FACTS:
1. Respondent Joson filed an application for land registration in the
CFI of Bulacan
The land subject of application was a Riceland.
Joson was able to possess the lands by way of a deed of
sale from Dionisio to his mother.
2. Fiscal Reyes interposed an opposition in behalf of Director of
Lands and Bureau of Public Works.
In their opposition they averred that whatever legal and
possessory rights the respondent had acquired by reason
of any Spanish Government grants had been lost,
abandoned or forfeited for failure to occupy and possess
the land for at least 30 years immediately preceding the
filing of the application.
That the land applied for was actually a portion of the
Labangan Channel and could not be the subject of
appropriation or land registration.
The OSG also filed their Opposition averring that:
o The land was unclassified and were denominated as
forest lands.
3. CFI Decision: Ordered the registration of land in the name of
Joson.
The applicants were able to establish their possession in the
concept of an owner for more than 30 years
4. CA Decision: Affirmed the decision of the RTC.
The indorsement from the Bureau of Forest Development
that the subject area is within the unclassified region of
Bulacan does not warrant any evidentiary weight since the
same had never been formally offered as evidence by the
oppossitor-appellant.
5. Hence, this petition.
