Guidelines for the bus providing pick

up and drop facility to the school students

Preface :- In order to start safe and sound, well-planned and efficient


bus service for the school students in Mumbai city, committee has been
formed under the chairmanship of Transport Commissioner,
Maharashtra State vide Government Resolution, Home Department No
MVR-0808/CR-153/PARI-2 dated 23 Jul 2008. As per the
recommendations of the said committee, the Government has formed
Maharashtra Motor Vehicle Rule, 2010 for school bus which has got
approval of cabinet on 24 Jun 2010. Under this rule and as per school
bus rules and regulation, 2011 the matter of issuing guidelines to all the
schools through education department for the bus providing pick up and
drop facility to the school students was under consideration with the
Government. Accordingly decision has been taken as follows :-

Government Resolution :- Under Maharashtra Motor Vehicle Rule, 2010


for school bus in order to make available safe and sound, well-planned
transport facility to the concerned, the Government has fixed school bus
rules and regulations, 2011 as under :-

1(a) Every school will have one transport committee to look after issues
like safe pick up and drop of students, to fix transport fees and bus
stops. This committee will verify, the vehicle documents like certificate of
registration, correctness certificate, insurance certificate, permit, PUC,
driving licence, fire-fighting system, first-aid facility, and agreement
bond.

The school Headmaster/Principal will be the chairman of the


committee. Representative of parent teachers association, traffic
inspector of the concerned area / police inspector, educational inspector
or representative of education officer, representative of bus contractor
and representative of local authority will be included in the committee.
Meeting of the committee will be conducted once in every three months
and before commencement of each session.

(b) School Headmaster/Principal will be responsible for safe journey of


the students and will take necessary steps for looking after the daily pick
up and drop of students.

(c) The school authority will be liable to take one day course on first
aid revision in two times in a year before the commencement of school
session.

(d) In order that the students move safely both at the time of starting
of the school and while closing of the school, the school authority with
consultation of traffic police will appoint traffic guards in sufficient
numbers for control of the traffic.
(e) The school administrators with consultation of traffic police and
help of local authority will look after that necessary marking and signs
are put near the school.

(f) No permission should be given by any school authority or traffic


authority for parking of any such private vehicle like auto-rickshaw and
car which do not possess the school permit of contracted vehicle within
the area of 100 meters from in gate or out gate of the school.

(g) The driver should submit every year fitness certificate given by at
least MBBS or doctor having higher educational qualification than MBBS
and medical certificate given by eye specialist as per form 1 c. In case of
default of the same by vehicle driver the school management and / or
contractor should be discontinued and the matter should be brought into
notice of legislative authorities.

(h) Each school management should remove insurance policy of their


school boys/girls of appropriate amount which covers everything. The
school management should recover the amount due for the premium of
insurance from the school fees of the students.

(i) Distinguished uniforms should be prescribed to the driver, female


assistants and cleaners for their recognition. The driver should give
identity cards to be worn by workers on duty.

(j) First aid box, essential medicines and material should be kept in
the vehicle. Every month authorised person / Principal should check
whether these are kept in the vehicle.
(k) Every school bus should have the information about blood group of
the students and contact number of the concerned in case of any
emergency.

(l) School authorities should ensure that every vehicle on contract


basis should possess two fire extinguishers of ABC type, 5 kg capacity
and having ISI mark. One of which should be kept in the driver cabin and
second near the emergency exit door. Similarly training should be given
to the driver, conductor and assistant to operate fire extinguisher.

(m) The school bus driver should follow all the terms and conditions
specified in the contract by the Government and those agreed upon by
school authority and him mutually. These terms and conditions will be
mandatory for both of them.

(n) The contracted vehicles used for the school should always
possess driving license, permit, insurance certificate, correctness
certificate PUC certificate.

(o) The owner of the bus should follow school timings strictly.

(p) The bus driver/assistant should strictly follow the route and bus
stops specified by the school.

(q) The bus No should be displayed prominently on the frontage.

(r) No employee should smoke or drink while on duty.

(s) Female assistants and cleaner should help the children while
getting in and out of the bus. They should also check the identity cards
of the helpers who take the children. The parents or authorised persons
should take down their children at their respective bus stops. If there is
mark on their identity cards that someone is going to take them but if
nobody comes then the child should be brought back to the school.

(t) No music or songs should be played in the school bus carrying


students.

(u) The bus employees should not give any eatables or drinks to the
students unless any provision made by the school.

