TERMINAL REPORT
TRAINING ON COMMUNITY PARTICIPATION IN PROCUREMENT
February 12-14, 2014
1st Batch

Proceedings of Day 1

In the early morning of February 12, 2014 the participants were fetched all
the way from Bani, Pangasinan. Upon their arrival at PSU, they registered at the
audio-visual room of Pangasinan State University-Lingayen Campus, the venue of
the said training seminar. A total of 76 participants who were barangay officials,
CVOs, barangay health workers, KALIPI members, and youth attended the first batch
of trainees. The trainees came from 11 various barangays in Bani such as Banog
Sur, Banog Norte, Ambabaay, Ballag, Ranom Iloco, San Vicente, Tipor, San Miguel,
Dacap Sur, Macabit and Dacap Norte.

Opening Program

The program formally started with a prayer, followed by the singing of the
Philippine National Anthem and the Pangasinan Hymn respectively.

In lieu of Dr. Victoriano C. Estira,the University President, Dr. Honorio


Cascolan delivered the opening remarks while Mr. Lord Byron Abadezza, Project
Coordinator from the Transparency and Accountability Network (TAN) also delivered
a message, stressing on the significance of the training to the participants.

Provincial Treasurer, Ms. Marilu Utanes, delivered the message in behalf of


Gov. Amado T. Espino, who stressed the significance of community participation in
good governance.

Bani Municipal Mayor, Hon. Gwen Palafox-Yamamoto also delivered her


message to her constituents, telling how fortunate they are because they were
chosen to be one of the pilot municipalities for this training and how thankful they
are of the said activity.
First Lecturer: Dr. HONORIO L. CASCOLAN
PSU Vice President for Administration and Finance
Topic: The Principles of Social Accountability

Dr. Cascolan started his speech by asking some question: Below are the Q and A.
Q: Please describe the situation in your barangay?
A: (Brgy. Ambabaay) Tahimik po ang barangay namin ngayon dahil sa aming
kapitan at mayor.
Q: Experience nyo po sa particQ: ipation sa inyong barangay?
A: Kami po ay nagkakaisa kapag kami ay may aktibidad, pag may disaster.
Hindi kami natutulog pag may konting tubig. Tahimik ang aming barangay.
Q: May pag asa pa ba na mapaganda ang barangay?
A: (Ballag) Sa palagay ko, sa pagtutulungan natin, may pag-asa pa na
maiangat and pangkabuhayan.

Dr. Cascolan went on to describe the web of life, the four main pillars of social
accountability, public management cycle and social accountability interventions,
participatory expenditure tracking, how to take action through procurement reform.
He also discussed the various key challenges and problems encountered by the
citizens and government regarding social accountability. He also enumerated the
various factors for successful SA strategies, benefits of SA in budgeting and public
spending. He also talked about the different principle of motivation and the genres
of social mobilization and finally, Dr. Cascolan ended his lecture by talking about
how to be community leaders.

After the lecture, there were no questions asked by the participants.

Second Lecturer: Engr. ISAGANI M. VICTORIO


University Engineer, PSU
Topic: Introduction to the Government Procurement Reform Act
(GPRA) or R.A. 9184 as it
Applies to Local Government Units

Engr. Victorio discussed Procurement as the process of acquisition of goods,


consulting services, and the contracting for infrastructure projects by the procuring
entity (Sec. 5 (aa), IRR, R.A. 9184). Define goods, infrastructure projects, etc.,
approved budget for the contract, bidder, bidding documents, PhilGEPS, Bids and
Awards Committee (BAC).
He answered the question: Why cant we just purchase what we need directly
from the market? Because, all procurement should be within the approved budget
and should be meticulously and judiciously planned by the procuring entity
concerned.
Basic steps in the procurement process were also discussed. The process
starts from the annual procurement plan (APP), to purchase request (PR) to public
bidding or alternative methods of procurement, then purchase order to delivery or
installation/ commissioning up to payment.
Engr. Victorio also elaborated on how to prepare the annual procurement
plan. Thorough planning, he said, is important. 10% allowance can be considered
due to possible inflation. The Technical Working Group or TWGs advices can be
sought to insure that the prices indicated in the PR are current.
Negotiated procurement was also discussed.

