Law Commission People with Dementia
and Learning Disabilities kept in Care
without Checks.
The Law Commission has said that lots of people
with dementia and a learning disability are being
kept in hospitals and care homes without proper
checks.
People who cannot make decisions lack the mental
capacity to consent like certain people with
dementia or learning disabilities.
Sometimes these people need to be kept safe in a
place like a hospital or care home.
For example, a dementia patient may be kept in
their care home to prevent them from wandering
off, which could put them in danger.
This is known as a deprivation of liberty and a
proper way of doing it should be in place to make
sure that this is done lawfully.
Local authorities have been under lots of pressure
and as a result 100,000 people did not have their
deprivation of liberty safeguards done it the right
way.
The Law Commission has now published the report
saying that there needs to be a new way to make
sure vulnerable people are no longer denied their
rights.

your life and care- changing the law to do with the
