AN ORDINANCE ADOPTING THE PROMOTION OF EXCLUSIVE
BREASTFEEDING IN ILOILO CITY

Sponsored by Councilor Lyndon V. Acap, co-sponsored by


Councilors Perla S. Zulueta and R Leone N. Gerochi, seconded by
Councilors Plaridel C. Nava II and Rodel F. Agado

WHEREAS, the World Health Organization and the United Nations Children Funds
issued guidelines for a "Baby Friendly Hospital Initiative" and by virtue of RA 7600, as
amended by RA 10028 known as "Expanded Breastfeeding Promotion Act of 2009" to support
the strategy to reduce the incidence of infant and maternal mortality;

WHEREAS, the State adopts rooming-in national policy to encourage, protect and
support the practice of "exclusive breastfeeding" which shall create an environment where basic
physical, emotional and psychological needs of mothers and infants are fulfilled through the
practice of rooming-in and breastfeeding;

WHEREAS, one of the indicators under the Urban Heart (Urban Heart Equity
Assessment Response Tool) identified the equity gaps between the rich and the poor specifically
malnutrition;

WHEREAS, under the Infant and Young Child Feeding (IYCF) Program strongly
recommends "Exclusive Breastfeeding" to provide optimal growth and development of the
infant, as well as protection from several acute and chronic diseases;

WHEREAS, exclusive breastfeeding has distinct advantages which benefits:

I. Infant upon birth, breast milk is the first preventable measure given to the child
against illness;
2. Mother, enhances mother-infant relationship;
3. Hospital, saves time, money and energy;
4. Country, exclusive breastfeeding could save the country valuable foreign exchange
that may otherwise be used for milk important.

WHEREAS, breast milk is the best food since it contains essential nutrients completely
suitable for the infant's needs which serves as nature's first immunization, enabling the infant to
fight potential serious infection and contains growth factors that enhance the maturation of an
infant's organ systems;

WHEREAS, multi national milk companies aggressively promote infant formula and
other milk products which give perks and incentives to health personnel to the detriment of the
health and well being of the children;

WHEREAS, towards this end, the City of Iloilo shall promote and encourage "Exclusive
Breastfeeding" and provide the specific measures that would present opportunities for mothers to
continue expressing their milk and/or breastfeeding their infant or young child.

NOW THEREFORE, be it ordained by the Sangguniang Panlungsod of the City oflloilo,


in session duly assembled, that:

Section I. - Title: This Ordinance shall be known as "An Ordinance Adopting the
Promotion of 'Exclusive Breastfeeding in Iloilo City."

Section 2. - Definition of Terms: For the purpose of this Ordinance, the following

b. Breastfeeding - the method of feeding an infant directly from the human breast.
c. Bottle-feeding - the method of feeding the infant using a bottle with artificial
nipples, the contents of which can be any type of fluid.
d. Breastmilk - the human milk from a mother.
e. Complementary feeding - After six months, babies are introduce to other foods to
complement breastmilk even up to two years of age.
f Donor's milk - the human milk from another non-biological mother.
g. Exclusive breastfeeding - method of feeding the infant with breastmilk only and no
other liquids or solids, not even water for six months. Drops or syrups of vitamins,
minerals supplements or medicines are permitted.
h. Expressed breastfeeding - human milk which has been extracted from the breast by
hand or breast pump. It can be fed to an infant using a dropper, a nasogastric tube, a
cup and spoon or a bottle.
1. Formula feeding - the feeding of newborn with infant formula usually by
bottlefeeding. It is called artificial feeding.
J. Health Institutions - are hospitals, health infirmaries, health centers, lying in centers
or puericulture centers with obstetrical and pediatric services.
k. Health personnel - are professionals and workers who manage and or administer the
entire operations of health institutions and/or who are involved in providing maternal
and child health services.
I. Infant - a child within zero (0) to twelve (12) months of age.

m. Infant formula - the breastmilk substitute formulated industrially in accordance with


applicable Codex Alimentarius standards, to satisfy the normal nutritional
requirements of infant up to six (6) months of age and adopted to their physiological
characteristics.
n. Lactation management - the general care of a mother-infant nursing couple during
the mother's prenatal, immediate postpartum and postnatal periods. It deals with
educating and providing knowledge and information to pregnant and lactating
mothers on the advantages of breastfeeding the physiology of the lactation, the
establishment and maintenance of lactation, the proper care of the breast and nipples,
and such other matters that would contribute to successful breastfeeding.
o. Lactation station - private, clean sanitary and well ventilated rooms or areas in the
workplace or public places where nursing mothers can wash up, breastfeed or express
their milk comfortable and store it afterwards.
p. Low birth weight infant - a newborn weighing less than two thousand five hundred
(2,500) grams at birth.
q. Nursing employee - any female worker, regardless of employment status, who is
breastfeeding her infant and/or young child.
r. Mother's milk-the breastmilk from the new born mother.
s. Publk place - enclosed or confined areas such as schools, public transportation
terminals, shopping malls and the like.
t. Rooming in - the practice of placing the newborn in the same room as the mother
right after delivery up to the discharge to facilitate mother-infant bonding and to
initiate breastfeeding. The infant may either share the mother's bed or be placed in a
crib beside the mother.
u. Seriously ill mother - are those who are with severe infections, in shock, in severe
cardiac or respiratory distress, or dying or those with other conditions that may be
determined by the attending physician as serious.
v. Wet nursing - the feeding of a newborn from another mother's breast when his/her
own mother cannot breastfed.
w. Young child - a child from age of twelve (12) months and one (1) day up to thirty six
(36) months.

Section 3. Continuing Education, Re-education and Training of Health Workers


and Health Institute.

The Department of Health with the assistance of other government agencies, professional
and non-governmental organizations shall conduct continuing information, education, re-
education and training programs for doctors, nurses, midwives, nutritionists-dieticians and health
workers on current and updated lactation management.

Information materials shall be given to all health workers involved in maternal and infant
care in health institutions.

Section 4. Information Dissemination and Educational Programs to Pregnant


Women and Women of Reproductive Age.

The health personnel during prenatal, perinatal and post natal consultations and/or
confinement of the mothers or pregnant women in a health institution shall immediately and
continuously teach, train and support the women on current and updated lactation management
and infant care, through participatory strategies such as organization of mothers club and
breastfeeding support group and to distribute written information materials.

The health personnel shall develop and provide "exclusive breastfeeding programs for
working mothers and advocate to employers to avail of it as part of their human resource
development programs".

To equip women of reproductive age with accurate information on maternal nutrition and
proper nourishment in preparation for successful and sustainable breastfeeding and make
available relevant information.

Section 5. Lactation Room

To encourage government, non-government, private institutions and establishment to


establish lactation stations within their premises for breastfeeding mothers where they can wash-
up, breastfeed or express their milk comfortably and store milk afterward.

Section 6. Breastfeeding Month Awareness Month

To raise awareness on the importance of and to promote breastfeeding, the month of


August in each year and every year, throughout the Philippines shall be known as "Breastfeeding
Awareness Month".

Section 7. Separability Clause. Any clause, sentence, paragraph or part of this


Ordinance shall be declared invalid, the remainder of this Ordinance or any provision not
affected thereby shall remain in force and effect.

Section 8. EtTectivity Clause. This Ordinance shall take effect fifteen (15) days after
its publication in a local newspaper and posted for three consecutive weeks.
