REGULATION ORDINANCE NO. 2009-362

AN ORDINANCE GRANTING SEVENTY PERCENT (70%) AMNESTY ON
SELECTED TRICYCLE AND TRISIKAD REGULATORY FEES FOR
DELINQUENT TRICYCLES AND TRISIKADS FOR THE MONTH OF
DECEMBER 2009

WHEREAS, Tax Ordinance No. 2007-016 "An Ordinance Revising Ordinance No. 399
otherwise known as The Local Revenue Code of Iloilo City and Providing Penalties Thereof'
under Chapter XXII, Section 136 (h) provides for Tricycle and Trisikad Regulatory Fees";

WHEREAS, due to the perceived exorbitance of such fees, majority of tricycles and
trisikads failed to comply with such provision, resulting to the failure of the Permits Division,
Traffic Management and Engineering Unit and the Committee on Transportation and Public
Utilities to have an accurate date base on the total numbers of such mode of transportation;

\'~1:: WHEREAS, the poor compliance to such provision have resulted to massive illegal
, operations at the expense of legally operating units and the difficulty of regulating their
operations.

NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod of the City of

Iloilo, in session duly assembled, that:

Section 1. - The month of December, 2009 shall be designated as the Amnesty Month for
all delinquent tricycles and trisikads and bicycles in the City of lloilo.

Section 2. - (a) A seventy percent (70%) amnesty shall be extended to all delinquent
tricycle and trisikad operators who failed to comply with certain regulatory fees as provided for
under Section 136 (h), Chapter XXII of Tax Ordinance No. 2007-016, irrespective of the period
of delinquency incurred;

(b) The above provision shall only apply to existing delinquent tricycle and trisikad units
and not to new additional units;

The above provision shall likewise apply only to the following:

(i) Tricycle - Original Franchise/MTOP/Driver's Permit holders issued by the

Sangguniang Panlungsod and the Permits Division of the City Mayor's office, as
the case may be
(ii) Trisikad Operators and Drivers - Original Permit holders who are of legal age and
are bonafide residents of Iloilo City, as evidenced by a certification coming from
the Punong Barangay and a Residence Certificate.

Section 3. -The seventy percent (70%) amnesty shall be applicable to the following:

a. Franchise Fee for Tricycles

b. Yearly Permit
c. License Fee for Tricycle and Trisikad Drivers

Section 4. - Those who shall avail of the amnesty, the schedule for the next regular
renewal will be January of201 l.

Section 5. - For purposes of this ordinance only the following documentation shall be
required:

a) Previous franchise and MTOP (Motorized Tricycle Operators' Permit) for tricycles;
b) Previous operators' and drivers' permit issued by the Permits Division, City Mayor's
Office, for the trisikads;
c) Barangay Clearance and Residence Certificate for trisikad operators and drivers,
certification as to membership from association president;
d) All other requirements shall be waived during the period of amnesty.

Section 6. - Upon approval of this proposed ordinance a copy shall be provided to the
.. Permits Division, City Mayor's Office, for their perusal and compliance.

Section 7. -This ordinance shall take effect on December I, 2009.