Question and Answer:

Q: Kung ang lowest bidder ay hindi nagawa ang kontrata sa infrastructure sa


barangay, paano kaya yun?
A: Kapag hindi nasunod yung specifications and instructions, maari na po
tayong mag-file ng legal action.
Q: Maari po bang maki transact ang BAC sa suppliers?
A: Kailangan pa ring dumaan sa tamang proseso. Hindi maaring makicontact
or contract ang BAC sa suppliers. Thats a violation to the law RA 9184. Kahit
si Kapitan, bawal magname ng supplier and Kapitan.
Q: Ang amount na 500,000. Wala ba tayong specific minimum amount sa
barangay na dadaan sa procurement?
A: Kapag below 500,000 maari nang gumamit ng alternative mode of
procurement.

Third Lecturer: Dr. VIRGINIA M. FERRER

Topic: Community Participation in Procurement

Dr. Ferrer lectured the participants on the following:


Definition of Community Participation
Legal References of Community Participation
Objectives and key aspects of community participation
Guiding principles of Community Participation as an Alternative Mode of
Procurement (Sec. 53.12 of RA 9184s IRR)
Projects appropriate for Sec. 53.12
Proposed procedures for procurement using community participation as an
alternative mode of procurement
Eligible Community Participants
Proposed Guidelines for Community Participation (53.12) in barangay
procurement

At the end of the lecture, no questions were raised by the participants.

After the days proceedings, Mr. Abadezza called for a short meeting
with the training management team and emphasized the need for the
more active participation of the attendees. He asked the training
management team to devise a way so that the participants will be able to
voice out their feelings.
Day 2
February 13, 2014
Workshop on Problem Identification

The day started with an activity where the participants were asked to identify
problems in their respective barangay and from the list of problems they are to
choose only one major problem. Each barangay was given materials where to write
their presentation.
After brainstorming among the members of each group, the following is the
result of their work:

Presentor 1 (Zenaida of Ranom Iloco): Kawalan ng trabaho po ang problema sa


amin. Tambay po sila. Umaasa lang yung iba sa makukuha sa 4Ps. Tsismisan at
tong-its sila.
Presentor 2 (Malou of Ballag): Source of Water dahil sa amin ay Away ang
aming pangunahing problema. Pangalawa ay ang tungkol sa Astray Animals at
pangatlo ay ang waste management. Hindi naise-separate ang nabubulok at hindi
nabubulok na basura. Kulang din po kasi sa explanation sa mga kabarangay. Pang-
apat po ang lack of sports facility. Problema sa health dahil sa kakulangan ng mga
gamot.

Presentor 3 (Sir Cacho of Ambabaay): Problema sa trabaho ang nangunguna sa


aming lugar. Nandyan din ang problema sa astray animals at babuyan.

Presentor 4 ( Sir Romulo from Banog Norte ): May walo po kaming problema:
unemployment, lack of unity, lack of potable drinking water, malnutrition, astray
animals, flooding and unimproved roads. Nangunguna po ang unemployment kasi
ang mga kabataan sa amin ay tamad mag-aral. Puro sila ligawan, tas kasalan, tas
magkaka-anak, kaya patuloy ang kahirapan dahil sa kawalan ng trabaho.
Presentor 5 (Sir Richard from San Miguel). Tulad po ninyo, kawalan po ng
trabaho ang problema sa amin. Dahil seasonal ang pagsasaka at pagpapakwan,
yung apat na buwan ay wala kaming trabaho. Pinagbabawalan din kami na mag-
tirong sa dagat ng San Miguel kasi preserved area yun. Karamihan po sa
negosyante sa amin ay dayo. Galing po sila sa Katagalugan. May Asinan din po sa
amin. Corruption sa amin ay kunti lang po. Nag-uumpisa sya sa taas. Problema din
po sa baha. Yung tubig po pumupunta sa San Miguel, yung tubig galing sa Brgy.
Embarcadero. Yung tubig pumupunta sa palaisdahan. Problema din po sa Philhealth.
Nung nagpalit ang administrasyon, nawala po Philhealth namin.