(v) The driver should immediately inform to school regarding any


changes in the bus due to bandh/traffic jam/accident/breakdown/road
closure. The school should ensure that in such emergency situations the
contractor should have adequate substitute.

(w) The driver or supervisors should immediately report to the school


about any unusual events.

(x) While driving the bus the doors should be closed and bolted
properly.

(y) In order to avoid the nuisance of mosquitoes the bus should be


cleaned thoroughly.

(z) Bus should be cleaned from inside. Every bus should have air
freshener.

(aa) Cleaners and female assistants should always see to it that the
children are safe and the bus is clean.

(ab) In case of violation of rules, other than the punishment given by


legislative authority as per CSA fine will be charged.
2. CSA will be made on non-judicial bond of stamp fee of Rs 100/-.
The management which provides school bus facility will make this
agreement available to the parents and students for verification with
prior permission.

Necessary amendments will be made to the above rules from time


to time. For implementation of the above rules, the format of necessary
applications are given as appendices as under :-

Appendix A
Guidelines for starting bus service

Part-1

The school Headmaster / Principal will inform the parents


regarding starting the facility of school bus and if this facility is required
by the parents then the school will inform parents to give information
about the student address as per reflected in the detailed information
statement of the student through letter.

Action to be taken by bus management division of the school

1. To fix the area of residence and to fix the common stops for pick
up and drop of students according to the received applications of all the
students.

2. To fix the route and time according to the school time and informed
the contractor to follow the same.

3. The bus stops will be reflected in the office computer.

4. The information of the morning session students and afternoon


session students with address will be reflected in computer.

5. The fees to be paid by students/parents, bank details, cheque No


etc will be reflected in the computer.

6. Teacher report, routewise report, bus stop report, classwise report,


balance fees report will be made.
Part-2

After fixing the contractor and bus route the following will be
informed to the students :-

1) Statement showing student name, class, division wise and each


student wise bus route, contractors name and payable fees.

2) Letter to start bus service from Head Master/Principal to parents.

3) Fee schedule
4) Statement showing fixation and composition of fees as per
physical area.

5) Application to be filled by parents for bus service.

6) Statement showing complete information about the students in the


academic year (to be filled by parents and returned back to school)

7) Regulations to be followed by students in the bus.

Part - 3

The Common Certified Agreement will be made on a non-judicial


bond of stamp fee of Rs 100/-. Headmaster / School Principal and
contractor will sign on this. One copy of agreement will be with the
contractor and the other with school. Common certified agreement will
be issued every year alongwith addendum.

Appendix B

Circular of Headmaster/Principal for starting the bus service

Dear Parents,

The students who require bus service from the current academic
year can submit their applications in the school office by __________.
The students staying in the nearby areas of the school and in the areas
where school bus service cannot be provided are excluded from this
service. No student is allowed as per given as follows to enter in the
school premises with own private vehicle. (---------------------------------------

Available bus routes and identity No :
Identity card : Student of each class will be given identity cards of
different colour. Recent passport size photograph of the students should
be given for the identity card. Identity card should be carried daily.
Students can travel only on the route mentioned by them. Change of
address should be intimated in writing. Loss of identity card should be
intimated to the school. New identity card will be given by taking
appropriate fees. The person receiving the student should be informed in
the school. If that person is not present, the student will be brought back
to the school.
The complaints regarding bus service should not be made to the
bus driver/attendant. Instead complaints should be informed to the
Headmaster/Principal. Action will be taken on this as per the approval
given by the transport authorities to the bus service rules and regulation
2010. If the bus service is required, it is requested to send applications
signed by parents alongwith the statement showing personal details of
the student, passport size photograph (required for bus) having name
and class written on back etc to the class teacher by ________. Do not
send cheque alongwith the application.
Every year common certified agreement is made with the
contractor providing the bus service. Such agreements are available for
verification in bus service administration department. They can be
contacted for this.

Regarding Bus Fees

Bus fees will be payable for total 12 months from the date __ to __.
The structure of bus fees is based on residential area from the school.
Total bus fees (non-refundable) is payable at one time or in two
instalments. Fees should be paid in the name of the contractor by draft /
cheque (authorised for 6 months). Second identity card fees is _____.
The name of the contractor should be written in the draft / cheque
correctly.

1) I authorize the school for making appropriate rule / agreement with


the contractor providing school bus service. Under this authority, the
school by the means of common certified agreement can make
appropriate decisions for the safety of the students.

2) The school will select the contractor having best driver and quality
vehicles and utmost care will be taken on this matter.

