Dear Delegate Korman:

Thank you for taking the time to discuss the provisions of your proposed HB 387 with me. This bill
increases transparency for consumers by requiring each assisted living program with a website to post
on its website their most recent services disclosure statement.

As we discussed in our email exchange, the Department does not require any additional statutory
authority to implement this provision through regulations. Over the past several years, OHCQ has been
working closely with stakeholders to revise the assisted living regulations in COMAR 10.07.14. We are
nearing the end of this effort and will propose these regulations in the next two to three months.

OHCQ will add the requirement that assisted living programs with websites post their most recent
uniform disclosure statement on their website. Thus, the goal of HB 387 will be achieved without the
need for any legislation.
