A by-law to regulate Secend-
hand Dealers, Pawnbrekers and
Junk Dealers.
THE COUNCIL OF THE CITY OF VANCOUVER, in epen meoting
assembled, enacts as fellews:-

This by-law may be cited as the “Second-hand Dealers
In this by-law unless the context etherwise requires:-
“Junk” ineludes any ef the follewing used
or old articles or things: rubber, tires, metal,
bottles, glass, paper, sacks, wire, repes, rags,
machinery, or any other article or thing commonly
found in a junk shop;
“Junk Dealer" means a person who carries on
the business of purchasing or selling junk; or who
earries on the business of a junk stere or junk shop;
"pawnbroker" includes every person who carries
on the business of taking goods and chattels in
Pawn;
"purehase" includes buy, barter, deal in, take
in exchange, take in part payment, or receive on
consignment; "purchasing" end "purchased" shall be
construed accordingly;
"Second-hand Dealer" includ
(1) Every person carrying on the
trade or business of purchasing or selling
any second-hand goods, wares, or merchand-
ise, or who keeps a store, shop, or other
place of business for the purposé of carry-
ing on such trade or business;
(2) Every person whe, while licensed
or required to procure a license for any
occupation, or calling other than
referred to in this by-lew, pur-
either as principal or
“hand goods, wares, or mer-
chandise whatsoever.
Any person mentioned in clause
(2) hereof shall not be required to pay
license fee as a second-hand dealer,

3. (1) Every second-hand dealer and every junk dealer
shall keep a record of all goods, articles, or things purchased
or otherwii
ink in a plain legible hand in the English language, and shall
be made at the time of or immediately after such purchase in a
reeeived by him, Such record shall be written in
book known as the "Second-hand Dealers! Register." Such record
shall include the following particulars:-
(a) & correct account and description of, and any
descriptive mark or name on any goods, articles,
or things purchased, or received;
{b) The price paid for such goods, articles, or things;
(c) The precise date and hour of purchasing er receiving
such geods, articles, or things;
(a) The name, residence, or street address and des-
eription of the person from whom such goods,
articles, or things were purchased or received.
(2) Such register shall at ell reasonable times
during business hours be produced for the inspection of the
Chief Consteble of the City or any other officer or member
of the Police Force of the City, the License Inspector of the
City, or any person authorized to make such inspection on his
or its behalf, and may be removed at any time by any such
officer for inspection at police headquarters, or for use as
evidence in Court, Such dealer shall, immediately on the
return to him of such register, enter therein in proper
sequence each and every transaction involving the purchasing
of goods, articles, or things made during the absence of such
register.
(3) No Second-hand Dealer or Junk Dealer, shall
permit any entry made in such book to be e!

