AnOrdinancetorepealand,withcertainmodifications,re enacttheEmigrationAct,1922.

WHEREASitisexpedienttorepealand,withcertainmodifications,reenacttheEmigrationAct,
1922(VIIof1922).

ANDWHEREASthePresidentissatisfiedthatcircumstancesexistwhichrenderitnecessaryto
takeimmediateaction

Now,THEREFORE,inpursuanceoftheProclamationofthefifthdayofJuly1977,readwiththe
Laws (Continuance in Force) Order, 1977 (C.M.LA Order No. 1 of 1977), and in exercise of all
powers enabling him in that behalf, the President is pleased to make and promulgate the following
Ordinance:__

CHAPTERI

PRELIMINARY

1.Shorttitle,extent,applicationandcommencement.__(1)ThisOrdinancemaybecalledthe
EmigrationOrdinance,1979.

(2)ItextendstothewholeofPakistanandappliestoallcitizensofPakistan,wherevertheymay
be.

(3)Itshallcomeintoforceatonce.

2. Definitions.__(1) In this Ordinance, unless there is anything repugnant in the subject or


context,

(a)BureaumeanstheBureauofEmigrationandOverseasEmployment

(b)conveyancemeansanyvehicle,aircraftorshipusedforthetransportationofemigrants

(c)Corporationmeans,theOverseasEmploymentCorporationLimited

(d) depart and departure means the departure out of Pakistan of any person for
employmentorselfemploymentbyanymeans

(e) dependent, in relation to an emigrant, means the spouse, sons not above the age of
twentyoneyears,andunmarriedsistersanddaughtersoftheemigrant,andincludesaged
or incapacitated parents, incapacitated sons above the age of twentyone years and
widowedanddivorcedsistersanddaughtersoftheemigrantwhollydependentuponand
residing with the emigrant and the sons not above the age of twentyone years, and
dependentunmarrieddaughters,ofsuchwidowedordivorcedsistersordaughters

(f) DirectorGeneral means the DirectorGeneral, Bureau of Emigration and Overseas
Employment, appointed under section 3, and includes any person for the time being
dischargingthefunctionsofDirectorGeneral

(g)emigrantmeansanypersonwhoemigratesorhasemigratedorwhohasbeenregistered
asanemigrantunderthisOrdinanceandincludesanydependentofanemigrant

(h)emigrateandemigrationmeansthedeparturebysea,airorlandoutofPakistanof
anypersonforthepurpose,orwiththeintention,ofworkingforhireorengaginginany
trade,professionorcallinginanycountrybeyondthelimitsofPakistan

(i)foreignserviceagreementmeansanagreementbetweenanemigrantandhisprospective
employerabroadorhisauthorisedOverseasEmploymentpromoterinPakistancontaining
termsandconditionsofhisemploymentanddulyregisteredwiththeprescribedauthority

(j)OverseasemploymentPromotormeansapersonlicensedassuchundersection12

(2)Incaseofanydoubtordisputearisingotherwisethaninthecourseofanylegalproceedings
astowhetheranypersonisanemigrantwithinthemeaningofthisOrdinance,thequestionshallbe
determinedbytheFederalGovernment,andsuchdeterminationshallbefinal.

CHAPTERII

DIRECTOR GENERALANDPROTECTOROFEMIGRANTS

3. Director General, Bureau of Emigration and Overseas Employment.__(1) The Federal


GovernmentmayappointapersontobetheDirectorGeneral,BureauofEmigrationandOverseas
Employment,forthewholeofPakistanandsuchotherofficersasmaybenecessaryorexpedientto
assisttheDirectorGeneral.

(2)TheDirectorGeneralandeveryotherofficerappointedundersubsection(1)shallbeapublic
servantwithinthemeaningofsection21ofthePakistanPenalCode(ActXLVof1860).

