Legal and ethical

Unit 78 assignment 3
Ciaran Morton

Legal

Legal means if the content is legal or illegal,

Copyright

The copy right law was passed in 1988, this was created/made so that
other people couldnt copy someone elses work and use it as their own.
This was made to stop people stealing work, whoever makes the work, for
example a band making a new album have it copy righted so that people
cant take the album and use it elsewhere as their own work. In the UK all
work is automatically copy righted, meaning people dont have to file for a
copy right, in other countries, they will have to get a copy right or patent
on their work, for example from the patent office, or you could go online
and file one, this is an example website:
https://www.gov.uk/government/organisations/intellectual-property-office.
By using an exact copy of someone elses work it will be breaking the
copy right laws (and the law) meaning you could be prosecuted, taken to
court, fined or worse, this can all be avoided by not stealing other peoples
work. The only way you can use other peoples work is if you ask
permission from the owner of the work or agree to pay them royalties, this
is common for people buying the rights to use certain music tracks.
In my game I am going to create ALL of the assets/graphics/sounds myself
therefore I am not breaching ANY of the copyrights as I am solely using
my own work which is fully legal, along the way I am going to have to
check all of the copyrights and patents to see if I have to remove certain
items I create or re-name them.

Ethical

Ethical basically means no discrimination based on age, sex, gender,

religion etc. This is used everywhere e.g. the work place, online, in the
community, this is to stop people from being discriminated against, in the
aspect of my game I am ensuring that the game is not discriminating
against anyone by carefully planning exactly what content is deemed
appropriate to be featured in the game, this is so the game does not
offend anyone. An example of the game not being discriminating is the
ability to change the skin colour or gender of the character (even though I
did not have a character as the game is first person single player so apart
from the forearms/hands the character is not going to be shown AT ALL!)

Unit 78 assignment 3

To the right is the GTA 5 online where the gender and race of the
character can be changed, this is showing that the game is not
discriminating against anyone.

Confidentiality

Confidentiality is all about keeping information away

from the public, a great example of this is at a
doctors where there is patient confidentiality, this
can only be broken when the patient is a risk to
someone elses wellbeing, apart from that no one
else can know. Basically, confidentiality is a set of
rules that stop certain people getting hold on certain information just
like patient confidentiality.
The only way confidentiality fits in with my game is if people have to
create an account on my game to play it, as this is a PlayStation game
they already have an account which will broadcast the information
worldwide on which games it plays, therefore I am not going to concern
myself with confidentiality as the players have FULL control on the
confidentiality and I have little/no control over this.

Privacy

Privacy is very similar to confidentiality, it is keeping information away

from certain people, information like identity etc. The definition of privacy
differs in different countries though, but they all share the common parts
of privacy, theorist Edwin Lawrance Godkin said nothing is better worthy
of legal protection than private life, or, in other words, the right of every
man to keep his affairs to himself, and to decide for himself to what extent
they shall be the subject of public observation and discussion. Meaning
that people should be able to keep their personal life to themselves.
The only way privacy fits in with my game is if people have to create an
account on my game to play it, as this is a PlayStation game they already
have an account which will broadcast the information worldwide on which
games it plays, therefore I am not going to concern myself with privacy as
the players have FULL control on the privacy and I have little/no control
over this.

Decency

The minimal decency is a requirement according to the philosophy of

Immanuel Kant, it is basically about the minimum amount of
kindness/decency people should show, for example in a business/company
not allowed to pay under the minimum wage, have to have
confidentiality, not allowed to post liable about staff etc.

Libel

Liable means to say or write something that isnt true to damage

someone elses reputation, an example of this is someone blogging or
posting a statement taking about someone else trying to insult them, this
is liable because it will damage the other persons reputation. Libel
exposes people to public hatred, damage to his/her business/profession
and can cause the person to be ridiculed.

Representation Race, gender, religion and sexuality

As I have mentioned above, to keep the game non-discrimination I have

decided to implement a race/gender option, this is not going to change
much apart from the hands/arms as this is THE ONLY THING THE PLAYER
will see! I have written MULTIPLE times I have NOT created a character as
this is a first person SINGLE player game so NO ONE will see the
character! I will however develop male and female character forearms.
hands and then change the skin colour to fit non-discrimination themes.
(This section is short but clearly covers race and gender as there isnt
anything else to write about race or gender).

Religion There are NO references to religion within my game, this is

basically to not have discriminating content against one. This section is
short as all I have to write is that my game is not going to affiliated with
any religion to avoid offending people, including offensive content or any
other discriminating or copyrighted content.

Aesthetic qualities

Composition

Composition in aesthetic qualities means what

the images are made up of, in my project I
took the images myself, the only asset I
traced over is the dvd cover to get the right
measurements for the ps4 dvd cover, apart
from this all of the images are my own. After I
took the images I edited them slightly in
PhotoShop to match the storyboards
I produced better, the image to the right is one of the story boards.
The image to the right is of a character holding a torch, I did not edit the
image I took for this as I made a torch and took images
of myself holding it. This is shown to the right.
These images are the story board and the finished
graphic, I did not want to edit this image (this is the
only image I did not edit) as it was the same as the
story board and I want realistic images so I didnt
heavily edit any images so they retained their high
resolution, bit depth and realistic aspects.