3) In the scheme of making available the bus service, the role of the
school is of service provider. The responsibility of any losses or
accident while availing the service does not lie with the school.
Carelessness or default in service for all these matters contractor will be
responsible. Regarding this parent/student will not take any action
against the school.

4) In the scheme of making available school bus service regularly


and in a remunerative rates, the role of the school is only of service
provider. Any legal / financial liabilities arising about this service will not
be of the school. This is the basic condition of this service and this will
be agreed upon and accepted by the parents.

Appendix F
Rules to be followed by the students in the bus

1) Students should sit in their place before the bus starts. They
should not stand when the bus moves.

2) Big boys should sit behind.

3) Each student should carry their pass.

4) Students should look after their belongings.

5) School bags should be kept on the racks and not on the seats.

6) Silence should be maintained in the bus. Chaos should be


avoided. This can distract the driver.

7) If on the precise stop nobody is available to receive the student


then that student will be brought back to the school and sent back only
on written request by the parent.

8) Student should not put out any part of the body from the window or
the door.

9) Cleanliness should be maintained in the bus.

10) Any loss made by the student to the bus will be reported to the
headmaster / principal.

11) Only the required number of students will enter the bus.

12) School bus service will be cancelled for the students found in
misconduct.
13) Students should be present on the bus stop in the prescribed time.
Bus will not wait for the students.

14) Any change in the fixed bus stop or the bus should be reported to
the school within 24 hours.

15) Things forgotten in the bus will be deposited in the school.

16) The students should be prompt and disciplined while getting in and
out of the bus as standing of the bus for long time can obstruct the
traffic.

The above rules are made for safety and safe journey of the
students.

In this agreement collectively both parties and personally party is


addressed.

Whereas:-

1) The above-mentioned contractor has required buses, driver and


other employees and the contractor is interested in providing bus
service.

2) The required documents like legal license, approval and other


personal documents are available with the contractor.
3) Students from each class of the school are interested in availing
the bus service.

4) As it is not possible for all the students to make agreement with the
contractor personally, the school makes this agreement on behalf of the
students.

Both parties give approval to the following points and give approval to
follow them:-

1) Students and the parents on behalf of the school indenture the


above-mentioned contractor for providing school bus service and
indenture for providing service as mentioned under section 13 of this
contract.

2) The role of the school will be of service provider among all the
students who need the bus service and the contractor. Due to this
agreement no employee of the contractor can become an employee
of the school.

3) The school has been authorised to make this agreement on behalf


of all the students. Contractor agrees upon this. Conditions for
providing bus service will come into existence through this
agreement. Thus contractor cannot amend this agreement unless
approval of the school. Similarly contractor cannot amend any service
which is to be provided by this agreement. The contractor guarantees
this to the school. It will be mandatory for the contractor to follow the
policy, rates and guidelines made by the school.

4) Date of commencement of bus service

6) Admissibility and improvement-


This agreement will be admissible and acceptable for a period
one year from the date of commencement of bus service. This
agreement will be improved upon 90 days before its expiry on
appropriate rates and conditions.

8) Contractor Fees

a) For the service provided by the contractor as per prescribed in


annexure appropriate fees will be paid to him.

b) Each student will pay the fees for the service provided by the
contractor through the school.

c) All drafts/cheques will be collected by the school and given to


the contractor.

d) The contractor will accept the fees for his service. However,
school will not be responsible for this as it has the role of co-
ordinator between student/parents and contractor.
e) After taking the fees for bus service the contractor will give
receipts to all the students.

9) End of contract-

a) For end of the contract, the school can end the contract by
giving one month prior notice without any reason. After a period
of one month the contractor can stop the service. Or to end the
contract immediately the school can pay fees of one month and
end the contract.

b) If contractor wishes to end the contract he can do so by giving


three months prior notice

c) After end of the contract the school will not be responsible for
paying any fees.

d) If any loss has been occurred by the contractor or his


employees directly or indirectly and if it affects the fixation of
fees, even then there will be no liability of the school.

e) Unless in the written no amendment can be made in this


agreement or such amendment cannot be implemented.

10) Payment-

No employee of the contractor for whatsoever reason shall


ask for any kind of bonus, fees or money from the student or
parents. These instructions shall be given by the contractor to
his employees.

11) Insurance for buses of contractor-

a) In the term of contract the contractor shall insure his buses


and other corresponding things.

b) In case of any loss or injury to other people from the service


providing buses, for such claims insurance shall be done.

c) In case of injury to any school student, or death of the


student, for such claims contractor shall make insurance.

