1- INTRODUCTION
West Central Railway cane into existence from April 1, 2003. Two division (JBP
& BPL ) and one Workshop (CRWS) were earlier in Central Railway and one
division (KTT) and one workshop (WRS) were earlier in Western Railway.
The work practices and procedures have varied from division to division due to
different procedures prevailing in the parent railways. This circular lists out the
broad outlines regarding the functioning of the Industrial Relations machinery on
West Central Railway, with respect to recognized union.
2.1 Recognition has been granted to 2 Trade Unions by the WCR administration.
2.1.1 West Central Railway Mazdoor Sangh (WCRMS )---- affiliated to NFIR
Recognition granted vide letter No. WCR/PHQ/1210/PNM/WCRMS dt. 8/9.4.03
2.1.2 West Central Railway Employees Union (WCREU) --- affiliated to AIRF
Recognition granted vide letter No. WCR/PHQ/1210/PNM/WCREU dt. 8/9.4.03
3.1 Recognition was granted in accordance with the instructions contained in the
Indian Railway Establishment Manual Vol. II, Chapter XXV (Para 2510 to 2518).
3.2 Both the Trade Unions have submitted a copy of their constitutions , which were
submitted by them to the registering authorities under Trade Union Act. 1926.
3.2.1 West Central Railway Employees Union (WCREU) : Registered whit the
Additional Registrar of Trade Unions, Kota. The registration number is
KT/ARTU/1/2003 dt. 04.03.03.
3.2.2 West Central Railway Mazdoor Sangh (WCRMs): Registered with Registrar of
Trade Unions, Madhya Pradesh, Indore. The registration number is 5910 dt.
24.03.03.
3.3 The recognition of the 2 Unions was issued with the approval of GM/WCR and is
subject to the registration remaining valid.
3.4 Any amendment made to the constitution has to be intimated by the Union to
the Railway Administration in terms of Para 2513 of IREM Vol. II.
3.5 Copy of Annual Audit and Accounts: are also required to be submitted to the
Railway Administration by the recognized Unions.

4. PERMANENT NEGOTIATING MACHINERY (PNM) :
PNM was set up by the Railway Board in the year 1951 vide letter No. E.51.FE-
22 dt. 24.12.51 for maintaining contact with labour and resolving disputes and
differences which may arise between organized labour and administations.
The Secretary of the PNM at the Headquarters level is CPO and at the Divisional
/Workshop level, it is Sr. DPO /Workshop Personnel Officer. He/She hall
convene these meetings.
4.1 At headquarters, it will be once in 3 months with each union, i.e. 8 meetings in
all. In divisions and Workshops, it will be once in 2 months with each union, i.e.
12 meetings in all.
4.2 Calendar to drawn in advance: The time table for holding he meetings may be
decided by the Unions and administration by mutual consultation.
4.3 Who will attend :
4.3.1 From Union side :The number of union representatives that can be invited is 20.
The General /Divisional will submit the names of those required to attend to the
respective Secretary PNM by the General /Divisional Secretary and the names
will be circulated in advance granting them Special Casual Leave so that the
union representatives can be relieved well in time.
A person who has been granted special CL for attending the meeting by another
office bearer shall be permitted only when the request is made well in advance.
No other office union bearer can attend PNM meeting without prior approval.
4.3.2 Administration : At Headquarters, the respective PHODs and in the Divisions
/Workshops, the Branch Officers will be required to discuss their respective item.
They shall also be present when the GM /DRM/CWM is present.
4.4 Agenda for the meeting : Agenda for the meeting (Maximum 30 items) has to
be submitted will in advance (one month) of the meeting. It should not contain
either any unrelated sub items or subjects, which are not in the scope of PNM.
Keeping in view the increasing use of computers , an additional soft copy (either
floppy or CD ) can also be given.
4.4.1 Items should be submitted to the Personnel department by the General
Secretary/Divisional Secretary of the HQrs /Division and Secretary of the
Workshop branch to the Secretary/ PNM who will examine each item proposed
in the agenda.
4.4.2 Agenda should be scrutinized by Secretary, PNM and suitable follow up action
taken including marking items to the concerned officials.
4.4.3 Items accepted for inclusion in the agenda will be circulated and remarks of the
concerned officer obtained will in advance of the meeting date the Union can be
replied accordingly.
4.4.4 It is desirable that prior correspondence be made in regard to the items proposed
to be included so that by the time the meeting takes place some definite action is
taken and the discussions are conclusive and effective. The reply to such
correspondence should also be ensured before PNM date.
4.4.5 The Union may take up individual cases only after the individual concerned had
sought relief through the proper channel and only after the union is satisfied that
the individual grievances are genuine and have not been redressed.