4. Functions of Director General. Subject to the provisions of this Ordinance and the overall
supervisionandcontroloftheFederalGovernment,theDirectorGeneralshalltakesuchmeasuresas
maybenecessary

(c)tolookaftertheinterestandwelfareofemigrants

andtodischargeandperformsuchotherdutiesandfunctionsasmaybeassignedtohimbythe
FederalGovernment.
2[4A. Functions of Corporation. Subject to the provisions of this Ordinance and the overall
supervisionandcontroloftheFederalGovernment,theCorporationshalltakesuchmeasuresasmay
benecessarytopromoteemigrationofcitizensofPakistan.]

Protection of interests of Overseas Pakistanis.__ (1) Subject to provisions of this
Ordinance,theDirectorGeneral,uponreceiptofacomplaintfromanOverseasPakistanioraholder
ofPakistanOriginCardregardinganymatterincludingillegaldispossessionofproperty,afterhaving
beensatisfiedthatthecomplaintisPrimafaciegenuine,shall,inaccordancewithsuchprocedureas
maybeprescribedandwithinfifteendaysofreceiptofsuchcomplaint,referittotheGovernment
concernedforappropriateaction,withacopytothecomplaint.

(2)TheDirectorGeneralshallsubmitannualreporttotheFederalGovernmentregardingstatus
ofcomplaintreceivedundersubsection(1)".]

5.AppointmentofProtectorsEmigrants.(1)TheFederalGovernmentmayappointapersonto
beaProtectorofEmigrantsanddefinetheareatowhichtheauthorityofaProtectorofEmigrantsso
appointedshallextend.

(2) Every Protector of Emigrants shall be a public servant within the meaning of the Pakistan
PenalCode(ActXLVof1860).

6.GeneraldutiesofProtectorofEmigrants.EveryProtectorofEmigrantsshalldischargesuch
dutiesasmaybeassignedtohimbytheFederalGovernment.

7. Appointment of Labour Attaches. The Federal Government may, for the purpose of
safeguardingtheinterestsofemigrantsandpromotingOverseasEmployment,Appointapersontobe
aLabourAttacheinaplaceoutsidePakistanandmaydefinehisduties.

8.Regulationofemigration.__(1)EmigrationfromPakistantoallcountriesoftheworldforthe
time being recognised by Pakistan shall be lawful if it is in conformity with the provisions of this
Ordinanceandtherules.

(2)SubjecttotheprovisionsofthisOrdinanceandtherulesandanyotherlawforthetimebeing
in force, the emigration of a citizen of Pakistan shall be lawful if he is in possession of a letter of
appointmentoraworkpermitfromaforeignemployeroranemploymentvisaoranemigrationvisa
fromaforeignGovernment,orbehasbeenselectedforemigrationbytheforeignemployerthrough
the DirectorGeneral or by an Overseas Employment Promoter or under an agreement or treaty
betweentheGovernmentofPakistanandaforeignGovernment.

(3) If the Federal Government, having regard to the occupation, profession, vocation or
qualificationsofanypersonorclassofpersons,issatisfiedthatemigrationofsuchpersonorclassof
personsisnotinthepublicinterest,itmay,byrules,regulateemigrationofsuchpersonorclassof
personsandthedepartureofsuchpersonorclassofpersonsotherwisethaninaccordancewithsuch
rulesshallnotbelawful.

(4)TheFederalGovernmentmay,bynotificationintheofficialGazette,prohibit,fromadateand
for reasons to be specified in the notification, all persons or any specified class of persons from
emigratingtoalloranyspecifiedcountry.

CHAPTERIV

GENERAL

9. Prohibition of advertisement, etc. No person other than the Corporation shall recruit a
citizen of Pakistan or issue an advertisement or publish any material or hold any interview or
examinationforsuchrecruitmentforthepurposesofemigration,exceptwiththepriorpermissionof
theDirectorGeneralortheProtectorofEmigrantsofthearea,inaccordancewithsuchconditions,if
any,asmaybeprescribed.

10. Advisory Committee. The Federal Government may, for the purpose of advising the
Government, constitute an Advisory Committee, in such manner as it may think fit, and may
prescribetheproceduretobefollowedandthefunctionstobeperformedbysuchCommittee.