any part of them to be cut out or removed.-3-
(4) It shall be the duty of every Second-hand
Dealer and Junk Dealer to make out and deliver to’ the Chief
Constable of the City daily before the hour of 9:30 a.m, on
® form to be provided for that purpose by the Chief Constable
& legible and correct statement copied from the book mentioned
in the preceding subsections of this section, which statement
shell be signed by him, and shall set forth:
(a) A correct account and description of and any
descriptive mark or name on each and every
article or thing purchased or received by him
during the twenty-four hours immdiately pre:
ing the hour of 8:30 a.m. of the day on which
such report is made;
(b) The price paid therefor;
(ce) The precise time of purchasing or receiving such
article or thing;
(4) ‘The names, places of residence, and street addresses
of the persons from whom such purchase was made, or
from whom such article or thing was received. in
case of Sunday or a public holiday intervening, such
report shall be made on Monday or the day following
such holiday, and in such event the report shall
cover the whole period subsequent to 8:30 a.m, of
the day on which the lest preceding report was made.
(5) No Second-hand Dealer or Junk Dealer shall,
during the period of his license as such, carry on eny busin
@ pawnbreker unless such person has also taken out a Pawn-
broker's license.
(6) Every license granted to a Second-hand Dealer
or Junk Dealer shall designate the house or place in which
the person receiving such licenses shall be authorized to
carry on such business as a Second-hand Dealer or Junk Deeler,
and he shall not carry on sny such business at any place not
so designated.
(7) In case any Second-hand Dealer or Junk Dealer
shall remove his place of business from the place designated in-4-
such license, he shall immediately thereupon give notice to
the Inspector and have his change of address endorsed on such
license, and also the street mumber of his new place of business,
and thereafter he shall carry on business only at such new address.
(8) No Second-hand Dealer or Junk Dealer shall pur-
chase or receive in the way of his business any goods, article,
or thing whatsoever from any person whomsoever between the hours
of six (6) o'clock p.m, and six o'clock a.m, the next day.
(9) No Second-hand Dealer or Junk Dealer shall pur-
chase or receive in the way of his business any goods, article,
or thing whatsoever from any person under the age of eighteen
(18) years.
(10) Every Second-hand Dealer and Junk Dealer shall
forthwith on demand being made by the Chief of Police or eny
member of the police force of the City, present for view to
such Chief or member of the police force any and every article
and thing coming into his possession in the way of his business,
inspection of which is required by such Chief or member of the
police force.
(11) Every Second-hand Dealer and Junk Dealer shall
have his name and address painted plainly in English lettering
on the front of the premises where he carries on such business,
and if he carries on such business by means of a vehicle or
vessel, then such name and address shall be plainly painted
in English lettering on both sides of such vehiele or vessel.
(12) No Second-hand Dealer or Junk Dealer shall alter,
repair, dispose of, or in any manner part with any goods,
articles, or things purchased or received by him, nor shall he
allow any such goods, articles, or things to be removed from the
premises or otherwise disposed of until after the expiration of-5-
fifteen clear days from the date of purchase, exclusive of
Sundays and holidays; and until the expiration of the said
fifteen clear days, such goods, articl
, or things shall be
segregated and kept apart from all other goods, articles, or
things in or on such premises, and shall be subject to inspect-
ion at any reasonable time during business hours by any member
of the police force of the City, and by any person accompanied
or delegated by any officer of such police force, for the purp-
ose of identifying any such goods, articles, or things reported
or suspected of having been stolen.
(13) The License Inspector shall, as soon as a license
is issued to a Second-hand Dealer or Junk Dealer, forward to
the Chief Constable written particulars thereof.
PAWNBROKERS
4. (1) No license shall be issued to any person carry-
ing on or conducting the business of a Pawnbroker ‘within the
City who holds a license as an auctioneer, or is a member of
any firm or partnership holding a license to cerry on the
business or calling of an auctioneer.
(2) Every pawnbroker shall keep the books md docu-
ments required to be kept by him pursuant to the "Pawnbrokers
Act" open during the hours of business to the inspection of the
Ghief Constable or any member of the police force of the City,
and also every article or thing pawned or pledged with him.
(3) No Pawnbroker shell, unless he has also taken out
@ license as a Second-hand Dealer, purchase or buy any second-
hand goods, articles, or things whatsoever from any person.
(4) It shall be the duty of every Pawnbroker to make~6-
out, sign, and deliver to the Chief Constable of the City or
officer in charge at the nearest police station every day before
the hour of 9:30 a.m. (excepting Sundays and public holidays) a
legible and correct statement taken from the book specified in
subsection (2) hereof, containing a list of all personal property
received by him in the way of his business during the twenty-four
hours immediately preceding the hour of 8:30
m, on the day on
which such statement is delivered as afor
id, and stating there-
in oll the particulars entered in said book relating to such
property.
(5) | Sueh report on any day following a Sunday or
public holiday shall cover the whole period subsequent to 8:30
a.m. of the day on which the last preceding report was made.
(6) No Pawnbroker shall employ any person under the
age of eighteen (18) years in the way of his business.
(7) No Pawnbroker shall take in pawn any goods,
article, or thing whatsoever from any person whomscever between
the hours of six o'clock p.m, and six o'clock a.m, of the follow-
ing day.
PERSONS VIOLATING BY-LAW DEEMED GUILTY
5. Every person who violates any of the provisions of
this By-lew, or who suffers or permits any act or thing to be
done in contravention or in violation of any of the provisions
of this By-law, or who neglects to do or refrains from doing
anything required to be done by any of the provisions of this
by-law, or who does any act which violates any of the previsions
of this By-law, shall be deemed to be guilty of an infraction
thereof, and liable to the penalty hereinafter provided.-T-
PEWAL CLAUSE
Any person guilty of an infraction of this By-law
shah ‘upon convietion thereof before the Mayor, Police Magist-
rate, oF any b9o Justices of the Peace, or other Nagistrate or
Magistrates having jurisdiction in the City of Vancouver, on
the oath or affirmation of any credible witness, forfeit and
pay at the discretion of the said Mayor, Police Magistra’
Justices, or other Magistrate or Magistrates convicting, @
fine or penalty not exceeding the sum of one hundred dollars
and costs for each offence, and in default of payment thereof,
forthwith it shall be lawful for such Meyor, Police Magistrate,
Justices, or other Magistrate or Magistrates convicting as
aforesaid, to issue a warrant under his or their hand and seal
to levy the said fine or penalty end costs, or costs only, by
distress and sale of the offender's goods and chattels, and
in case of no distress, or no sufficient distress, is found
to satisfy the said fine or penalty, it shall and may be law-
ful for the Mayor, Police Magistrate, Justices, or other
Magistrate or Magistrates convicting as aforesaid, to commit
the offender to the common gaol or any lock-up house in, of,
or for the Gity of Vancouver for Period not exceeding two
months (with or without Hard Labour) unless the said fine or
penalty be sooner paid.
By-laws numbered 1511, 1731, 1892, 2020, 2429, 2450,
2486, 2504 a and 2635, are repealed.
8, ‘This By-law shall come into force and take effect on
and after the date of the final passing thereof.
