AFFIDAVIT of DESISTANCE

I , married, Filipino Citizen, of legal age, and a resident

of-------------, Philippines under oath depose and state that:

1. I am the private complainant in I.S No. ----------against

the Respondents;

2. After careful deliberation, I found that the case does

not merit or warrant criminal prosecution as the injuries
and/or damage suffered was the result of a
misunderstanding and were able to settle and come up
with a compromise agreement relative to the above
entitled case for the delivery of the Owners Copy of the
Title subject matter of this case and in turn my delivery
of my balance of Php. 20,000.00 processing fee to the
respondents.

3. In view of the foregoing, I am no longer interested in

further prosecuting the instant case against the
accused and neither will I appear and testify against
him in connection with the instant case, even as I thank
the office of the City Prosecutor for having acted on my
case with dispatch;

4. This affidavit is being executed by me, of my own

free will and volition for the purpose of seeking a
 dismissal of the pending action
against______________________;

5. I have read and understood the foregoing

statements and I attest that the same are true and
correct to the best of my knowledge and belief.