11.Powertosearchanddetainvessels,etc.TheDirectorGeneral,aProtectorofEmigrantsor
anyofficerauthorisedbytheFederalGovernmentmay,forthepurposeofpreventingthecommission
ofanyoffenceunderthisOrdinance,exerciseallthepowersconferredontheofficersofcustomsby
the Customs Act, 1969 (IV of 1969), with regard to the searching and detention of vessels or
otherwiseforthepreventionofsmugglingonboardthereofand,forthispurpose,heshallhavethe
authority to enter any port or point of entry or departure or inspect any conveyance carrying or
bringingorbelievedtobecarryingorbringinganyemigrant.

APPOINTMENTOFOVERSEASEMPLOYMENTPROMOTERS

12.GrantofOverseasEmploymentPromotersLicence.__(1)Whoeverdesirestoengage,or
toassistortorecruitanypersontoemigrateshallapplyforalicencetotheFederalGovernmentand
shallwithhisapplicationfurnishsuchinformationanddocuments,paysuchsecurityandfee,andat
suchtimeandinsuchmannerasmaybeprescribed.

(2) On receiving an application under subsection (1), the Federal Government may, after such
inquiryasitmaydeemnecessary,grantthelicenceappliedforonsuchtermsandconditions,ifany,
andonpaymentofsuchfeeandonfurnishingsuchsecurity,asmaybeprescribed,orwithholdsuch
licence,andthedecisionoftheFederalGovernmentshallbefinal.

1[(2A)AlicenseissuedundertheEmigrationAct,1922(VIIof1922)shallbedeemedtohave
beenissuedunderthisOrdinance,butitshallnotbedeemedtobeavalidunlessthesecurityandfee
for the said licence as prescribed by this Ordinance and the rules made thereunder have duly been
paid.].

(3) If at any time during the period for which a licence is valid the Federal Government is
satisfied, after making such inquiry as it may deem nary, that the licensee has been guilty of
misconduct,orthathisconductandperformanceasalicenseehasbeenotherwiseunsatisfactory,or
that he has committed a breach of any of the provisions of this Ordinance or the rules or the
prescribedcodeofconduct,theFederalGovernmentmay,byorderinwriting,cancelthelicenceor
suspenditforaspecifiedperiodandmayalsopassordersinregardtotheforfeitureofthesecurity
furnishedundersubsection(2)inwholeorinpart,andthedecisionoftheFederalGovernmentshall
befinal.

Before an order is passed under subsection (3), the licences shall be afforded an
opportunityofbeingheard.].

(4) On the expiry of the period for which the licence is granted, or on being informed by the
licenseethathedoesnotproposetocontinuetoactasanOverseasEmploymentPromoter,andon
being satisfied that no ground exists for forfeiting the security in whole or in part the Federal
Governmentmayorderthereturnofthesecurityoranypart,thereoftothepersonbywhomitwas
furnishedortohisauthorizedrepresentative.

13.Powerstowithdrawlicences.NotwithstandinganythingcontainedinthisOrdinance,if,at
any time, it appears to the Federal Government that, in the public interest, it is necessary to
discontinue the practice of granting licences to Overseas Employment Promoters, it may, by
notification in the official Gazette, withdraw all such licences and entrust the functions concerning
emigration for employment abroad to the Corporation or any other institution established or
controlledbyGovernment,insuchmannerasitmaydeemfit.

14.DelegationofpowertoDirector Generaltoreceiveanddisposeofapplication.__(1)The
FederalGovernmentmay,bynotificationintheofficialGazette,delegateitspowersundersection12
totheDirectorGeneraloranyotherofficer:

Provided that an appeal shall lie to the Federal Government from an order passed by the
DirectorGeneraloranyotherofficerinexerciseofthepowerdelegatedtohim,andthedecisionof
theFederalGovernment2[takenaftertheappellanthasbeenaffordedanopportunityofbeingheard]
shall,subjecttosubsection(2)befinal.

(2)TheFederalGovernmentmayreviewitsdecisionundersubsection(1)andthedecisionofthe
FederalGovernmentinreviewshallbefinal.3[:].