Presentor 6 (Merrilyn of Tipor): Lahat naman tayo sa barangay sa Bani, halos


pareho naman problema natin. Kami sa Tipor, issue sa poultry. 10 years na nag-
ooperate. Tuwing harvest time, kawawa mga studyante sa school. Sunod ay ang
issue sa astray animals. Transportation ang pangatlo. Dahil sa hilltop ang location
namin, kitang kita ang kabuuan ng bayan ng Bani. Yung paninda hindi madala dala
ng on time sa tindahan. Pang-apat ang problema sa tubig. Sunod ang livelihood.
After ng taniman ng palay at gulay wala ng trabaho sa amin. Panghuli ay ang
problema sa electricity.
Presentor 7 (Perlita of Banog Sur): Ang problema po sa amin ay ang water
supply lalo na ngayon na hindi umuulan. Kahit kami ay may balon, nauubusan din.
May poso din kami, at doon na lang umaasa. Water supply po ang number one na
problema.

Presentor 8 (Rogelio of San Vicente): Ang unang trabaho sa atin ay palayan.


Pagkatapos ng tag-ulan , wala na. Suplay ng tubig ang problema.
First Lecturer: Dr. VIRGINIA M. FERRER
University Chief Administrative Officer
Topic: Community Participation as an Alternative Method of
Procurement

Dr. Ferrer started with explaining the sessions objectives:


to provide the participant with sufficient comprehension on the guiding
principles of community participation as an alternative mode of procurement
to be familiar with the proposed procurement procedures under 53.12
to be eligible community participants
to provide the participants with understanding on the roles of the
a) Project Procurement Management Committee;
b) Project Preparatory Committee;
c) Monitoring and Inspection Committee; and
d) Community Reporting and Feedback Committee
to emphasize the steps to be undertaken by the barangay in preparation for
the 53.12 procurement, and
to know the basic requirements needed for community to participate as
contractors or service provider.
Question and Answer

Dr Ferrer asked if they have development council in their barangays, wherein the
participants affirmed that they do have. One of the participants enumerated the
members of the barangay development council such as the barangay local officials,
NGOs..

The participants pointed out that their share in IRA does not even reach the amount
of Php 500,000.00. Brgy. San Miguel one of the big brgy has a 400,000.00 IRA.

The participants were asked if they have already experienced the bidding process,
the participants answered in the negative but they mentioned that they have a BAC
in their barangay.

When Dr. Ferrer was discussing the awarding of contract the following questions
were raised:

Q: meron po akong nabasa na at least may 3 participants sa bidding .. paano


po kung walang 3 participants na nag join.
A: pag na upload sa internet.. at 1 lang bidder, I aaccept na po yun. Pro sana
po kya iisa yan kasi hindi tinakot ng iisang yang ung mga ibang bidder.
Participant: usually kasi yang mga bidders ay magkakakilala yan.
Q: Sinu sino po ang pwede mag participate sa bidding?
A: Basta within the community, dapat participate lahat sa barangay,
binibigyan ng opportunity mga engineers, architect ,mga service providers sa
barangay para makialam, basta taga barangay po
Q: paano kung iwanan nya ang kontrata nya
A: hindi nya pwedeng iwanan kasi meron syang performance bond. Which is
10% of the contract at hindi iri-release ang bond ng 1 yr after nya natapos
ang contract.

At the end of Dr. Ferrers lecture there was only one question raised by the
participants:

Q: SA 53.12 pwede po bang mga maliit na project lang.. konti po kasi ang
malalaking project ng barangay..
A: by administration through the barangay council kasi maliliit ang project
nyo.
Second Lecturer: Atty. RHOMIR S. YANQUILING
University Board Secretary
Topic: The Barangay Assembly and Formation of Community
Committees

Atty. Rhomir S. Yanquiling assured the participants that his topic will be
discussed in a very fast and brief presentation by classifying his topic into two, first
is the barangay assembly and its role in the implementation of community
participation and alternative methods of procurement, and second is the formation
of organization and composition of different community committees which will serve
as machineries to take part in the community participation in the implementation as
an alternative mode of procurement.

He started his topic on barangay assembly by asking the participants on their


concept of barangay assembly and also mentioned that may be some of the
participants are headed by barangay captain, members of the Sangguniang
Barangay, NGOs and civil societies in our community.

Atty. Yanquiling emphasized on the mandatory holding of barangay assembly


twice a year as being stated by the government code wherein the barangay officials
led by the Brgy. Captain is given a chance to make a dialogue to his constituents
regarding different issues and concerns in the community.
He further asked the participants to identify the people who are required to
attend the Brgy. Assembly and said that according to the Local Government Code,
all the people aged 15 and above living/residing for 6 months in the community.

