The role of justice in the reformation of the

Romanian society

The justice represent all organs of jurisdiction of a State, all the laws and the
courts,and the system of functioning of these courts. Also represent one of the
fundamental forms of state activity, which consists in civil cases or criminal prosecution
and sentencing under the law.

Justice sector includes in the first place ordinary judiciary and the entire set of
authorities and relationships between they, that contribute to justice: criminal
prosecution,

Justice sector related legal professions (lawyers, notaries, mediators, executors


judicial, legal experts, administrators of insolvency, translators / interpreters), the
probation system execution of decisions courts, the prison system, the Ministry of Justice,
the institution of the ombudsman, Constitutional Court.

The role of justice in society is very important because it ensures the optimal
operation of the system, controls all areas of life, taking care that the society follow the
right way.

People need justice to defend their rights to ensure justice and fairness are the facts
and to feel safe in the society where they live.

When characterize a democratic judicial system we talk about transparency and


trust, concepts that define very well wishes of people regarding the thrive society.

Unfortunately today, there is only justice institution level, as a formality


increasingly complicated that we can use, and only to satisfy our own interests against
each other.
But justice must be really daily, except any institution, and it must mean primarily
the right way and just being the people in the society in which they live.

It is therefore important to know the true power of justice doesnt mean only
independence, but accepting it fair that balance in our relationships with others and the
power of each of us to give up claims unfair and unjust that we often , just deluded
ourselves that we have control over others, or that we are smarter than others and that we
are who we are right.

In Romania, the statistiques indicate the fact that the justice is seen as being too
slow, that it doesnt combate enough the criminallity, that the magistrates are either
incompetents or corrupted.

I believe though that only the closely unknowledge of the way of organization and
function of the system may fundament such an opinion.

Most of the magistrates accomplish professionally their attributes. But the citizens
must see that; in this way, is an international principle: Justice must not only be done, it
must also be seen to be done.

Level of trust in justice is one that reflects the mood of society and attitudes
towards justice. If people lose confidence in justice, they did not manage to identify with
it and in this mode, justice loses credibility in front of people.

Honore Balzac said that The distruction of trust in the judiciary marks the
beginning of the end of society. Smash the present patterns of the institution, rebuild it on
a different basis but dont stop beliving in it.

A justice system perceived by the population as corrupt seriously affects the


credibility of justice and feeds people distrust the integrity of people working in this field.

In order to prevent and combat corruption effectively in the justice sector specific
interventions are necessary and harsh, oriented to : increasing salary levels of relevant
actors in the justice sector, onset of real and effective mechanisms for verifying income
and property declarations and declarations of personal interests of actors of justice sector,
control mechanisms on compliance with the legal regime of incompatibilities and
conflicts of interest; introduction of new mechanisms and categories of liability for
people involved in corruption; provision of new measures to prevent the spread of
corruption in the justice sector; excluding the human factor as much as possible of the
management of administrative processes of the justice sector and the application of
modern technologies; introduction of regulations clear the obligation to declare illegal
influences exerted on justice sector representatives; strengthening institutions responsible
for ensuring the integrity and internal security.

The specific nature of the justice lies in the impossibility of implementing a


coherent strategy and policy reform, in the lack of coordination.

So justice in Romania should help citizens to solve problems, to insure justice and
fairness. Must rely on some clear values and relevant; also must to provide a framework
in which people feel safe; and last but not least to fight against corruption and promote
transparency and justice.
