Petitioner NORTHWEST ENVIRONMENTAL ADVOCATES (NWEA) is a non-profit

Oregon corporation with its principal business office located in Multnomah County, Oregon.

NWEA works through advocacy and education to protect and restore water and air quality,

wetlands, and wildlife habitat in the Northwest and beyond. It has been doing so for forty-eight
12
years.

Petitioner NORTHWEST ENVIRONMENTAL DEFENSE CENTER (NEDC) is a non-

16 profit Oregon corporation with its principal business office located in Multnomah County,

17 Oregon. NEDC works to preserve, protect, and improve the environmental quality of the Pacific

18 Northwest, and has done so for more than forty-eight years.

Petitioner BILL BAKKE is a member of NWEA and NEDC and an individual residing in

Multnomah County, Oregon.

24 NPDES permits with pending renewal applications are known as administratively continued
permits. These permits should have expired at the end of their statutorily mandated five-year
25 fixed term, but remain in effect because DEQ has failed to make a final decision regarding
whether to deny a permit or to prepare and issue a proposed draft updated permit.

NWEA and NEDC regularly submit public comments on administrative proposals related

3 to water quality and water pollution in Oregon and have brought litigation under the federal

4 Clean Water Act (CWA) over the last three decades to protect and improve water quality in the

5 state.

7 NWEA and NEDC have brought numerous lawsuits to protect Oregons water quality
8
and the environment. Some of those suits have focused on trying to assure water temperatures in
9
Oregon streams and lakes are sufficiently protective of threatened and endangered cold-water
10
fish such as salmon, steelhead, and bull trout. NWEA and NEDC have also worked to ensure
11
protection of Oregons human health and aquatic species from toxic chemicals. NWEA and
12
NEDC additionally regularly provide extensive public comments to Respondent DEQ regarding
13
its proposed water quality standards, proposed CWA 303(d) lists of impaired waters, proposed
14

15
Total Maximum Daily pollutant Loads (TMDLs) for those waters, and proposed NPDES

16 permits. NWEA and NEDC have also both sought and obtained schedules for the development

17 of TMDLs to help clean up Oregons impaired waters. Furthermore, NWEA and NEDC have

18 participated in numerous DEQ advisory committees.

Petitioners NWEA and NEDC have invested significant group resources, time, energy,
21
and money to educate the public, monitor and collect information, communicate with state and
22
federal agencies, strengthen clean water regulations, and secure meaningful restrictions on
23
pollutant discharges from municipal and industrial sources in the state.

Petitioners NWEA and NEDC are adversely affected and aggrieved by Respondents

3 failure to make timely decisions regarding pending NPDES permit renewal applications. Both

4 organizations have invested time and financial resources into improving the water quality

5 standards, listing water quality impaired Oregon waters, and forcing the adoption of TMDLs.

6 These are all protections which Respondents are required to use as the basis for issuing NPDES
7 permits, and which may or should result in more stringent effluent limits being included in any
8
reissued permits, particularly for discharges into impaired waterbodies. Respondents repeated
9
failures undermine Petitioners efforts.

Petitioners NWEA and NEDC are also adversely affected and aggrieved by Respondent
12
DEQs unreasonable delay in making decisions regarding pending NPDES permit renewal
13
applications because this continuing failure forecloses the Petitioners opportunity and ability to
14

15
review and submit public comments on those NPDES permits. Additionally, by administratively

16 continuing permits, and then not making any decision on reissuing them, DEQ effectively shields

17 these permits from the more stringent limits that may apply under newer water quality standards,

18 and from being subject to public comment and review, undermining the purpose of the CWA and

19 NWEAs and NEDCs efforts to force implementation of that law.

Petitioners NWEA and NEDC are further adversely affected and aggrieved by

Respondents unreasonable delay in making decisions regarding pending NPDES permit renewal
23
applications because their respective organizational objectives have been undermined by
24
Respondents unreasonable delay. As organizations incorporated, in part, for the express purpose
25

of protecting water quality, Petitioners NWEA and NEDC have an interest in ensuring that any

permitting decision affecting water quality in Oregon is made in accordance with applicable state
2

3 and federal laws. These organizational interests have been injured by Respondents unreasonable

4 delay in making decisions regarding pending NPDES permit renewal applications because the

5 existing expired and administratively continued permits authorize further degradation of

6 Oregons waters, both impaired and not impaired. Actual pollution controls that are achieved
7 through the requirements of NPDES permits are essential to achieving Petitioners missions.

Continued degradation of water quality may limit the ability of Petitioners NWEA and NEDC to
9
attract new members, retain current members, and to obtain financial donations. When
10
Respondents unreasonably delay in making decisions regarding pending NPDES permit renewal
11
applications, these failures to make decisions result in further pollution and this could suggest to
12
the public and/or Petitioners members and funders that the these Petitioners are failing to
13
achieve their organizational missions and goals, which are specifically to reduce pollution of
14

15
Oregons waters.

17 Petitioner Bakke has been involved with the protection of fish and Oregon rivers for

18 approximately 50 years.