According to the LGC, the Brgy. Captain can call and hold a brgy. assembly or
if not, four (4) members of the sangguniang pambarangay can also call for a brgy
assembly, but in the event that both captain and the members of the sangguniang
barangay do not want to call for a brgy. assembly, then a petition will do by getting
5% of the members of the community from which they can call or hold a brgy.
Assembly. He also stated that according to Proclamation 20060 signed by the
President Benigno C. Aquino on Sept. 11, 2011, that different barangays and
municipalities should conduct assembly in their respective jurisdiction
simultaneously.

Some questions were raised during the lecture:

Q: Sir, nabanggit niyo po kanina na ang pagconduct ng brgy.assembly ay


compulsory, paano po kung hindi nagtawag ng assembly ang aming
kapitan o brgy. officials ano po ang pwedeng ikaso sa kanila?

RSY: yan po isang magandang katanungan, ayon po sa ating batas,


nakasaad nga po sa Proclamation 20060 na dapat ay magtakda at
magtawag ng brgy assembly pero kung sila man ay hindi nagtawag at ito
ay ginawa intentionally o purposive, pwede po tayong magsampa ng
administrative complaint sa kanila pero kung ang rason ng di pagtawag o
pagdalo s assembly ay justifiable wala pong problema dun.

Q: Sir, pwede po bang iadvance o di kaya ay idelay ang pagtawag ng brgy


assembly?

RSY: As much as possible dapat po ay tinatakda ito ayon sa Proclamation


20060 tuwing 3rd Sat of March at 2nd Sat of October para synchronize at
simultaneous ang pag conduct ng brgy assembly.Bakit March? Para
mailatag sa miyembro ng assembly ang mga binabalak na proyekto para
sa komunidad atpwede pa itong pag-usapan ng mas mahabang panahon.

Q: Ano naman po ang pwedeng ikaso sa brgy official na di dumalo sa brgy


assembly?
RSY:Kailangan po muna tignan no, kung intentional o purposive ang
dahilan ng di pagdalo sa assembly, again pwede po yan na maging
grounds for administrative complaint at pwede po kayong magfile sa DILG
at sa sangguning pambayan.

Q: Sir, un pong 5% sino po ang pwedeng maging presiding officer?

RSY: magandang katanungan din po yan, in the absence of the brgy


captain or officials, pwede pong mag appoint ang committee ng presiding
officer, provided there is a quorum.

Atty. Yanquiling continued his lecture on the following topics such as:

Steps in preparation for 53.12 procurement by the barangay;


Community reporting and feedback mechanisms;
Roles and responsibilities of barangay committees:
a. Project Procurement Management Committee;
b. Project preparation Committee;
c. Monitoring and Inspection Committee; and
d. Committee Reporting and Feedback Group
AFTERNOON SESSION

Third Lecturer: Mr. ALEX N. MORES


University Chief Finance Officer
Topic: Barangay Governance: procurement planning and budget
linkages

Mr. Mores started his lecture on the importance of the role of barangay in the
countrys economic development with the enactment of the local development
Code. He also explained the basic principles which will guide the barangay budget
administrators in order to meet the challenges of the barangays vital
responsibilities mandated by the LGC. He also informed the participants on the
following:

sources of income of the barangay by explaining the barangays taxing


powers, sources of income, shares of the barangay from national,
provincial, city or municipal revenues, the shares of barangay from the
various real property taxes.

Process flow of IRA

In terms of planning and linkage, Mr. Mores enlightened the participants on:

How planning is linked with budgeting


The barangay development plan and the basis of its preparation
Barangay Annual investment plan
The importance of and legal basis of barangay budget
Budget cycle and flow chart of the budget process

For barangay fund management, Mr. Mores stressed the value of accountability
and other issues on barangay budgeting were also discussed.

The following questions were asked by the participants:

Q: Sa amin po ang committee on finance and commite on tax ay iisa ng


commite lang, Ok lang po ba un?
A: OK lang naman na magkasama ung dalawa.
Q: Isa sa mga concern sa brgy namin is all about poultry. Sa aming barangay,
may malaking poultry, ano po ang maari naming gawin para makakuha ng
income sa poultry kasi sa municipyo sila nagbabayad.
A: Maari yan pag may barangay ordinance.
Q:San po maari pong gamitin ni Kap discretionary fund/emergency fund.
A: For emergency purposes, tulad ng pag may biglaang nanganak.
Q: Pag sa cellphone load?
A: Pwede pag sa communication operation. Kung halimbawang bumisita si
Mayor, at i-aacommodate si Mayor, pwede naman gamitin fund.

