COMES NOW, petitioner, through undersigned counsel unto this

Honorable Court most respectfully states:

1.That on (date), State Prosecutor (name of Prosecutor)

issued a Report stating that there is no collusion between the
parties in this case. A copy of the report is Attached as Annex A.

2.That under paragraph 3 of Section 9 of A.M. No. 02-11-10-

SC: (1) Pre-trial mandatory. a pre-trial is mandatory. On motion
or motu proprio ,the court shall set the pre-trial after the last
pleading has been served and filed, or upon receipt of the report
of the public prosecutor that no collusion exists between the
parties.
 3. Considering that the last pleading has already been
served and filed, and that the public prosecutor has already
submitted its report stating that there is no collusion between the
parties, then, this case is already ripe for pre-trial.

WHEREFORE, premises considered, it is respectfully prayed

that this case be set for pre-trial.
