1. LICENCE. This document is a licence agreement between the original
purchaser of the product Layo1 PCB for Windows, hereafter known as the licensee, and Peter Baas, hereafter the licence owner. 2. RIGHTS . The licensee has no exclusive entitlement to either the software supplied or its documentation. The software is only to be installed on one single computer and used by one single user at any given time. If the software is to be installed in a network configuration the licensee is obliged to purchase a separate licence for each individual user on the network. Neither the software itself nor any of the files relating to the software may be transferred electronically from one computer to another unless a separate licence for the product has been purchased for each individual computer. 3. COPYRIGHT. The licence owner is also owner of the copyright of the software and its documentation. The copyright is protected under Dutch copyright law and corresponding international agreements. No duplicates in any form whatsoever are to be made of the software or the documentation with the exception of a back up for security reasons. The licensee is not to circulate copies of either software or documentation. The licensee is not to alter or translate either software or documentation without written consent from the licence owner. Any duplicates of either software or documentation break the licence agreement. ON NO OCCASION MAY THE LICENSEE USE, COPY, ALTER OR TRANSFER EITHER SOFTWARE OR DOCUMENTATION, EXCEPT UNDER SUCH CIRCUMSTANCES AS ARE STIPULATED IN THE LICENCE AGREEMENT. 4. TERMINATION. The licence agreement is valid until terminated. The licence will be automatically terminated should the licensee fail to comply with the terms and conditions of the licence agreement. The licensee may terminate the licence agreement by deleting the software from the computer and by destroying not only the original and backup disks but also the documentation. After terminating the agreement the licensee must sign a written declaration stating that all copies of the software and its documentation have been destroyed. 5. TRANSFERAL. The licensee may transfer the licence to a third party on condition that the third party accepts the terms of the licence agreement. In order to confirm acceptation of the terms, the third party must complete a registration form and return it to the licence owner. The original licensee must transfer all software, back ups and documentation to the third party at this time. The software installed on the computer(s) of the original licensee must then be deleted. 6. LIMITED WARRANTY. Both software and documentation are supplied 'as is' with no guarantee of suitability for any specific purpose, capability to function without error, accuracy, reliability or currency etc. The licensee uses the software and the results produced by the software entirely at his own risk. Responsibility for the costs of any damage or losses incurred while using this software or the inability to use the software lies not with the licence owner, his representatives or his distributors but with the licensee. The licence owner gives no other guarantee for the product than that described above. Neither does he give any explicit guarantee of the suitability of the product for any specific purpose. This limited warranty gives the licensee specific rights which may possibly differ from country to country. 7. UPGRADE POLICY. To be eligible for upgrades of the software the original purchaser, or the third party, to whom the licence has been transferred in accordance with the stipulations of the licence agreement, is obliged to complete the registration form and to return it to the address printed on the form. The licence owner will provide registered users with an upgrade of the software should one be issued within one year of the purchase date that appears on the purchase receipt. If the registration form is not returned to the licence owner, the latter has no obligation whatsoever to make upgrades available to the licensee, not even should the licensee be prepared to make payment for the possible costs of such. 8. CONFIRMATION. The licensee confirms that he/she has read this licence agreement and that he/she understands that he/she is bound by the terms and conditions stipulated herein. Moreover, the licensee acknowledges that this licence agreement contains the complete and exclusive terms and conditions binding the licensee and the licence owner.