Ms. Vargas, the facilitator during that day, shared her experience that in their
barangay, they collect 1 peso (Php. 1.00) for every sack of palay or corn being dried
in the paved drying area of the barangay.
DAY 3 February 14, 2014

First Lecturer: Dr. MARIA RHODORA E. MALICDEM


University Deputy Director, Gender and Development
TOPIC: Project Resource Mobilization and Sustainability

Dr. Malicdem discussed resource mobilization for procurement monitoring


purposes. She gave the participants insights about possible ways by which they can
mobilize resources for procurement activities.

Questions:

Q: Pwede po ba naming kayong imbitahan sa amin?

A: Opo, sulatan nyo lang po kami at handa po kaming tumulong sa inyo sa abot ng
aming makakaya.

After the lecture the participants were again given an activity. By which
they are going to identify the project as a solution to the problem that
they have identified earlier, each member of the group presented their
outputs to the participants (see scanned outputs of participants).
Second Lecturer: Engr. ORLANDO SOCO
Technical Director, Commission on Audit RO1
Topic: Procurement Observers Guide

The lecture of Engr. Soco centered on the discussion of the activities and timelines for
the procurement of project using 53.12. He also discussed with the participants the significance and
process of monitoring public procurement (competitive bidding). He also emphasized the
importance of the Annual procurement Plan (APP) and the Project Procurement
management Plan (PPMP).
During the discussion of Engr. Soco, the following questions were raised:

Q: Ang ibig po ba ninyong sabihin pwede po na ang amount ng PPMP ay sosobra sa


pondo na nakapondo sa aming barangay development plan?

A: Pwede. Kasi ang ifoforward nila yan sa Municipal Development Council para
pondohan. Kung hindi nila kya pondohan pwede nila irequest yan sa World Bank. All
you have to do is identify the project. Kaya ginawa and training na ito para
malaman ng WB ang inyong needs. Pwede rin na gagawa kayo ng resolution sa
municipyo na pondohan ang project ninyo. If you have identified hindi naman kayo
ang gagawa ng Feasibility study. Ung PPMP ay ifo-forward na natin sa sanggunian..

Q: Di mayroon din PPMP committee para iba-budget ung APP?

A: Importante yong minutes sa mga meeting at sa BA kasi dun makikita yong mga
needs ng community at i-include sa APP. Kasi imo-monitor ito. Gagawa ng short
term at long term procurement plan. Hindi ka makaka-request sa national agency
kung hindi included sa Municipal Development Plan, kailangan ng proper planning.

Q: Di halimbawa yong problem namin sa waterworks, pwede na namin yong


papondohan?

A: Iyong output nyo dito i-present nyo na siya sa BA. Kasi meron namang mga tao
sa municipyo o kaya ang PSU na tutulong sa inyo sa paggawa ng feasibility study.
Ang papel nyo ay i-identify ang problema at ang solusyun sa problema nyo. Later
pati ang pag procure sa project na ito ay kayo na din ang gagawa. Ito ang sinasabi
natin na community participation. In every step kasama ang community. Sa pag-
identify ng project, pag-resolve sa project at pag-procure sa project.
After the last lecturer, the participants were asked to answer questions based
on the topics and what they have learned from the three-day training. They were
asked to individually write the major problem in their respective barangay, the
possible solutions or project to answer the problem and the procurement plan for
the identified project. After which their outputs were collected (see attached
scanned copies of participants outputs).
CLOSING PROGRAM

During the closing program, some of the participants gave their impressions
about the training in general wherein they expressed their gratitude for the activity.
They also mentioned that they are very happy that their municipality was chosen
and the training made them aware of their role in their barangay during project
identification and procurement. They also added that they are now aware of the
importance of community participation if they wanted to achieve their goals and
solve their problems.

Dr. Cascolan challenged the participants in his message telling them that
they should always be a part of the events happening in their respective barangays.
He also expressed his gratitude for their cooperation and congratulated them for
participating in the training. He asked the participants as well to put into practice
what they have learned and informed them that they will be monitored for whatever
endeavor / projects they will undertake.

Two barangay kagawads from different barangays accepted the challenge


and again thanked the university and TAN for their experience and learnings.

The participants were awarded their certificates of participation; each


barangay was also given a CD containing all the topics discussed by the lecturers
plus pictures during their training.
