Logic Midterm Examination Atty. Arnold Rimon Martinez

The question is whether or not a female student who gets pregnant be


kicked out from a Catholic school, my position in this argument is
NEGATIVE.

The rationale behind my stand lies in the presentation of law and


constitution. The point of my reasoning is based on the three aspects in
battling my defense against discrimination: society, institution and women.

First, a society is the guardian and protector of human rights and punished
the guilty one. The society has a duty bounded to the public maintaining
peace and order among its people and protects its being at all cost. It is
written in our law and constitution that the society guarantees that no
gender in preference will be the victim of discrimination. Thus, the
Declaration of Principles of Article II Section 14 of the Philippine
constitution asserted that "The State recognizes the role of women in
nation building and shall ensure the fundamental equality before the law of
women and men. Meaning, the law emphasize the equality of women
against the mask of discrimination.

In view of US constitution, Title IX of the Education Amendments of 1972,


a federal law prohibits sex discrimination in schools and programs. It
states that the students cannot be excluded from any activities including
any class or extracurricular activity, on the basis of such students
pregnancy, childbirth, false pregnancy, termination of pregnancy or
recovery there from.

Second, the institution that teaches the student on how to evaluate and
assist things; taught them on how to live a life to the fullest and become
their family; and; a scapegoats of their weary, boring and cloudy home.
The school, instead of kicking them, should accept and embrace them in
their doorstep. Provide with and encourage the mother teen in pursuing
opportunities to further their education and careers even in their midst of
pregnancy. The National Womens Law Center of the Unite States
reiterates through Title IX of the Education Amendments of 1972 the Basic
Rights of the pregnant student: the free access to school and activities; a
choice to attend if the school has a special program provided for the
pregnant women offered; and; excuse absence provided that a doctor
allows it. Schools must at least prevent discrimination against pregnant
and parenting students and support them so they succeed in endeavor.

In the Philippines, there is a school terminating their employee for the


basis that a woman got pregnant out of wedlock. The defense is
Immorality. The case presented in Leus vs. St. Scholastica College
wherein the SC ruled that public and secular morality should determine
the prevailing norms of conduct, not religious morality. In this case, Leus
wins. University of Santo Tomas includes in their students code under
Article II of Academic Rights that unmarried pregnant students shall not be
denied enrolment and/or scholarship on the basis thereof.

Lastly, as women, according to Magna Carta of Women (RA 9710) of


Section 32, equal access and elimination of discrimination against women
in education, scholarships and training. This includes revising educational
materials and curricula to remove gender stereotypes and images, and
outlawing the expulsion, non-readmission, prohibiting enrollment and other
related discrimination against women students and faculty due to
pregnancy outside of marriage.
Thus, to conclude my argument, the society and institution must look at it
as an opportunity by lifting them from social isolation, poor life habits, low
education level, maltreatment, stress, and depression. Currently, US and
Canada are making their studies shown that young mothers are at greater
risk of leaving school or attaining a lower level of education, and therefore
reaching professional dead-ends or missing out on job opportunities;
these factors increase the likelihood of using employment insurance
benefits. Although some teenage mothers can receive help from their
family and those close to them, the scene is not particularly bright.

My Finality, the female student must not be kicked out from any of the
catholic school in the Philippines.
