ENROLMENT OF ORDER
MOTION ON NOTICE
BROUGHT PURSUANT TO SECTION 115 & 133 OF THE ADMINISTRATION OF
CRIMINAL JUSTICE LAW OF LAGOS STATE, 2011 AND THE INHERENT
JURISDICTION OF THIS HONOURABLE COURT.
UPONN THIS MOTION ON NOTICE dated 4th day of December, 2015 coming up today
before this Honourable court praying for the following:
1. An order reducing sum on the recognizance which has been forfeited by the
Respondent/Applicant from N2.5 Million to N1.2 Million.
2. An order granting leave to the respondent/Applicant to pay a minimum sum of
N700,000.00 as part-payment on the forfeited recognizance and spread the repayment of
the balance over 9 months or any other period the honorable court may deem appropriate.
3. An order granting leave to the Respondent/Applicant to be released on bail upon the
provision of a credible surety who shall enter into a recognizance for the payment of the
balance on the forfeited recognizance and/or any reduction thereof.
4. An order granting leave to the Respondent/Applicant to provide a surety who shall be a
civil servant of not less than grade level 10 an employee (in a executive, not clerical
position) in a publicity quoted company or an owner of land with registered title within
Lagos State.
5. And for such further or other orders as the Honourable court may deem fit to make in the
circumstances.
AND UPON READING through the sworn affidavit in support of the motion deposed to by
Idowu Onabote, Male, Nigerian, Christian, Litigation officer of No 10 Apapa Road, Ebute Metta,
Lagos dated 8th day of December, 2015 and filed at the High Court Registry, Ikeja.
AND AFTER HEARING D. Onafowope of counsel for the Respondent/Applicant move the
court in support of the motion and Jameel of counsel for prosecution in opposition.

K. A. JOSE (MRS.) IT IS HEREBY ORDERED AS FOLLOWS:


JUDGE 1. Prayer 1 on the application is refused.
2. Prayer 2 is granted to the extent that the Applicant is granted leave
to pay the sum of N700, 000.00 as part of the recognizance sum of
N2, 500,000.00 and he is to spread the repayment of the balance of
N1, 800,000.00 over the period of 12 months from January 2016
December 2016 paying the sum of N150, 000.00 per month.
3. Prayer 3 and 4 are granted to the extent that the Respondent is to
produce any of the described sureties i.e. either a civil servant on
not less than grade level 10 or an owner of land with registered title
as surety.
4. The Respondent is to be released on bail until the recognizance sum
is fully paid after which he should fully discharged from the
recognizance.