4.4.6 This is not with any intention of restricting the activities of the Unions/Sangh, but
to give the administration as the Union and opportunity to examine every case
thoroughly and completely.
4.4.7 Agenda for Headquarters Meeting Should normally contion Policy matters
involving Hqrs and items not agreed upon at the divisional PN. Individual
subjects have to be necessarily taken up in the Divisional /Workshop PNM first
unless the issue is pending in HQ for decision.
The Board would like to emphasise that in framing the notes bearing on an item
that is proposed to be included in the agenda , because although it pertains
appropriately to a lower level, it would not be settled at such lower level, the
Union should quote the minutes of the meeting at which the discussion was held
and should indicate the reasons why it desires that the matter should be
considered yet again at a higher level. The advantage of this procedure would be
that it would not be necessary for the official at the higher level to spend
considerable time in getting to know the facts and they would therefore be in a
better position to discuss the subject at the PNM meeting than they would
otherwise be. The Board would also like to point out that items should not be
included in the agenda if they properly pertain to a lower level and have not
been discussed at such lower levels, or they pertain to a higher level at which
alone can a decision be taken.
4.4.8 An extract of the Rly. Board, letter No. E51FE0-22, dated 24.12.1951, dealing
with the seeing up of Permanent Negotiating Machinery for setting disputes
between Railway labour and Railway Administration, states as follows:
All disciplinary matters and subjects like promotion, transfer etc. of individual
members of the staff which do involve any general principle will be excluded
from the scope of the discussions at all these levels except at the discretion of
the officer concerned
4.4.9 The items of the agenda are not sometime clearly worded and often do not
bring out the exact point in dispute and what is sought to be discussed .It is in the
interest of the unions that the items of the agenda should be worded clearly,
giving complete information, view, and suggestions so that the offices who are
holding Permanent Negotiating Machinery.
4.4.10 Minutes of PNM : Extract of Para 14 of Railway Boards letter No. E(L) 56 NM1-
6 dated 21.07.1958 reproduced below is self explanatory.
Brief minutes of the meeting should be drawn up immediately after the close of
each meeting and copies given to the Unions. It should also be possible, to a
considerable extent, to dictate the conclusions in respect of each item that has
been discussed immediately after the discussion and in the presence to the
Union representatives to ensure that the result of the discussion is correctly
recorded in phraseology acceptable to both parties. The draft copy of the minutes
should be signed on behalf of both the parties.
i) Card passes for the office bearers of Zonal Unions will be issued at the rate of
one card pass per division, keeping the minimum number as six ;
ii) Two of the card [asses mentioned in (i) above will be general card passes, i.e. in
favour of one office bearer of the union , as at present, and the rest of the card
passes will be issued by name and designation of the office bearers &
iii) Card passes which are issued in the specific names and designation tf the office
bearers will also be made available upto Delhi/ New Delhi. (Rly. Bds letter No.

i) One card pass will be issued in favour of four specified office bearers of the
Divisional Union by name over the division and upto the Headquarters of the
Railway, the class of the pass being that of the person entitled to the highest class
amongst the persons specified.
As per extent rules two card pass are to be issued in favour of the divisional office
bearers to the recognized unions each containing names of 2 office bearers
instead of 4 names in one card pass. (Rly. Bds letter No. E(LR) III UTF /2 dt.
30.4.97 )
ii) Six sets of cheque passes will be given for nominated office- bearer as and when
necessary, on a requisition made by the Divisional Secretary to the DRM, available
within Divisional and six sets will be similarly granted s, which will be available
within the Divisional and upto the Headquarters of the Railway.
Passes will be issued to all members of the working committee for meetings of
the working committee. As far as meetings of the General/Central Council and
the General body are concerned special casual leave and passes will be granted
at the rate of 1 for every 1,250 members. (RBE No. E(LU)71 UT3-3 dt. 9.3.71).
Special casual leave will also be granted to delegates availing of their own
passes or PTO subject to the condition that the member of delegates to whom
special casual leave is granted does not exceed the number at the rate of one for
every 1,000 members for meeting of the General /Central council and the general
body.
Five members in addition to office bearers will be granted special casual leave
for one day for six meeting in a year.
5.2.7 The representative attending PNM meeting at the Zonal level and at the
Divisional level should be given special casual leave to enable them to be
available at the place of PNM meeting one day in advance of the date of meeting
for consultation among themselves.
6. OFFICE BEARERS :
6.1 The list of the office bearers of the union will be notified by HQrs. From time to
time on receipt of the same from the General Secretary/President. The letter
issuing the list of office bearers (including any modifications) shall be full and
complete in itself including interalia as -
i) Jurisdiction of the branch.
ii) Date from which the list becomes effective.
iii) Complete updated list of Office Bearers.
6.2 Whenever any change taken place, the full revised list be taken out instead of
only the names to be changed. It should clearly mention valid w.e.f.----------so
that any confusion is avoided.