(3) The DirectorGeneral shall maintain, in such form as may be prescribed, a register of the
namesofallpersonstowhomlicenceshavebeengrantedundersubsection(2)ofsection12.

15. Appearance of engaged persons before, and registration of names by, Protector of
Emigrants. Before any person emigrates, he shall appear in person, alongwith the overseas
EmploymentPromoterbywhomhehasbeenengagedorassistedorrecruitedforemploymentabroad
or his duly authorised representative, before the Protector of Emigrants and furnish to him such
informationasmaybeprescribed.

CHAPTERVI

RULES

16. Power to make rules.__(1) The Federal Government may, by notification in the official
Gazettemakerules1forcarryingoutthepurposesofthisOrdinance.

(2)Inparticularandwithoutprejudicetothegeneralityoftheforegoingpower,suchrulesmay
provideforalloranyofthefollowingmatters,namely:

(a)thepowersanddutiesoftheseveralofficersappointedbytheFederalGovernmentunder
thisOrdinance

(b)thelicensing,supervisionandcontrolofOverseasEmploymentPromotersandthe
prohibitionofunlicensedpersonsfrombeingengagedincausingorassistingorrecruiting
personstoemigrateandintheconveyanceandaccommodationofemigrants

(c)theestablishment,supervisionandregulationofanyplacesofaccommodationprovidedfor
emigrantsandfortheirmedicalcarewhileresidentthere

(d)theformstobemaintainedandthereturnstobesubmittedbytheOverseasEmployment
PromotersandtheCorporation

(e)theinformationtobefurnishedbyOverseasEmploymentPromoterstoemigrant,andthe
languageinwhichsuchinformationistobefurnished

(f) the production and examination of emigrants before the Protector of Emigrants or such
otherauthoritiesas,maybeappointedisthisbehalf

(g)theagebelowwhichpersonofeithersexmaynotemigrateexceptasdependents

(h)thereceptionandthedespatchtotheirhomesofreturningemigrants

(i) the fees, if any, payable by Overseas Employment Promoters to the Protectors of
EmigrantsforeachemigrantdepartingfromPakistan

(j)executionofabondbyanemigrant,orapersonproceedingabroadforeducation,studies
or training, or any other purpose, in which he undertakes to return to Pakistan after a
specifiedperiod

(k) setting up of training centres and orientation and briefing centres to guide and advise
intendingemigrantsandtheirdependentsproceedingabroad

(l)therecallandrepatriationinthepublicinterestofsuchemigrantsasmaybeprescribed

(m)thetimewithinwhichanappealundertheprovisotosubsection(1)ofsection14maybe
presented.

(n)creationofwelfarefundandmeasuresforthewelfareofemigrantsandtheirdependents
andestablishmentofmachineryathomeandabroadfortheimplementationofsuchrules

(o)thedisposalofcomplaintsagainstOverseasEmploymentPromoters

(p)theformationofanOverseasEmploymentPromotersAssociationandcodeofconductto
beobservedbyOverseasEmploymentPromoters

(q)theservicechargestobepaidtoOverseasEmploymentPromotersandtheCorporationby
theemigrantand

(r)thedepositingoffeesandsecuritiesbyOverseasEmploymentPromoters.

CHAPTERVII

OFFENCES,PENALTIESANDPROCEDURE

17. Unlawful emigration, etc.__(1) Whoever, except in conformity with the provisions of this
Ordinanceandtherules,emigratesordepartsorattemptstoemigrateordepartshallbepunishable
withimprisonmentforatermwhichmayextendtofiveyears,orwithfine,orwithboth.

(2)Whoever,exceptinconformitywiththeprovisionsofthisOrdinanceoroftherules,

(a) makes, or attempts to make, any agreement with any person purporting to bind that
person,oranyotherperson,toemigrateordepartor

(b) causes or assists, or attempts to cause or assist, any person to emigrate or depart or to
attempt to emigrate or depart or to leave any place for the purpose of emigrating or
departingor

(c)causesanypersonengaged,assistedorrecruitedbyhim,aftergrantofthelicencereferred
to in section: 12, to depart without appearing before the Protector of Emigrants as
requiredbysection15

shallbepunishable

(i)forafirstoffence,withimprisonmentforatermwhichmayextendtofiveyears,orwith
fine,orwithbothand

(ii)forasecondorsubsequentoffence,withimprisonmentforatermwhichmayextendto
sevenyears,orwithfine,orwithboth.

