4. SECOND AMENDMENT TO THE CITY OF ALHAMBRA'S 2016-2017 ANNUAL
ACTION PLAN FOR CDBG AND HOME PROGRAMS — F2M16-26, N2W17-12,

This isthe time and place set by Notice No. N2W17-12 forthe City Council to hold a
public hearing on the reprogramming and ultlization of CDBG and HOME funds in
‘The Second Amendment to the Citys Action Plan and to recelve comment on the
proposed changes, Staff is seeking authorization to increase the funding curently
Allocated to CDBG Administration by $70,000 to provide additional program oversight
including salaries and overneae, forthe program Income activities and will be charged
by itemized timecard and authorization to commit and spend the funds on the
aforementioned program. Staff is also seeking authorization to increase the funding
currently allocated to the Home Buyer Progr by $88,512 lv provide down payment
assistance to a qualified First Time Homebuyer and authorization to commit and spend
the funds oh the aforementioned program. On February 7, 2017, staff presented the
proposed Second Amendment to the Housing and Community Development Citizen
‘Advisory Committee. The Committee unanimously recommended approval of the
Second Amendment to the 2016-2017 Annual Action Plan, The 30-day review period
began February 8, 2017 and concluded March 10, 2017. No comments from the public,
were received.
Recommended Action: ‘After receiving pubic testimony, the Mayor should
close the public hearing and, at the City Councils discretion, approve the Second

There were no change orders issued for the project. This project has been inspecied
by staff and all work has been completed in accordance with the Gity's requirements and
specfications. As such, staff requests that the City Counsl to accept this project as
complete.

BUDGET APPROPRIATION TO FUND PURCHASE OF SOFTWARE SYSTEM —

In an effort to make it easier for the public to submit applications for a variety of
purposes, such a8 Bulking and Planning applications, Pubic Records Requests, and to
be able to login and check the status of an appication, City staff has been exploring
Companies that offer these services. During this process, staff found a vendor that can
provide an excellent customer facing platform, which has work-flow bul in for staff to
easily make approvals and comments an an application. The product Is called
‘SeamlessGov from the company SeamlessDocs, In adcition to having the abilty to
Streamline the application and approval process for applications in al Cy departments,

the product also has an intranet feature and the product comes with a full redesign of the
City's website, making it more ADA accessible and more mobile friendly, a5 well as

countywide enforcement. The develooment of a grading program for mobile food

REAUTHORIZATION OF CITY PEG FEE COLLECTION AUTHORITY UNDER STATE
LAW —F95-22, o2m17.4711,
In Calfomia, franchising and regulation of cable TV and video providers is governed by
the Digital inrastnicture and Video Compatiton Act of 2006 (DIVCA). One provision of
DIVCA allows local entites to establish by ordinance a fee equal to one percent of
operator! gross revenues generated locally, which can be used solely to support Publi,
Educational and Government Access (PEG) capital expenditures. In 2007, the City
Counc amended Alhambra's Telecommunications Ordinance — Chapter 4.08 of the
‘Municipal Code to incorporate requirements for video providers franchised by the state
in conformanee with DIVCA, The amendments included establishment of the PEG Fee
for stale-ranchised providers, The current state-Issued franchises for the two video
providers operating in Alhambra - AT&T and Charter Communications (now branded a8
Spectrum) — expire in March, 2017 and January, 2018 respectively. The conclusion of
the intial 10-year terms of the state franchises is significant because DIVCA states that
local one percent PEG fee ordinances "..shall expire, and may be reauthorized, upon
the expiration ofthe state franchise." At present, itis unclear whather re-authorization of
the City's PEG Fee ordnance is required upon expiration ofthe AT&T and Charter video
franchises. However, staff has observed that other local agencies, including the City of
Los Angeles, have sought re-authorzation of thelr PEG Fee ordinances as AT&T's intial
statewide franchise comes to an end. Although a reasonable argument may be made
that DIVCA’s expiration language does not apply, there is the possibilty that PEG
funding could be lot unlase the fee is reauthorized. As such, taf recommends the City
Council approve the proposed ordinance,

