COMPLAINT

The undersigned, Sansa Stark, accuses Ramsay Bolton of the

crime of RAPE, committed as follows, to wit:

That on or about 5 August, 2015, in the Municipality of

Miagao, Province of Iloilo, Philippines, within the jurisdiction of this
Court, the said accused, actuated by lust, did then and there,
willfully, unlawfully, and feloniously, commit rape upon the
undersigned by then and there sexually assaulting her by
inserting his penis into her genital orifice, against her will, and by
means of force.

INFORMATION

The undersigned, provincial fiscal, upon sworn complaint

originally filed by the offended party, accuses Ramsay Bolton of
the crime of Rape, committed as follows:
That on or about 5 August, 2015, in the Municipality of
Miagao, Province of Iloilo, Philippines, within the jurisdiction of this
Court, the said accused, actuated by lust, did then and there,
willfully, unlawfully, and feloniously, commit rape upon the
undersigned by then and there sexually assaulting her by
inserting his penis into her genital orifice, against her will, and by
means of force.

JUDICIAL AFFIDAVIT
OF SANSA STARK

I, SANSA STARK, 18 years old, single, residing at BN099

Nonato Street, Brgy. Baybay Norte, Municipality of Miagao, after
having been sworn to in accordance with the law do hereby
depose and state:

That Fiscal ROBERT BARATHEON is the counsel who

conducted and supervised my examination as a witness at his
office at Provincial Prosecutors Office, Iloilo City, Province of Iloilo;

That I am answering the questions herein fully conscious

that I do so under oath and that I may be criminally liable for false
testimony or perjury;
The following are the Questions propounded by Fiscal Robert
Baratheon and my answers in English language:

Q1: Do you swear to tell the truth and nothing but the truth?
A1: Yes Sir.

Q2: Are you the same Sansa Stark, the private complainant in
this case for Rape in Relation to Republic Act No. 8353 now
pending before the Regional Trial Court, Branch 67 of the
Municipality of Guimbal, Iloilo?
A2: Yes Sir

Q3: What is your highest educational attainment?

A3: Currently a 2nd Year College Student at the University of San
Agustin.
Q4: Do you personally know the accused in this case, Mr. Ramsay
Bolton?
A4: Yes Sir.

Q5: Can you tell us why you personally know Mr. Bolton?
A5: He also lives in Barangay Baybay Norte. He is our neighbor
and their house is just beside our house. We are friends since I
was a child.

Q6: Where were you on August 5, 2015 at about 3 oclock in the

afternoon?
A6: I was at home.

Q7: Didnt you have classes on that day and time?

A7: I did not go to school because I was having menstrual
cramps.

Q8: Who was with you during that time?

A8: I was home alone.

Q9: What transpired during that time?

A9: I was resting in the sofa on the sala when I heard a knock on
the door. When I opened the door, it was Mr. Bolton. He asked me
in the local dialect to quote Diin si mama kag papa mo?
unquote. Then he forced the door wide open, wrapped one arm
around me and covered my mouth with his free hand. Then he
shut the door with his back.

Q10: What did you do during that time?

A10: I was not able to do anything since he overpowered me.

Q11: What transpired after he restrained you?

A11: He forced me on the sofa and punched me in the stomach. It
was so painful, I almost fainted. Then I felt him taking off my
shorts and underwear. When I tried to resist he punched me in the
stomach again. It was there that I fainted for some time. When I
regained consciousness, he was already on top of me, his penis
was already inserted in my vagina. I tried to beg him to stop but
he gagged me with his shirt. I tried to push him away but he was
too strong.

Q12: What happened after that?

A12: He left me on the sofa. I could not move. Then put on his
clothes and left.

Q12: Was Marcelo Bayambago drunk at that time?

A12: No Sir. He didnt smell or look like he was drunk.
Q13: Can you tell us how big Marcelo is?
A13: He is 58 tall. His body structure is firm and has strong
muscles because he works out sometimes. We are actually
terrified by his presence because of his unpleasant behavior.

Q14: Why do you say unpleasant behavior?

A14: Because whenever I would pass by their house and he
happens to be outside, he would give me a nasty stare.

Q15: Did anybody see the incident?

A15: No Sir. But Meera Reed and Jeyne Poole saw Mr. Bolton
leaving our house. And so they came to me afterwards and asked
me what happened, and I told them.

Q24: And then, what happened next?

A24: When my mother arrived, I told her the incident. Then she
reported it to the police station of Miagao.

Q25: Do you have any proof of all your allegations?

A25: I have my witnesses Sir, my friend Meera Reed and
Jeyne Poole. And a medical certificate.

Attached to this Judicial Affidavit is an original copy of the

medical certificate marked as Exhibit A.

Q27: Based on this medical certificate you are showing to us that

there are bruises on your genitalia?
A27: Yes, Sir.

Q28: Who issued this medical certificate?

A28: It was Dr. Podrick Payne, Sir, Medical Officer III at Miagao
Medical Center

Q29: Whose signature is this in the medical certificate?

A29: My doctor, Sir, Dr. Podrick Payne.

Q30: Why did you say that it was Dr. Payne who signed it?
A30: Because I was in front of her when he signed the medical
certificate.

Q31: Do you have anything to say, Ms. Stark?

A31: No more, Sir.

RESOLUTION
This case was filed by the Chief of Police of the Miagao,
Police Supt. Robin Arryn against respondent, RAMSAY BOLTON,
resident of Barangay Baybay Norte, Miagao, Iloilo for raping the
victim SANSA T. STARK, who was at that time in her residence in
Barangay Baybay Norte, Miagao, Iloilo.

This resolves the inquest proceedings brought to this Office

by the complainant against respondent who was arrested in
accordance with Seciotn 5, Rule 113 of the 2000 Rules on
Criminal Procedure, as amended. When apprised, respondent
chose not to execute a waiver of his rights under Article 125 of
the Revised Penal Code, as amended by Executive Order No. 22.
He likewise opted not to avail of their right to preliminary
investigation, hence, an inquest proceeding was conducted.

The evidence for private complainant established that at 3

ocock in the afternoon of August 5, 2015, at Barangay Baybay
Norte, Miagao, Iloilo, the accused entered the premises of the
victim while she was home alone and then and there, using his
superior strength, forced the victim into carnal knowledge with
him. And that at around 4:30 in the afternoon witnesses MEERA
REED and JEYNE POOLE, saw the accused hurriedly leaving the
premises of the residence of the victim.

Respondent voluntarily surrendered to the police authorities.

Based on the foregoing, the undersigned finds that probable

cause exists against respondent RAMSAY BOLTON for the crime of
rape.

WHEREFORE, it is recommended that the corresponding

information be filed against respondents with the Regional Trial
Court stationed in Guimbal.