(3)When,inthecourseofanyproceedinginconnectionwithemigrationinwhichanOverseas
employment promoter is concerned, a breach of the provisions of this Ordinance or of the rules is
committed,suchpersonshallbeliabletothepunishmentprovidedbysubsection(2),unlessbeproves
thathewasnotresponsibleforandcouldnothavepreventedthecommissionofthebreach.

(4) Whoever, in contravention of the provisions of section 9, recruits a citizen of Pakistan or


holdsandintervieworexaminationorissuesanadvertisementforsuchrecruitment,andtheeditor,
printerandpublisherofanewspaperinwhichsuchadvertisementispublished,shallbeliabletothe
punishmentprovidedbysubsection(2).

18.Fraudulentlyinducingtoemigrate,etc.Whoever,__

(a)forgesanydocumentrequiredfororrelatingto,theemigrationofanyperson,orhasinhis
possession or under his control any instrument or article which may be used for the
purposeofsuchforgeryor

(b)bymeansofintoxication,coercion,fraudorwilfulmisrepresentation,causesorinduces,
or attempts to cause or induce, any person to emigrate, or enter into any agreement to
emigrate,orleaveanyplacewithaviewtoemigrating

shall be punishable with imprisonment for a term which may extend to fourteen years, or with
fine,orwithboth.

19. False representation of Government authority. Whoever falsely represents that any
emigrantisrequiredbytheGovernmentoristobeengagedonbehalfoftheGovernment,shallbe
punishablewithimprisonmentforatermwhichmayextendtofiveyears,orwithfine,orwithboth.

20.Violationoftermsofagreementwithforeignemployerbyemigrant.Whoeverviolatesthe
termsoftheagreementwithhisforeignemployerbyabandoninghisemploymentorotherwiseshall,
afterhisrepatriationtoPakistan,bepunishablewithfinewhichmayextendtotenthousandrupees.

21.Certainamountrecoverableasarrearsoflandrevenue.Theamountofanyexpenditure
incurredbytheFederalGovernmentfortherepatriationtoPakistanofapersonwhoisconvictedof
anoffencepunishableundersubsection(1)ofsection17,orsection20,andtheamountpayableby
any person in pursuance of an agreement or bond or undertaking executed in pursuance of this
Ordinanceortherules,shallberecoverablefromsuchpersonasanarrearoflandrevenue.

22. Receiving, money, etc. for providing foreign employment. Whoever, for providing or
securing,oronthepretextofprovidingorsecuring,toorforanypersonemploymentinanycountry
beyondthelimitsofPakistan,

(a) being an Overseas Employment Promoter, charges any fee in addition to the prescribed
amount,or

(b)notbeingsuchaPromoter,demandsorreceives,orattemptstoreceive,forhimselforfor
anyotherperson,anymoneyorothervaluablething,

shall be punishable with imprisonment for a term which may extend to fourteen years, or with
fine,orwithboth.

23. Penalty for other offences. Whoever contravenes, or fails to comply with, any of the
provisionsofthisOrdinanceortherulesshall,ifnootherpenaltyisprovidedbythisOrdinancefor
suchcontraventionorfailure,bepunishablewithimprisonmentforatermwhichmayextendtoone
yearandwithfine.

24.SpecialCourts.__ (1) The Federal Government may, by notification in the official Gazette,
.setupasmanySpecialCourtsasitconsidersnecessaryand,whereitsetsupmorethanoneSpecial
Court,shallspecifyinthenotificationtheheadquartersofeachSpecialCourtandtheterritoriallimits
withinwhichitshallexercisejurisdictionunderthisOrdinance.

