Article 5 COMPOSTING

Section 34. Inventory of Markets for Composts. In a six months period, the existing
markets and demands are required to have and inventory for composting with the
effectivity of this act by the DA. It is very important that the inventory will be updated
and be published annually so that it will be monitored and be provided with the necessary
data needed. It is also provided and encouraged that it will not be limited with the garden
waste but also it will be composting of agricultural wastes and other compost materials.

Section 35. Guidelines for Compost Quality. By the standards for organic fertilizers set
by the DA, compost products that are distributed commercially shall be confirmed.
Compost products shall passed the standards and the DA will assist the compost
producers to ensure and follow the proper rules and regulation in producing.

Article 6 Waste Management Facilities

Section 36. Waste Management Facilities. In a six months period, It shall publish an
inventory of all solid waste disposal facilities or sites in the country by the effective of
this Act, the Department, in cooperation with the DOH, DILG, and other concerned
agencies.

Section 37. Prohibition Against the Us of Open Dumps for Solid Waste. Provided that
within a span of three years after implementing of this Act, no open dumps shall be
established and operated and every LGUs shall convert its open dumps into controlled
dumps in accordance with the guidelines set in Section 41 Act, no controlled dumps will
be allowed five years.

Section 38. Permit for Solid Waste Management Facility Construction and
Expansion. An Environment Compliance Certificate (ECC) from Department to PD
1586 and permits and clearances of agencies that are concerned should be required or no
one should commence any operation including site preparation and construction of a new
solid waste management facility or Expansion of an existing facility.

Article 7 Local Government Solid Waste Management

Section 43. Guidelines for Identification of Common Solid Waste Management


Problems. The local government plans for solid waste management and also the
Commission shall publish guidelines for identification of areas which has a common
solid waste management problems implementing not lather than six months from the
effectivity of this Act. The following are the guidelines:
a) Size and Location of the areas is needed to be included;
b) Solid wastes volume that also generated;
c) Local government planning between among LGUs for the availability of coordinating
and for the integration for national plan;
d) Disposal facilities and its possible lifespan.
Section 44. Establishment of Common Waste Treatment and Disposal Facilities. In
accordance with the Section RA 7160 which also called the Local Government Code,
through appropriate ordinances, are hereby mandated to consolidate all provinces, cities,
municipalities, and barangays and also to coordinate any efforts, services, and resources
in addressing common solid waste management problems and will established waste
disposal facilities. Provided by technical and marketing assistance to the LGUs by the
Department, Commission, and local solid waste management boards.