Petitioner Bakke is a lifelong fisherman and a lifelong resident of Oregon. He uses
21
Oregon waters affected by Respondents failures to make decisions on pending NPDES permit
22
renewal applications. He fishes and recreates on many of Oregons rivers including the
23
Columbia, Willamette, Deschutes, Klamath, and Snake Rivers. He also fishes on many of those
24
rivers tributaries.

Petitioner Bakke is adversely affected and aggrieved by Respondents failures to make

3 decisions on pending NPDES permit renewal applications because those failures undermine the

4 effective implementation of current water quality standards and imperil fish. His ability to fish is

5 diminished by the currently impaired status of many of Oregons rivers, which is exacerbated by

6 Respondents unreasonable delay in making decisions regarding pending NPDES permit renewal
7 applications.

Petitioner Bakke is also adversely affected and aggrieved by Respondent DEQs

unreasonable delay in making decisions regarding pending NPDES permit renewal applications
11
because this continuing and repeated failure forecloses his opportunity and ability to review and
12
submit public comments on those NPDES permits.

Individually and collectively, Petitioners interests are and will continue to be adversely

16 affected and aggrieved by Respondents unreasonable delay in making decisions regarding

17 pending NPDES permit renewal applications unless the requested relief is granted.

19 Respondent OREGON DEPARTMENT OF ENVIRONMENTAL QUALITY (DEQ) is


20
an agency of the State of Oregon, and has its principal place of business in Multnomah County,
21
Oregon. Respondent RICHARD WHITMAN is the current Director of Respondent DEQ and has
22
his office in Multnomah County, Oregon. Respondents should be making decisions, rather than
23
allowing the continuing unreasonable delay, regarding each of the pending NPDES permit
24
renewal applications. Attached as Exhibit 1, and incorporated by reference, is a non-exhaustive
25

list of the currently pending NPDES permit renewal applications that Respondents have failed to

make a decision on and/or unreasonably delayed deciding on.

3 LEGAL BACKGROUND

5 Congress passed the CWA to restore and maintain the chemical, physical, and biological

6 integrity of the Nations waters. To achieve this goal, the CWA prohibits the discharge of any
7 pollutant from a point source to navigable waters except in compliance with law.

The main way to achieve compliance with the CWAs general pollutant discharge
10
prohibition is by obtaining a NPDES permit. The U.S. Environmental Protection Agency (EPA)
11
operates the NPDES permitting program, but it may authorize states to run the NPDES program.
12
Oregon is an authorized state and must comply with the CWA and its implementing regulations,
13
along with state law, in issuing NPDES permits. Every NPDES permit must establish effluent
14

15
limitations for some of the pollutants being discharged. States may impose more stringent

16 requirements than the CWA or EPA approved standards.

18 Paralleling the CWAs statutory requirement, Oregon regulations provide that a NPDES

19 permit will be effective for a fixed term not to exceed five years. Congress also has, in the
20
past, reaffirmed the importance of five-year review of CWA permits.

Any person wishing to obtain a renewal of an existing NPDES permit from DEQ must
23
submit a written application at least 180 days before an NPDES permit is needed. EPA, or an
24
authorized state agency such as DEQ, may issue a new NPDES permit to an existing pollution
25

discharger who has timely sought renewal of an existing permit. If a new or renewed permit is

issued, it must incorporate any new and more stringent standards, any new information on the
2

3 quality of the receiving waterbody, and any new TMDLs.

5 However, if a completed application for renewal of a permit is timely filed with DEQ, the

6 permit will not expire until final action has been taken by DEQ on the renewal application.
7 THE RESOURCE AT ISSUE/FACTUAL BACKGROUND

Oregon has roughly 111,619 miles of streams and 1,400 named lakes. Many of Oregons
10
rivers and streams receive pollutants discharged by industrial and municipal sources that require
11
NPDES permits.

Each Oregon waterbody is assigned designated uses and criteria that are intended to
14

15
protect those uses. Designated uses and criteria are then incorporated into water quality standards

16 developed by Respondent DEQ and approved by EPA pursuant to section 303(c) of the CWA.

17 Respondent DEQ collects water quality data and compares these data to the water quality

18 standards in order to identify waters that are considered impaired pursuant to section 303(d) of

19 the CWA. Section 303(d) also requires states to develop TMDLs, which are science-based clean-
20
up plans to restore impaired waters to improved water quality.

Respondent DEQ is required to update its list of impaired waters every two years. Its
23
proposed 2012 list, submitted to EPA in 2014, included 1,910 waterbody segment-parameter
24
combinations, which EPA both approved and disapproved in December 2016. EPA has proposed
25

to add 1,055 segments. Many administratively continued permits were issued before 2012. See

Ex. 1. As a result, those permits were not analyzed based on the updated list of impaired waters.

4 Respondent DEQ has updated water quality standards many times since 1984the same

5 year that the oldest currently administratively continued NPDES permit on Exhibit 1 was issued.