Staffis seeking authorization to increase the funding currently allocated to CDBG Administration
by $70,000 to provide additional program oversight, including salaries and overhead, for the
program income activities and willbe charged by itemized timecard. Fundsto be used are from
unallocated program income. Staffis seeking authorization to commit and spend the funds on
the aforementioned program. The program is elgble to use CDBG funds provided by 24 CFR

2. HOMEBUYER PROGRAM

‘To request that the City Council approve the City’s participation in the 2017 Summer Food Service

BACKGROUND:
1. The Summer Food Service Program (SFSP) isa federally funded program, administered by
the State of California Department of Education (CDE),
2. According othe Alhambra Unified School District statistios more than 60% ofthe children who
reside with specc areas ofthe City of Alhambra, quali fr free or reduced cost mesle,
3. Inthe summer of 2016, the Cty of Alhambra provided 42,198 lunches and snacks to children
4. The proposed 2017 SFSP wil begin dstbution of lunches and snacks on Monday May 22,
2017 and will be provided Monday through Friday, through August 4, 2017.
5. The City wil be eligible for reimbursement for lunches, snacks and operational costs by the
CoE.
FINANCIAL ANALYSIS:
The CDE reimburses the City based on the number of meals and snacks that are served, and
allows any funds above the cost of food to be applied to the cost of program supplies and
personnel. Funding forthe proposed program poriod of May 29, 2017 through June 20, 2017 ie
Included in the FY 2018-2017 adopted budget. The romainder ofthe program, July 1,2017 though
‘August 4, 2017 wil be included in the FY 2017-2018 proposed budget. itis anicipated that as In

BACKGROUND:
4. The City of Alhambra has presented a Fourth of July celebration at Almansor Park that
includes a fireworks show for many years. The fireworks show is presented to the public
{tee of charge and is extremely well atended by the cizens of Alhambra
2. Staff sent Request for Proposal packels to present a fireworks show to five companies
‘that were identiied by the State Fire Commission as holding valid license for aerial
pyrotechnic displays In Calforia. Exposhows Inc. provided the sole proposal at
$28,900.
3, Exposhows Ine. successfully provided the Citys Fourth of July freworks celebration last
year.
4, The expenditure for the 2017 fireworks show must be approved in order for the City to
‘enter info @ contract with Exposhows Ine. The expenditure will be charged to FY 2017-
2018.
FINANCIAL ANALYSIS:
“The cost of the reworks ($26,900) Is appropriated inthe fiscal year in which the show will be
presented. Because the show must be booked inthe preceding year, the expenaiture of these
funds must be approved during tne preceding year so thatthe City can enter into @ contract with
2 pyrotechnic company. This approval allows for an encumbrance of funds in the preceding
year (FY 2016-2017). A 50% deposit wil be paid in FY 2016-2017 and the balance of the

4. UNION STATION HOMELESS SERVICES - F2w16-50
Deputy City Manager BINNQUIST reported that the City has contrasted with Union
Station Homeless Sarvices to provide street outreach, case management, and housing
assistance to Alhambra residents experiencing homeless. She introduced Amber Folet,
the outreach case worker assigned to the City’s contrac, and Alexis Booth, the City's
program manager. Ms. FOLLETT thanked the Council for creating this program in the
City and noted she was heartened, not only as the City’s caseworker, but as an
‘Alhambra resident, to see the City showing compassion and care for every resident in
the City al every level, She explaines that during her frst week and a half inthe positon,
she had conducted outreach to the Giy's homeless individuals to begin to build a
Felationship with them which would help build a level of trust thal would allow her know
thom as human beings and determine what their needs are. She noted that this would
allow her to ty to match each person with the more appropriate services. Finally, she
pointed out that she had also met with City staff and frst responders to make
Introductions and to discuss a coordinated way o assist homeless incviduals.