Colour palettes

The colour palettes I used in this assignment are mostly greens,

blues, browns etc. this is because I took all of my images in the
woods/forest so the images look quite similar, the only image
that is different is the night image as I wanted to show that my
game has a day/night cycle by having a lot of different day
images with different brightness (e.g. mid-day, sun rise, sun set
and night. This is achieved as I have 19 images in total, this
includes a poster, a dvd cover, a 3rd person night shot and 16
separate different time images during the day that have all been
separately edited. The image to the right is the list of all of the
image I created for this assignment.

Typography

The typography is very brief in this assignment, I have a few cover lines
on the poster and a few words on the back of the dvd cover that are just
terms and conditions that I copied off a PlayStation forum to add more
realism to the image.
The cover lines on the poster are Out now, PlayStation
Exclusive, ISOLATION AND 49.99. These are cover
lines giving information on the game like, when it is going
to be released, how much it costs, what platform it is
being released on and the name of the game. The image
to the right is the poster that shows the white text at the
foot of the poster.
The text on the dvd cover is the same as this with the
terms and conditions of PlayStation, the name of the
game and other small text dotted around.

Creation of meaning

6
Unit 78 assignment 3
Ciaran Morton

The creation of meaning means why I made the images the

meaning of why I created the images is that I am pitching a game
idea to businesses for funding, these are the game graphics I
produced for the game I am going to create, I planned out, took
images and edited them based on the plans I created for them,
this is the only meaning or explanation for why I created this
project, the image to the right is a list of ALL of the images I made
for this exact meaning. In short, I originally pitched the
ability/knowledge of building a game to potential investors now I
am going to pitch this game idea along with the ideas I had for the
game.

Industry practice

Reflect on finished project (compared with original intentions, fitness

for purpose, technical qualities, aesthetic qualities)

After comparing my finished graphics with my story boards, I can easily

tell that I created the images almost identically to the story boards I
created, this is because I decided to change my game idea and create
images that would be easier to produce so that I knew how to edit them
correctly and without wasting any time as I did not have very long to
complete this assignment and I did not have any time to waste on
learning how to better understand PhotoShop. The images below are a
story board and the image that it represents.

7
Unit 78 assignment 3
Ciaran Morton

This is very similar to the original design;

the scanner did not pick
up the cover lines I created
at the bottom of this
document as I made
them slightly too faint.

These images fit the

purpose EXACTLY as I
pitched my story boards to
the client who said I had to create digital graphics
for the story boards, as I have done this I have fit the
requirements exactly. This is the only thing to write for the
requirements as I have met them all, if I did not I wouldnt get a
grade for this assignment and wouldnt get a grade for this unit of
work.
The aesthetic qualities are very simple, this is the high quality
images, the bit depth, the resolution and the simplistic editing as
heavily edited images arent that good on realism.
The image to the right shows the aesthetic qualities of one of the images I
produced, this is the poster as it was the image that tool the most amount
of time.

Production skills (ideas generation, graphic specification, workflow and

time management. Technical competence, teamwork)

The production skills of this project include, generating the ideas, getting
the specifications for the graphics I was going to create, figuring out the
work flow and time management, getting better technical competence
and working in a team of sort.
For generating ideas, I thought of a basic idea and kept adding to this idea
until I had a small game concept, I then linked in some art for that project,
took some images and edited them slightly.
For workflow and time management I decided to design a timeline and an
ILP to better use my time and not focus too much on one aspect, I also
commented in the ILP and timeline after every session to see what I did

8
Unit 78 assignment 3
Ciaran Morton

that session and to document what I did every

session, what tool the longest amount of time and
what took the least amount of time. The image to
the right is of the ILP.

Employability skills

Maths, English, ICT, communications, punctuality, employer

expectations.
For this section I have bunched these together in order to write a decent
amount of text, this is due to the fact all of these section is quite shot on
their own.
Each of the sections (math, English, communications, punctuality and
employer expectations) are important when either getting hired to create
a game or actually creating a game or making the game, for maths and
English, these are very basic skill sets everyone should have, this is for
ANY job, the game is going to need English and math skills to measure out
all of the images correctly and to write correctly on the images, for
example, good punctuation, correct spelling etc. For communication, I had
to deliver a presentation in front of several different people, without any
communication skills I wouldnt have been able to secure a deal to create
the game and I wouldnt have been employed communication is a side
track of sort to English as communication is the ability to structure
sentences together correctly and correctly/appropriately respond to
questions or statements. Punctuality is one of the employer expectations
along with the employee doing their job and other basic things that are
very self-explanatory.
In short, employer expectations are what the employer expects from the
employee, an example of this is the employer doing their job and Turing
up to work on time (punctuality).