7 In 1996, Respondent DEQ submitted revisions to its water quality standards to EPA for
8
temperature, dissolved oxygen, pH, and bacteria. Many administratively continued permits were
9
issued before 1996. See Ex. 1. As a result, those permits were not analyzed based on updated
10
standards for pollutants such as temperature, dissolved oxygen, pH, and bacteria.

In 2003, Respondent DEQ again updated its temperature standards. Many
13
administratively continued permits were issued before 2003. See Ex. 1. As a result, those permits
14

were not analyzed based on updated standards for temperature.

17 In 2004, Respondent DEQ submitted to EPA, and ultimately received approval of, new

18 and revised standards for toxics. Many administratively continued permits were issued before

19 2004. See Ex. 1. As a result, those permits were not analyzed based on updated standards for

toxic pollutants.

In 2011, Respondent DEQ updated nearly all of its human health criteria for toxics. Many

administratively continued permits were issued before 2011. See Ex. 1. As a result, those permits

In 2015, Oregon adopted new ammonia criteria and in 2016 adopted new copper criteria.

3 In 2015 and 2017, respectively, EPA approved those criteria. And in 2017, EPA promulgated

4 new cadmium criteria for Oregon. Many administratively continued permits were issued before

5 2015 and 2017. See Ex. 1. As a result, those permits were not analyzed based on the new criteria

6 for ammonia, copper, or cadmium.

Prior to 2011, Oregon adopted and EPA approved numerous TMDLs for many waters
9
and basins, including the Willamette, Umpqua, Rogue, Grande Ronde, and John Day basins.
10
These TMDLs developed pollutant limits for sources of pollutants including temperature,
11
mercury, dissolved oxygen, bacteria, nutrients, pesticides, sediment, ammonia, and pH. Many
12
administratively continued permits were issued prior to the approval of relevant TMDLs. See Ex.
13
1. As a result, those permits were not analyzed based on updated TMDLs.

16 Additionally, if any recently issued permits are similarly administratively continued for a

17 period far exceeding their original permit term, such as many current administratively continued

18 permits, then these permits will also eventually contain out-of-date pollutant limits.

19 Respondents continued unreasonable delay in making decisions regarding pending NPDES

permit renewal applications will cause the current permit backlog to continue to increase.

THE PERMITS AT ISSUE

Currently pending NPDES permit renewal applications constitute DEQs current permit
24
backlog. See Ex. 1. As of the date this complaint is filed, at least 75% percent of all individual
25

NPDES permits in Oregon have exceeded their original fixed five-year term and are now
1
administratively continued. See Ex. 2, at 1. Normally, EPA expects states to maintain a backlog
2

3 of administratively continued permits that compromises 10 percent or less of all NPDES permits.

4 EPA has recognized that the high permit backlog negatively impacts many aspects of Oregons

5 NPDES program. On average, to avoid backlog, 72 Oregon NPDES permits should be renewed

6 annually. DEQ has not come even close to that number for quite some time.

A significant number of Respondents administratively continued permits have
9
applications for renewal that have been pending for five years or more, beyond the first
10
statutorily mandated five-year permit term. A significant number of the administratively
11
continued permits applications for renewal have been pending for ten years or more, in addition
12
to the first statutorily mandated five-year permit term. Some of the administratively continued
13
permits have been pending for more than two decades.

CLAIM FOR RELIEF

17 This Court has jurisdiction to consider this Petition for Review of Respondents

18 unreasonable delay to make one or more decisions pursuant to ORS 183.490 and ORS 183.484.

19 This Court has authority pursuant to ORS 183.490 to compel an agency to act where it has
20
unlawfully refused to act or make a decision, or where it has unreasonably delayed taking action
21
or making a decision.

Once a completed NPDES renewal application is submitted to Respondents, they are
24
required toand for the sake of the public waters, and to give certainty to the permittees,

4 Respondents have unreasonably delayed or failed to make a decision on whether to: (a)

5 deny a permit, or (b) to prepare and issue a proposed draft updated permit, on one or more of the

6 pending NPDES permit renewal applications for renewal that comprise the current backlog of
7 administratively continued permits. See Ex. 1.

Respondents failure to make decisions regarding pending NPDES permit renewal
10
applications has resulted in multiple unreasonable delays, in some cases delays of up to two
11
decades, or for at least four full permit cycles. See Ex. 1. Respondents pattern and practice of
12
allowing an excessive backlog of administratively continued applications to exist also constitutes
13
an ongoing refusal to act and/or an unreasonably delayed agency action.

16 Pursuant to ORS 183.497, ORS 183.486, and/or ORS 182.090 Petitioners request an

17 award of attorneys fees and costs incurred in this matter.

18 REQUEST FOR RELIEF

19 WHEREFORE, Petitioners request that this Court, exercising its authority under ORS
20
182.090, ORS 183.484(5) and 183.490:
21
(1) Declare that Respondents have unreasonably delayed making a decision on each
22
NPDES permit renewal application that has been pending for longer than five years;
23
(2) Issue an order requiring Respondents to make a decision on each NPDES permit
24
renewal application that has been pending for longer than five years within a reasonable time-
25