Greg MILLER noted that while the City had a good response to cals regarding graff removal or
code enforcement issues, he was concerned about trash and overflowing dumpsters. he
‘encountered on his walk along Main Street from the Emery Park area to the Alhambra Place
‘Shopping Center. He suggested the City could perhaps work with a community service program
‘te have those that need to complete service time clean up trash along the streets and sidewalks.
City Manager YOKOYAMA noted that the Puble Works Department was currently working on
various plans to clean up the Main Street area including gum removal from the sidewalk,
Installation of artificial tu, fresh plants in the planters and other tems as well. He added stafi

21347‘would continue effets to keep Main Street clean and would work with Code Enforcement to
address any issues, including any overfiowing dumpsters.

‘Vice Mayor Sham announced that he attended the City’s Lunar New Year Festival and, as
always, twas a great famiy-iendly event.
Counsitnmember Maloney announced that he had also attended the City’s Lunar New Year
Festival and noted that the size and scope ofthe event was amazing. He added that it was very
nice event and he Roped that kt would continue for years to come. He also noted that he had
allended the City’s Homeless Count and it was great to see the number of volunteers that came
‘ut to participate in identfying the homeless population inthe City. He was also glad to see that
Union Station was now working in the City to provide services for the City's homeless persons.
Mayor Mejia announced that he had recently attended a teen CERT graduation ceremony and
noted the program provided essential and important skils for Kids to know in the event of a major
feaithquake or other disaster. He added that he also recently attended the grand opening of
‘Creamistry on Main Street in the Downtown area and it was nice to see the community come out
fo the event and support a new business inthe area,

for the County of Los Angeles Public Health Deparment who requested thatthe City of Alhambra
‘adopt an ordinance conforming with the County’s as it related to inspection grading and posting of
leer grades for mobile food facilities to help ensure countywide enforcement

THE CITY COUNCIL OF THE CITY OF ALHAMBRA DOES ORDAIN AS FOLLOWS:
SECTION 1. Finaings. The Gity Council nds and deterrinas as flows
‘A. Chapter 6.16 of the Alhambra Municipal Code ("AMC") sets forth and describes
the procedures for regulation and posting of later grades for restaurants.
B. The City Council desires to include in that regulation the inspection and posting
of ltter grades to include mobile food facilities as known as food trucks.
SECTION 2. Amendment to AMC § 8.15. Chapter 6.15 Grading System for Food
Establishments ofthe Alhambra Municipal Code is amended to read as follows:
"§6.15.020 DEFINITIONS.
MOBILE FOOD FACILITY means any vehicle used in conjunction with a commissary or
other permanent food faclity upon which food is sold or distributed at retal “Mobile food facil
‘does Rot include a "Wansperter" used to transport packaged food from a food facility, or other
approved source tothe consumer.
RETAIL FOOD ESTABLISHMENT. Any food service business which prepares any
Potentially hazardous food on the premises for sale or gift to the public and includes, but is not
Tented to, all restaurants, markets, bakeries, mobile food preparation units, motile food
facilties, commissaries, and food processing establishments.
§ 6.15,045 ROUTE LOCATION FOR MOBILE FOOD FACILITIES.
‘The owner/operator of a mobile food facility shall complete a Mobile Food Faciity Route
Sheet, obtained from the County of Los Angeles, Department of Health Services, obtained trom
‘the county health officer, listing the complete adress, telephone number and arrivaldeparture
times of each location where the retal food business is being conducted. The Mobile Faclity
Route Sheet shall be maintained on fle atthe Vehicle Inspection Program, The ownerioperator
of 2 mobile food facility oF mobilo support unit shall nay the county heath officer af any

SECTION 3, Severability. If any section, subsection, subdivision, paragraph, sentence, clause
‘oF phrase, or portion of this Ordinance is, for any reason, held to be unconstitutional or Invalid oF
Ineffective by any court of competent jurisdiction, such decision shall not affect the valeity oF
effectiveness of the remaining portions of this Ordinance or any part thereof. The City Councihereby daciares that it would have adopted this Ordinance and each section, subsection,
subdivision, paragraph, sentence, clause or phrase ofthis Ordinance irrespective of the fac that
fone or more sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases be
declared unconstitutional or invalid or ineffective. To this end the provisions of this Ordinance
are declared to be severable.
SECTION 4, Publication. The City Clerk is directed to certly to the adoption ofthis Ordinance
and publish in accordance with law.