(2)ASpecialCourtshallconsistofapersonwhoisorhasbeenaSessionsJudgeoranAdditional
SessionsJudge.

(3) Notwithstanding anything contained in the Code of Criminal Procedure, 1898 (Act V of
1898),anoffencepunishableunderthisOrdinanceshallbetriedexclusivelybyaSpecialCourt.

(4)TheprovisionsoftheCodeofCriminalProcedure,1898(ActVof1898),so.farastheyare
not inconsistent with the provisions of this Ordinance, shall apply to the proceedings of a Special
CourtandsuchCourtshallbedeemedtobeaCourtofSessionforthepurposesofthesaidCodeand
the provisions of Chapter XXIIA of the Code, so far as applicable and with the necessary
modifications,shallapplytothetrialofcasesbyaSpecialCourtunderthisOrdinance,andaperson
conductingprosecutionbeforeaSpecialCourtshallbedeemedtobeaPublicProsecutor.

(5)Forthepurposesofsubsection(4),theCodeofCriminalProcedure,1898(ActVof1898),
shallhaveeffectasifanoffencepunishableunderthisOrdinancewereoneoftheoffencesreferred
toinsubsection(1)ofsection337oftheCode.

Providedthat,inacaseinwhichthecomplaintisnotaccompaniedbysuchsanction,theSpecial
Court shall, immediately on its receipt, refer the matter to the Federal Government and if the
requiredsanctionisneitherreceivednotrefusedwithinsixtydays,ofthereceiptofthereferenceby
theFederalGovernment,suchsanctionshallbedeemedtohavebeendulyaccorded.]

1[24A.Appeal.__(1)APersonsentencedbyaSpecialCourtmaywithinfortyfivedaysofthe
order,preferanappealtotheHighCourt.

(2)WhereaSpecialCourthaspassedanorderofacquittal,

(a)TheFederalGovernmentmaydirectanyofitsLawOfficerstopresentanappealand

(b)inthecaseofaprosecutionforanyoffencepunishableunderthisOrdinance,theperson
inrespectofwhomtheoffenceisallegedtohavebeencommittedmay,withinaperiodof
fortyfivedays,appeal,totheHighCourtagainsttheorder.]

25. Indemnity. No suit, prosecution or other legal proceeding shall lie against any person for
anythingwhichisingoodfaithdoneorintendedtobedoneinpursuanceofthisOrdinanceorany
rule.

CHAPTERVIII

VALIDATION,SAVINGS,ETC.

26. Validation. Any power or function of the Federal Government, the DirectorGeneral or a
ProtectorofEmigrantsundertheEmigrationAct,1922(VIIof1922),ortherulesmadethereunder
exercisedorperformed,beforethecommencementofthisOrdinance,byanyofficersubordinateto
theFederalGovernmentshallbedeemedtohavebeenvalidlyexercisedorperformed.

27.Savings.NothinginthisOrdinanceshallbedeemedtoapplytothedepartureofaperson,__

(i)whoisnotacitizenofPakistan

(ii)whoisintheserviceofPakistan,orintheserviceofalocalauthorityoracorporation
owned or controlled the Federal Government or a Provincial Government and is
proceedingondutyorforemploymentwithanyinternationalorganizationorfortraining
oronleave,withthepermissionoftheFederalGovernment

(iii) who is proceeding under a foreign scholarship or training scheme approved by the
FederalGovernment

(iv)whoisengagedascrewonboardaforeigngoingvesselinaccordancewiththeprovisions
oftheMerchantShippingAct,1923(XXIof1923)

(v) who is engaged as crew on board a foreign going aircraft in accordance with the
provisions of the Civil Aviation Ordinance, 1960 (XXXII of 1960), and the rules made
thereunder

(vi)whoisproceedingabroadforHajorZiaratandiscertifiedbytheFederalGovernmentor
anofficerauthorisedbyitinthisbehalftobesoproceeding

(vii) who is a dependent of a citizen of Pakistan who is already settled or employed in a


foreigncountryor

(viii)whoisalreadysettledoremployedinaforeigncountryandisonatemporaryvisitto
Pakistan.