In terms of Railway Boards letter No. E/LR/III/92/UTF/1 dated 17.1.94 & 6.7.93
retired railway employees cannot be co-opted to function as office bearers at
divisional level. As Apprentices and Trainees are not railway servants, they also
cannot be made office bearers.
1. Any proposal for transfer of an office bearer of recognized Trade Union including
the Branches there of should be communicated by the Railway to the Union
concerned and the union allowed to bring to the notice of the Divisional Railway
Manager and, if necessary later to the General Manager any objection that they
may have against the proposed transfer. If there is no agreement at the lower
levels, the decision of the General Manager would be final. Sufficient notice
should be given to the union of a proposed transfer so that the Union can make
alternative arrangement for carrying on work of making a representation against
the proposed transfer (Rly. Bds letter No. E(L)60 UTI-31 dated 19.2.60) (RBE
No. E(LR)III/79/UTF/14 dated 16.01.80).
There are two basic letters on the subject which read as under:
a) The recognized Trade Unions are allowed to conduct gate meeting in Railway
premises on the following conditions (RBE No. E(L) 60-UT-33 dt. 9.2.60 )
1) To take prior permission of Railway authority .
2) Intimation of holding gate meeting should reach to the sanctioning authority,3
days in advance.
3) No political subject will be discussed in the meeting.
4) Permission for use of loud speaker and other necessary permission as may be
required will be obtained by the Union from civil authorities.
b) In request letter, Union should mention the place/date and time of meeting which
they desire to hold. The grant of such permission is within the power of
ADRM/DRM/CWM (Rly. Bds No. P/Con/8 dt. 17/23.8.77)
8. SPECIAL MEETINGS:
Special meetings can be held at the instance of either the Union or the
administration, whenever so required, to sort out or negotiate any issue. The date
of such meetings has to be decided in advance and those called to attend shall
be granted special Casual leave.
9. In the divisions, the ADRM incharge of the PNM should keep a close watch to
ensure that the decisions taken in the PNM Meeting are implemented speedily.

10. CORRESPONDENCE
i) Letters to the General Manager are to be written by the Head Office of the
Union/Sangh.
ii) Correspondence with Divisional Officers is to be made by the Divisional Branch
of the Union/Sangh. Letters should ordinarily be addressed to the Divisional
Railway Manager /CWM or Sr. Divisional Personnel Officer /Workshop
Personnel Officer of the Division/Workshop.
iii) In regard to district Offices of the non-divisionalised Departments,
correspondence with district Officers, of Assistant Officers in independent
incharge , will be conducted by the respective Branch of the Union/Sangh.
Railway employees, who are union office bearers, are expected to put in a full
days work while on duty just as other Railway employees. The Board have
decided that no offs are to be allowed to these employees during working hours
for the purpose of union activates. Normal union work should be carried on
outside the duty periods.
The time thus spent should be treated as duty and should be covered by
operation idle form work, the time spent will be allocated against the shop on cost
work-order for idle time and this work order should be clearly indicated on the
Duty Certificate . The form of duty certificate may be devised by the workshop to
suit their practice in the case of workers brought under the incentive scheme, this
time covered by the absence as per the duty certificate will be excluded from the
tine to be charged against the piece-work job affected on the date
concerned.(RBE No. E(L)61 UFI 89 dated 07.4.62)
1 .PNM Agenda of one union should be sent under a forwarding letter to the
Other unions by the Secy. PNM.
2. On receipt of the same the other union can bring to the notice of the
Administration any facts pertaining to item which they consider as important .
These aspects will be taken into account before arriving at a decision in the PNM
meeting.
3. If, the other union is not satisfied with the decision taken in the PNM in respect of
the item on which they had given their views then the fresh facts which are
subsequently brought to the notice of the Administration will be examined.
4. If, as result of the fresh facts, any change in the decision is warranted, the
reasons for such change will be advised by the Administration to the union with
whom the decision was taken. If the union accepts the change in the decision,
the same will be communicated and treated as final.
5. If, on the other hand, the union with whom the decision was taken does not agree
for any revision of the decision, the papers will be put up to the GM for a final
decision. The decision given by the GM will be final and thereafter the issue will
not be further discussed at zonal level.
6. However, every case should be examined by both the unions as well as the
administration in matters of cross items as they affect Industrial Relations and
adversely affect the employees in general. Therefore cross items should be
avoided by unions.
7. Any further correspondence of fresh PNM item on the decision taken in the PNM
in respect of items on which the other union had initially given views sholdbe
made within a period of 45 days of the date of the issue of PNM minutes. Any
representation received after 45 days thereof will not be entertained.
Note : The relevant instructions of the Board, where quoted, should be referred to in
case of any doubt.
