REGULATION ORDINANCE NO. 2009-258


AN ORDINANCE AUTHORIZING THE ISSUANCE OF SPECIAL
PERMITS BY THE CITY MAYOR FOR LEGITIMATE TOURISM-
RELATED ACTIVITIES ALONG SELECTED STREETS IN THE
CITY OF ILOILO AND PROVIDING GUIDELINES AND FEES
THEREOF

Sponsored by Councilor Erwin J. Plagata, Co-Sponsored by Councilor


Armand S. Parcon, and seconded by Councilor Nielex C. Tupas

WHEREAS, the Perimeter Boundary Ordinance, as amended1 failed to consider


tourism-related transport services whose itinerary of travel include the City of Iloilo.

WHEREAS, there is a need to streamline certain prohibitions of the Perimeter


Boundary in order to support tourism related activities provided strict guidelines must be
provided so as not to jeopardize the viability of public transport within Iloilo City.

f NOW THEREFORE, be it ordained, as it is hereby ordained by the Sangguniang


anlungsod of the City of Iloilo, in a session assymbled that:

ARTICLE I. Definition of Terms

Tourist- for the purpose of this ordinance shall mean any person who travels from
one place to another for pleasure or culture.

Tourist- related activities - for the purpose of this ordinance shall include
activities such as sight seeing, educational tours, conventions, seminars and
athletic meets. Contracting of ordinary day to day passengers of the airport or
seaport or along the route for a particular public utility service SHALL NOT BE
CONSIDERED AS TOURIST RELATED.

Tourist - related transport - for the purpose of this ordinance shall mean
Department of Tourism accredited transport, bearing rainbow plates or regular
public utility transport so contracted for tour-related activities.

ARTICLE II. The City Mayor shall be authorized to issue special permits for legitimate
tourism-related activities, subject to the guidelines provided under this ordinance, and
after paying a fee of Two Hundred Pesos (P200.00).

ARTICLE III. Guidelines to be followed in securing a special permit to enter the City
beyond the limitations set forth by the Perimeter Boundary Ordinance, for tour related
activities.

Section 1. For organized City Tours

a.) Tour operator must be duly Department of Tourism-accredited, and a


registered business entity in the City of Iloilo with a business permit and
Tourism License.

b.) Letter request for the City Tour shall be addressed to the City Mayor, copy
furnished the City Tourism and Development Office (CTDO) and the Traffic
Technical Working Group/Traffic Management and Engineering Unit, which
shall include the following information:

1. Name of Touring Group


2. Number of Persons
3. Date and time of tour
4. Itinerary
5. Type and number of tour-related transport to be used
6. Contract of Service or Letter of Intent if request is made by tour
operator

c.) The City Mayor indorses the letter request to the CTDO for verification and
validation of documents.

d.) The CTDO indorses the letter request to the TMEU for assignment route
basing on the itinerary submitted and the identification of the contracted
vehicles for dessimination.

e.) The TMEU recommends to the City Mayor the approval and issuance of
special permit after payment of corresponding fee.

Section 2. For conventions, seminars and educational trips

a.) Convenor/organizer/school submits letter request to the City Mayor, copy


furnished the Chief Traffic Management and Engineering Unit with the
following information:

1. Nature convention/seminar, school of origin (for educational tour)


2. Number of persons
3. Date and time of activity
4. Itinerary
5. Type and number tour related transport to be used
6. Contract of Service with transport operator

b.) The City Mayor indorses the letter request to TMEU for documentary
verification and for assignment of route and dissemination.

c.) TMEU recommends to the City Mayor the approval and issuance of special
permit after payment of corresponding fee.

ARTICLE IV. Requirements for tour-related transport operators

Section 1. Streamers/posters must be visibly placed on the vehicles to be used


identify the group on tour/convention/seminar/educational trip.

Section 2. Specific streets identified in this ordinance as absolutely NO-ENTRY


areas for buses whose sitting capacity is over 32 passengers, must be strictly followed.

These streets are as follows:

a.) Bonifacio Drive


b.) Fermin Caram Avenue from Arroyo Fountain until Plazoleta Gay
c.) JM Basa from Plazoleta Gay until Plaza Libertad
d.) Iznart Street from Ma. Clara Monument until Plazoleta Gay
e.) Ledesma Street from Plazoleta Gay until the junction with Rizal Street
f.) Valeria Street
g.) Gen.Luna Street

ARTICLE V. Any misrepresentation of information/data/documents relative to the


request for issuance of a special permit shall invalidate an already issued permit and
disqualify the transport operator/tour operator/convenor/organizer of any tour-related
event from prospectively availing of the privilege to apply for a special permit.

ARTICLE VI. The tour-related transport operator/driver contracted under the Special
Permit issued shall be subject to all existing and enforceable traffic rules and regulations.

ARTICLE VR. Certain provisions of the Perimeter Boundary ordinance, as amended,


inconsistent with the provisions of this ordinance, are hereby amended or repealed
accordingly.

ARTICLE VIII. Separability

If any provision of this ordinance or the application thereof, to any person or


circumstances is held invalid, the remainder of this ordinance and the application of such
provision to other persons or circumstances shall not be affected thereby.

ARTICLE IX. This ordinance shall take effect upon approval and after publication in a
newspaper of general circulation in the City and Province of Iloilo.