12) Exceptions for follow of rule:

Riots, bandh (call-off), earthquake, storm and other disastrous


circumstances can be considered exceptions for follow of rule of
contract for both the parties of the contract.

13) Bus Service :

By following the limitations as under the contractor shall provide


the bus service

a) Bus condition and route:

1) The mechanical and other state of the bus should be fine. The
authority prescribed under school bus rules and regulation 2010 shall
certify the condition of the bus.

2) All have buses will have permit for student travel and they will be
of yellow colour having written school bus on front and back.
3) The buses having contract not only with the school but also with
others will not be completely of yellow colour. The middle portion of the
bus will have a 20 inch broad yellow colour strip on all sides.

4) The school service buses will not be of more than 15 years of their
registration. The buses in the Mumbai will not be of more than 08 years.
Permit will be given to those buses working on CNG and not more than
15 years of registration.

5) All the buses will have the statement showing student name, class,
blood group, place of student pick up and drop. This statement will also
show the first and last route of the bus given by the school. The bus
routes and bus stops will be decided by the school.

6) The maximum speed limit of the bus in the Mumbai municipal


corporation will be 40 km per hour and for other municipal corporations it
will be 50 km per hour.

7) Each bus will have two boards which clearly display the school
name and the bus route number. One board out of them will of 8 width
and 21/2 length. This will be fitted on the front side of the bus towards
left. Second board will be of 8x8 fitted near the window towards
entrance door.

8) Each board will be fitted on a height not more than 325 mm. Care
will be taken that these boards do not fall down.

9) Railing will be fitted on the steps of entry and exit door.

10) No loud horns or the horns with air pressure will be fitted in the
bus.
11) No students other than the prescribed limit can travel by the bus.

12) Every bus shall have protective handle, railing, emergency exit,
first aid box and fire extinguishers.
The following should also be available in the bus :

The first aid box should contain all first aid equipment and medicines.,
ISI certified two fire extinguishers of ABC type having 5 kg capacity.
One of which should be kept in the driver cabin and second near the
emergency exit door.

13) The bus window should have three rods. There should not be
more than 5 cm distance between two rods.

14) There will be separate arrangement for keeping bags, water


bottles, tiffin box in the bus.

15) All the seats in the bus should be faced in front.

16) No commercial advertisement will be displayed on the school bus.

17) All certified documents of the buses will be collected in the school.

B) Employees in the bus

1) The school bus will have a trained driver, one male attendant and
one female attendant. These employees will look after the safety of the
students while getting in and out of the bus.

2) All the employees in the bus shall wear a clean uniform alongwith
an identity card given by the contractor.

3) All employees will have knowledge of Marathi/Hindi/English


language.
4) All the employees will be trained and while travelling will be alert
regarding the safety of the students.

5) The driver appointed by the contractor should have driving


experience of five years. He should not have been punished for any
offence of traffic. He should have all the documents like driving permit,
license, badge etc.

6) The driver should submit certified copies of the documents.

7) Smoking is prohibited in the bus.

8) All employees will help the children while getting in and out of the
bus.

9) The doors of the bus will be closed when the bus is moving.

10) No music will be played in the bus.

11) Bus employees will not give any eatables or drinks to the students.

12) If authorised person is not present on the bus stop for receiving the
student then such student will be brought back to the school. Student will
be handed over to this parents by calling them in the school.

c) Special conditions :

1. In half day schools, exams period etc the contract shall provide
service as per instructions given by the school.

2. Bandh (call off), traffic jam, accident, technical failure etc shall be
immediately reported to the school by the contractor. The bus
employees will inform the school regarding the event and make
necessary arrangement for safety of the students.
3. A fine of Rs 1000/- will be charged every month in case of unsafe
condition of the bus, late arrival of the bus, absence of employees etc.

4. If the bus fails while travelling then fine of Rs 50/- will be charged
for every bus stop / each trip. Thus the expenditure of the parents will be
made by the contractors account.

5. A fine of Rs 1000/- will be charged for late pick up and drop of the
students and for dropping them at other than the fixed bus stop.

6. For effective implementation of the contract the contractor shall


keep Rs 2000/- as deposit. No interest shall be paid on this amount.
After satisfactory termination of the contract and after deducting the fine
amount if any, the deposit will be returned to the contractor.

7. For smooth running of the bus service the contractor will pay
maximum Rs 25/- and minimum Rs .........../- behind each student as
administrative expenses at one time. After spending the amount for the
current academic year in case of any balance, the same amount will be
utilised for the expenses of the next year.

