I, MOISES LAYA, JR., 55 years old, married, living at No. 59 Lot 7


Amber St. Heritage Homes, Brgy. Loma De Gato, Marilao, Bulacan, witness
for the prosecution in this case, states under oath that:

PRELIMINARY STATEMENT

The person examining me is Asst. Provincial Prosecutor Christiano


Ronaldo, with address at Malolos City, Bulacan. The examination is being
held at the same address. I am answering his questions, voluntarily, to the
best of my knowledge and fully conscious that I do so under and may face
criminal liability for false testimony and perjury.

PURPOSE

This affidavit/testimony of witness Moises Laya, Jr. is being offered


to prove the existence of sufficient provocation on the part of the accused.

Q. Please state your name and other personal circumstances for the
record.
A. I am Moises Laya, Jr., 55 years old, married and with residence
at No. 59 Lot 7 Amber St. Heritage Homes, Brgy. Loma De
Gato, Marilao, Bulacan. I am an elected municipal counselor of
Marilao, Bulacan.

Q. What is your connection with the victim, Mr. Eli Laya?


A. I was the father of the deceased victim.
Q. Do you know PO2 Orlando Entines?
A. Yes.

Q. How do you know him?


A. He is living in the same village Heritage Homes Marilao,
Bulacan living fifteen blocks away from our house. Hes the
one who shot my son during his birthday celebration.

Q. Where were you last December 26, 2005?


A. I was with my son at our house where his birthday was being
celebrated.

Q. What happened that day?


A. At around 4:00 in the afternoon, my son and I was entertaining
some of our guests in our driveway when suddenly PO2 Entines
entered our gate just walking suddenly approached and shot my
son.

Q. What happened after that?


A. PO2 Entines was hurriedly grabbed and subdued by Elis four
male friends and my son was lying and bleeding barely
unconscious.

Q. What did you do after?


A. I immediately carried my son to our car and drove fast towards
Bulacan Provincial Hospital and my wife called the policemen.

Q. What happened after that?


A. The responding policemen arrived at the crime scene and PO2
Entines was turned over to them and arrested.

Q. What happened at the hospital, if any?


A. My son was barely alive when we arrived at the hospital. I am
panicking about my sons condition.

Q. What happened after?


A. The doctor immediately conducted an emergency surgery,
trying to revive my son. But eventually, my son wasnt able to
survive the four gunshot wounds he sustained and was declared
dead.

Q. As you were saying earlier, what happened a week before PO2


Entines killed your son?
A. My son and I were heading home when a motorcycle driving
fast entered a one way road where we were driving, and
it crashed with our car which my son was driving.

Q. Who was driving the motorcycle?


A. PO2 Orlando Entines.

Q. What happened after, if any?


A. PO2 Entines was drunk at that time. He was shouting and
cursing us, which led to insulting remarks and shouts of
invectives between him and my son. It eventually led to
their exchanges of fist blows.

Q. What did you do during that time?


A. I was trying to stop my son from fighting with PO2 Entines, but
since he is an athlete with big body build, I wasnt able to stop
him.

Q. What happened after that?


A. PO2 Entines lost the fight against my son. PO2 Entines then
threatened to kill me and my son before fleeing the scene with
his damaged motorcycle.

Q. What did you do after?


A. We went to the nearest hospital to get a medical report
regarding the injuries sustained by my son from the
exchange of fist blows between him and PO2 Entines.

Q. What happened after?


A. We went to the barangay hall to file a blotter. We also went to
the nearest police station to file a police blotter.

No. 143-M-2005 entitled People of the Philippines versus PO2
Orlando F, Entines for Murder;
I have faithfully recorded or caused to be recorded the questions I
asked and the corresponding answer that the witness gave;
Nor any other person then present or assisting me coached the
witness regarding his answers.
