SYNOPSIS OF PROJECT

Name of Student: - Aaditya Vasu

Topic of project: - Nominee vs Legal Heir- A Judicial Review

Type of Review: - In the present context the method followed is secondary review as all
information has been collected from secondary sources.

Scope of the Project: The Paper tends to study the concepts of the Law of Insurance in the
context of Nominees and the Legal heir(s) in the Insurance policies and how the one claim over
the another.

Research Methodology: The method of Doctrinal Research has been followed.


Abstract

There are basically two questions arose from the topic,

1. Who is a Nominee?

&

2. Who is a Legal Heir?

The answer for the given questions: -

A nominee is a person that you appoint to receive an asset or investment (or


its value as promised prior) in the event of your death. A nominee may not
necessarily be a legal heir or a relative. But be aware that nominee should
be someone who you can rely on and A legal heir is referred to an individual
mentioned in the Will of a deceased person, who has an indefeasible right over
the assets or investments of the deceased. Legal heir is entitled for most assets.
If a Will is not made, then the assets of the deceased person gets shared
according to succession laws. The classification of heirs and who gets how much
is different in different succession laws.

In this project I will try to study the various aspects of it in different situations
with the help of the landmark Judgments by the Honorable Courts of India and
even of foreign Courts. This piece of work will look on the Judicial Interpretations
of Insurance Policies done by the learned Judges.