8. The fines charged shall be deducted from the deposit kept by the
contractor for effective implementation of the contract and shown as
debit on the contractors account. No explanation regarding this shall be
given. In this regard, the school shall have full rights.

9. At the end of the year statement of deductions shall be given to the


contractor. If the deductions are more than the amount deposited, then
the contractor shall immediately arrange for payment of balance amount.
D) Discipline and Safety :

a) The students of other schools or parents will not be permitted in


the bus.

b) The employees will look after that the children maintain discipline
in the bus.

c) The employees shall inform the school of any event.

d) The student muster-roll will be kept in the bus.

E) Actions to be taken in emergency : (eg, technical failure of


bus, traffic jam, bandh (call off) etc)

1) In case of exceptional cases as mentioned in the above examples,


the contractor shall inform the school and make arrangement for
dropping the children safely in the school or at their residence.

2) In case of technical failure in the bus the contractor shall inform the
school. Fine will be charged to the contractor regarding this.

3) If the bus fails while journey, the attendants will inform the school
regarding this, control the students, and in no condition shall move away
from children. By the time the contractor arranges for the other bus, the
students shall sit in the failed bus.

4) If the buses are not available due to bandh (call off), strike then the
school should be informed two days in advance.

F) Other Services :

a) Mobile sets or wireless phones will be available in the bus.


b) In case of technical failure or emergency the contractor shall
promptly arrange for the other bus.

c) Contractor shall hand over the map showing all bus stops and
routes to the driver as specified by the school.

d) For successive implementation of the contract the contractor will


give payment/wages to the employees. Similarly preserve all the
accounts, notes and documents. Contractor will make rules for
implementation of the contract and look after that these rules are
followed. For smooth running of the bus service contractor can make
transfers of the employees, similarly can take action against employees.

e) If required under Worker Agreement Act, the required permit and


license will be taken.

f) Contractors shall not use the schools name for any credit in bus
service. Regarding this no responsibility lies with school for any liability,
loan or any commitment of contractor or his employees.

g) If due to negligence of contractor of his employees if any loss


occur to the school equipment or in case of any other loss the
responsibility will lie with contractor.

h) The employees should have proper means of communication for


contacting the school. Contractor will be responsible to provide such
means to the employees.

14) Assignment :
Both the parties unless in written approval cannot transfer the
rights, transactions, responsibility or commitments to the third party.
However, all the matters in this agreement will be continued

15) There shall be two copies of the agreement. Both the copies will
be treated as original copies. One copy will be kept with the school and
the second with the contractor.

16) Other

a) All the letter correspondence, instructions and other matter related


to the contract shall be in English. No party shall translate it to other
language.

b) Implementation :

If any terms, conditions and provisions in the agreement are


proved to be unauthorised, illegal or not able to follow then it will not
affect the other terms, conditions and provisions. Other terms, conditions
and provisions will be remain in existence and this agreement shall be
continued legally.

17) Confidentiality :

The list of students who have made complaints and other relevant
documents is schools property and any information known by the
contractor should be kept confidential. All such documents will be
returned by the contractor to the school after termination of the contract.
This information or the name of the school shall not be used by the
contractor in any other place or transactions.

18) Jurisdiction
In case of any disputes between the two parties of this agreement,
for decision on such disputes, action will be taken within Mumbai court
jurisdiction.

19) Account and Records :


All the essential records of this contract and accounts shall be
preserved by the contractor. These can be inspected by the school.

Appendix 2-1

Addendum to Agreement bond


(This addendum is a part of this agreement and can be amended as
required)

a) Contractor will reimburse the amount spent by driver / attendant.

b) The composition and terms of school bus fees can be amended


from time to time and new terms can be included.

The fee composition will be done at the commencement of academic


year and fees will be payable for 12 months.

Area wise school bus fees (to be decided every year)

1) 12 months fees from dt _____ till _____. (if payable in two


instalments then period and date to be mentioned.
2) If residential area is to be decided afterwards then fees will be
decided by total number of students, route, area.

3) Fees will be payable by draft. For 12 months fees will be payable


through one draft in one time payment or two instalments.

4) The following is prescribed regarding school bus fees

a) If permitted by the school the student can travel by another route.


Contractor should also give his approval for this.

B If approved by the school student can travel through two different


routes in the morning session and afternoon session. But the fees shall
be payable at one time to the contractor of the morning session.
