I hope to have more on this for you soon.

aftertheUSNavyended7decadesofuseoftheisland
archipelagoforUSandNATOmilitarytargetpractice.

ThecommunityofCulebraistraditionallyunderserved,
environmentaljusticecommunitythatdoesnotyetbenefitfrom
evenhospitalservicesontheisland.Everyoneonislandwillbe
affectedbythisproject,ascargoisreroutedintotheharbor,
addinganadditional40minutestotheroute.Theislandalso
hasmultiplecriticalhabitatdesignations,andourenvironmental
concernsareextremelylengthymanyofwhichwerenot
coveredbyagencyintheSect7documents.

TheEAdidnotprovideanysupportdatatobackanearly
conclusionthatthecurrentauxillaryferrydockcouldnotbe

solicitingforcommentsin2015,andthatthepubliccomment
periodhadendedin2015.ThisiswellbeforethefinalEAfor
theprojectwascompletedatsomeunspecifieddateinAugust,
2016.Alsothepermitnumberforthisprojecthasa2002
generationnumber.

Ms.Sassosentacopyofthelistofthosenotifiedwhichdidnot
includeourname,despitethefactaccordingtotheEAwewere
theonlyorgthatcontributedanycommentstodate,and
despitethefactweusedtobeontheCorps'notificationlist.It
wasatthistimewecontactedotherconcernedinterestswe
knewtobeontheCorpsmailinglist,whoconfirmedthatthey
toomusthavebeenremovedfromtheCorps'snoticelist,and
withoutnotification,backwhentherewasabrieftransitionto
electronicnotifications.

IntheNov16email,Ms.Sassosaidthedeadlineforpublic
commentswasin2015.

Sheconfirmedthattheprojecthadchanged(thedockswere
madelongerandmorepilingsaddedtotheplan),butindicated
thattheCorpsfelttheprojecthadnotchangedsubstantially.

Indeed,oneofourprimaryconcernshastodowiththefactthat
throughthesection7processmanyamendmentstotheproject
wereverballyagreedupon,butnoneofthesealteredanyofthe
schematics.
