lnvestigation in conducting an investigation into events that occurred on April 18,2010. Madison County Deputies
arrived at 1'13 Buckridge Drive in Hazel Green, Alabama to find JASON LEE EARLS holding his wife TELISHA
LEANNE EARLS at gunpoint ABI Corporal RODNEY KNIGHT was g¡ven the case and the following information was
revealed.

MADISON COUNTY SHERIFF'S DEPUTY JEFF MALONE'S STATEMENT OF EVENTS

Madison County Sherifls Deputy GEORGE WALLACE MALONE (JEFF) was the first offlcer to arrive at tbe address

the EARLS lived when he arrived. MALONE stated he walked into the garage and noticed the TV was a monitor and
not a W. MALONE stated he (J EARLS) wasn't in there but noticed a boom box playing music MALONE then heard
screaming coming from inside the house. MALONE walked up to the door and knocked with no response MALONE

that he heard the lock on the door rattle, the door opens and EARLS is standing there MALONE stated EARLS had a
gun pointed straight at him. MALONE stated he stood there and EARLS said" Malone'. MALONE then told EARLS tp

MALONE stated there were a few times J.EARLS was pushing the gun so hard against her head that she would
move in orderto get some relief. J.EARLS would only cinch her up tighter. MALONE stated itwas like he (J EARLS)
was possessed that night. J.EARLS would tell T EARLS to stop moving or he was going to kill her. MALONE stated

afraid J.EARLS was going to kill her or someone else. MAL t

run up to them and as he's mov¡ng he switches hands with his gun and flashlight and hits the magazine release.

On Sunday, April 18, 201 0, Madison County Deputy GEORGE WALLACE MALONE turned in his fìrearm for analysis
after he was involved in an on duty shooting. The Smith& Wesson Model MP40 pistol Serial Number MRA971B along
with 9live rounds was submitted to the Alabama Department of Forensic Sciences in Huntsville for testing on

On Sunday, April 18, 2010, Deputy MALONE fired his duty weapon after J. EARLS held his wife T. EARLS hostage
during a domestic dispute. Deputy MALONE stated during an interview with Corporals KNIGHT and ANDY JONES
that he fired four rounds during the exchange. MALONE added that while he advanced closer to J.EARLS he
swrtched hands with his flash light and gun causing him to hitthe magazine release on his firearm. MALONE stated
his magazine struck the concrete causing a single round to eject. MALONE stated he left the live round on the ground

On 1212712010, MALONE filled out an MCSO Miscellaneous Report Form stating the dìscharging of his firearm to eñd
the suffering of a deer that had been struck by a vehicle. MALONE stated during the interview with ABI that he never
replaced the round with a live round leaving himwith 44total rounds of ammunitioÀ. Two magaz¡nes with 'l 5 rourids
each and one magazine in hisweapon with thirteen rounds and one live round chambered in his weapoh.

The initial crime scene was processed on April 18, 2010, by members of t-he Madison County Crime Scene unit
Deputy MALONE'S Smith and Wesson Model MP40 40 Caliber pistol along with J.EARLS Taurus Model PT709 gmmr
was collected and sent to the Alabama Department of Forensic Sciences for analysis. Other pieces of evidentiary
items were collected including four'(4) sþent 40 caliber spent Speer shell casings, five (5) spent 9mm shell casings
andabloodswapfromthefrontporchoftheresidence TheseitemsweresenttotheAlabamaDepartmentof

On Fnday, April 30,2010, ABI Corporal KN|GHTobtained a searchwarrantto reenterthe residence at 113 Buckridge
Drive in HazelGreen, Alabama ABlAgents KNlcHT, BRADLEY RENFROE, ANDY JONES, and TERRy THOMAS
along with members of the Madison County Crime Scene Unit executed the search warrant and re-examined the
crime scene. While at the scene, Corporal RENFROE entered the attached garage and located ltÉm'#1.ä 3pêñt'40
caliber shell casjng approximately 2.8' from west wall and 7. 'from garage door The shell casing was collected and
sent to the Alabama Department of Forensic sciences in Hoover for analysis
lnsidethe residence, itappeared to be three total projectile paths in the general area of the doors.,one rounäl
appeared to go through the door and into the molding of the closet. Two additional rounds appeared to go into the
door frame. ltem# 2 'spent projecfile" was collected aI 1.07 p.m. by Corporal RENFROE from door frame at
approximately '1 '9' up from floor. ltem# 3 "spent project-rÎe" was collected at 1'.25 pm by Corporal RENFROE from
wall inside bedroom at approximately 2' up from floor The remaining spent projectililwas not collected due to it
entering a load bearing wall and possible damage tothe integrity of the room. Ánadditional possible spent projectile
entered the ceiling approximately 1'9" from wall and 2'1" frofn south side of doorway was noted and photographed but

Madison County Sherifls Deputy DENNIS DOMINICK DAVERSA stated they moved in closer (after the EARLS feil)
and remembers EARLS raising his hand (DAVERSA believes itwas J.EARLS left hand with the qun jn it) and his
volce raise. DAVERSA stated to himself 'Oh Shit lt's about to happen''. EARLS screamed something and then the

there was a pause and he heard her (T EARLS) moan or grunt DAVERSA then heard the remaining shots J EARaS
was still falling when DAVERSA got to him. DAVERSA was confident the first shot fìred struck T.EARLS.

Madison County Sherifls Deputy JUSTIN ADAM WATSON stated he heard one shot and a distinct pause then
maybe a second ortwo, then the remaining shots. WATSON stated he had timeto rise up and get him in the sights,
then heard MALONE shoot, There were four or five shots after the inÍtial shot WATSON stated he.didn't observ:e any
muzzle flash from the shots.

CorporalJONES questioned WATSON as the positioning of the EARTS

the top of her (T.EARLS) was parallel or above to the top of J EARLS
to be a pretty good shot not to hit her. WATSON stated it was a possibil E could 'have hit her. r