BACKGROUND
In California, ranchising and regulation of cable TV and video providers is governed bythe Digital
Infrastructure and Video Competition Act of 2006 (DIVCA). DIVCA shifted franchising of cable TV
‘and video operators from te local othe state level, and included a variey of provisions specitving
‘what local agencies could require of cable TV and video providers. One provision of DIVA alos
local entities to estabish by ordinance a fee equal to one percent of operators’ gross revenues
generated locally, which can be used solely suppor Public, Edveational and Government Access
(PEG) capital expenditures
‘The City Council amended Alhambra’s Telecommunications Ordinance — Chapter 4.08 of the
“Municipal Coda — in 2007 to incorporate requirements for video providers franchised by the statein
conformance with DIVCA. The amendments included establishment of the PEG Fee for state
franchised providers n fiscal year 20182016 the Giy collected approximately seventy-ve
‘The current state issued franchises forthe two video providers operating in Alhambra—AT&T and
Charter Communications (now branded as Specttum) — expire in March, 2017 and January, 2018
respectively. ATT applied for renewal ofits state franchise in December, 2016. Following abighly

AN ORDINANCE OF THE ALHAMBRA CITY COUNCIL
REAUTHORIZING THE PUBLIC, EDUCATIONAL, AND
GOVERNMENTAL ACCESS FEE
WHEREAS, Section 5870(n) ofthe Public Utities Code, which was enacted as part of
the Digital Infrastructure and Video Competiion Act of 2006, authorized the City of Alhambra to
adopt an ordinance establishing 2 fee on stale-ranchised video service providers to support
public, educational, and governmental access channel facities; and
WHEREAS, on June 11, 2007 the City of Alhambra adopted Ordinance Number 4497 to
establich such a fee; and
WHEREAS, Section 5870(n ofthe Public Utities Code appears to indicate that such an
ordinance shall expire, and may be reauthorized, upon the expiration ofa state franchise; and
WHEREAS, California Video Franchise Certificate Franchise No. 0902 granted to Pactic
Bell Telephone Co. abla SBC Pacific Bel Telephone Co. dfb'a AT&T California, wil expire on
March 30, 2017; and
WHEREAS, this ordinance is not intended to impose a new or increased fee, but rather
is intended to reauthorze the already existing PEG fee at the same level, tothe extent such
reauthorization is required by State law in order to continue to collect sad fe.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ALHAMBRA DOES
CORDAIN AS FOLLOWS:
SECTION 1, The City of Anambra hereby reauthorizes the fee on stateranchised video
service providers to support public, educational, and governmental channel facilities adopted in
Ordinance Number 4497, and referenced in Alhambra Municipal Code Secton 4.08.020. The
{ee shall main unchanged and in full effact as to all stateranchised video service providers,
SECTION 2. Environmental Finsings. The City Council exercises ils independent
Judgment and finds that this ordinance isnot subject to the Calforia Environmental Quality Act
(CEQA) pursuant to the State CEA Guidelines, California Code of Regulations, Tile 14
Chapier 3, section15061(b)(3) because the activity is covered by the general rule that CEQA
applies only to projects which have the potential for causing @ significant effect on the
environment and it can be seen ith certainty that there is no possibility that this Ordinance may
have a significant effect on the environment
SECTION 3, Severabilly. If any section, subsection, sentence, cause, or phrase of
lis endian fe for sty teuout held to be hvalid or unconetitaional by a decision of any court
(of competent jurisdiction, such decision will nt affect the valdity ofthe remaining portions of
this ordinance. The City Council deciares that it would have passed this ordinance and each
and every section, subsection, sentence, clause, or phrase not declared invalid or
