Counter-Affidavit

I, Cherry Panotes y Balenia, 18 years of age, single and a resident at No. 27

Urbano ST., Brgy. Bagbag, Novaliches, Quezon City, come here and swear that:

1. On December 30, 2016, at 8:30 in the evening, I bought two (2) pieces of BNY
T-shirts.
2. I waited for Melvin Solon Mariano, my boyfriend, for payment of the said shirts.
3. While waiting inside the mall area, the security guard named Rudy C. Yulas
approached and searched for my bag.
4. Thereafter, they brought us to the Mall office for inspection.
Surprised by the said acts, we asked for the CCTV Footage but they refused to comply.
 4. At 10:00 in the evening at the same date, we were brought to QCGH for
medical check-up and thereafter we were escorted to the police station for further
investigation.

5. I was charged with Theft and Melvin was charged with Qualified Theft and, we
were detained for four days. We paid the bail amounting to P 10,000 and P 24,000,
respectively, for our release.

6. I am executing this Counter-Affidavit to attest to the truth that I DID NOT

COMMIT THE CRIME OF Theft in whatever form as erroneously and maliciously
alleged by the Complainant.

IN WITNESS WHEREOF, we have hereunto signed this Counter-Affidavit this
