PRELIMINARIES:

Witness Denisa O. Faustino is of legal age, Filipino,


employed and with office address at Office of the City
Assessor, City Hall, Quezon City, and is currently the Head of
Assessment Records Management Division, do hereby state
under oath as follows:
PRELIMINARY STATEMENT

The examination of the witness is being conducted by


Atty. Jovy Anne V. Querubin, with office address at 9 th floor,
Sage House, 110 V.A Rufino St., Legaspi Village, Makati City,
the examination is being held at the Office of the City
Assessor, Quezon City Hall Building, Elliptical Road, Diliman
Quezon City. I am answering her questions fully conscious
that I do so under oath and may face criminal liability for
false testimony or perjury.

PURPOSE OF THE TESTIMONY

The testimony is being offered to prove that:

1. That the witness is the head of the Assessment


Records Management Division of the City
Assessors Office of Quezon City.
2. The she is authorized to appear in this case.
3. That their Office issues and keeps records of tax
declarations of real property covering lots and
improvements in Quezon City.
4. That their Office issued the tax declaration of the
subject property located at Kaligayahan,
Novaliches Quezon City.
5. That Spouses Calixto D. Bancolita and Marissa G.
Bancolita has been the registered and declared
owner of the above described property from 1997
until present.
6. That the declared owners address on the records
of the City Assessors Office is #69 Basa St, SFDM,
Quezon City.
7. That the address of the registered owner has not
been changed up to present.
8. That the above-mentioned tax declarations were
validly issued by the City Assessors Office, in
accordance with the proper and regular procedure
provided for by law.
9. That based on witnesss years of experience in the
City Assessors Office, it is not part of their duty to
look beyond the address provided for in the
records of the City Assessors Office.
10. That based on witnesss years of experience in the
City Assessors Office, it is the tax payer which has
the duty to request for a change of Address to
reflect on the Tax Declaration.

Furthermore witness will testify on all other matters


related to the above.

TESTIMONY

Q1: Miss Witness, please state your name and other


personal circumstances.

A1: I am Denisa O. Faustino, married, Filipino citizen, of


legal age, with office address at Office of the City Assessor,
City Hall, Quezon City, presently the Head of the Assessment
Records Management Division of the City Assessors Office.

Q4: How long have you been the head of the said division?

A4: I have been the head of the Assessment Records


Management Division of the City Assessors Office for sixteen
(16) years.

Q5: As the Head of the Assessment Records Management


Division, what are your basic functions and responsibilities?

A5: My basic functions include maintenance and


safekeeping of all assessment records with registered
owners information, including tax declarations, assessment
rolls, field appraisal and assessment sheets, among others.

Q6: How about the City Assessors Office which your


division belongs to, what are its functions and
responsibilities?

A6: The basic functions and responsibilities of the City


Assessors Office include:

a. Identification of real properties and improvements, if


any, for real property purposes;
b. Preparation of tax map or property identification map;
c. Issuance of tax declaration covering properties located
within Quezon City to registered/declared owner;
d. Keeping of records of tax declarations issued for real
properties and improvements located within Quezon
City;
e. Issuance of Certification as to Assessment value of real
property improvement;
f. Issuance of Certificate of Landholdings.

Q7: Madam witness, you mentioned that your basic


functions include maintenance and safekeeping of all
assessment records with registered owners information,
including tax declarations, if one will be shown to you will
you be able to identify it?

A7: Yes, I will.

Q8: I am showing you a certified true copy of Tax


Declaration No. E-046-06920, do you recognize this
document? (Counsel is showing the witness a certified true
copy of Tax Declaration E-046-06920, stamped and signed
by a certain Denisa O Faustino, which was previously
marked as Exhibit F)

A8: Yes.

Q9: How do you know this document?

A9: This tax declaration was issued by the City Assessors


Office and a copy of it is secured in our records. As Head of
the Assessment Records Management Division I am the
custodian of the original copy of this document.

Q10: In this tax declaration, there appears to be a stamp


with the name DENISA O. FAUSTINO certifying said
document to be a true photocopy of the original on April 16,
2012, do you recognize this stamp?

A10: Yes, I do.

Q11: Madam witness, there appears to be a signature


above the name Denisa O. Faustino, LAOO V, Chief, ARMD,
whose signature is this?
A11: It is my signature, maam.

Q12: Why does your signature appear on this document?

A12: Because it is part of my duty to certify that the


said tax declaration is a true photocopy of the original one in
the City Assessors files and records.

Q13: Based on your records, whose name is indicated as


registered owner in this tax declaration?

A13: Based on our records, tax declaration E-046-06920 is in


the name of Calixto D. Bancolita and Marissa G. Bancolita,
maam.

Q14: Based on your records, when is the effectivity of the


assessment of the said Tax declaration?

A14: Based on our records, the effectivity of the


assessment of the said tax declaration, is first the quarter of
2006.

Q15: Based on your records, what is the address indicated in


the Tax Declaration of registered owners, Calixto D. Bancolita
and Marissa G. Bancolita?

A15: Based on our records, the address indicated in the


Tax Declaration is #69 Basa St., SFDM, Quezon City.

Q16: As per your records, Is this the last known address of


the registered owners?

A16: Yes. This is the address on our records up until


today.

Q17: Madam witness, I am showing you another


document, a certified true copy of Tax Declaration No. D-046-
09652, do you recognize this? (Counsel is showing the
witness a certified true copy of Tax Declaration D-046-09652
stamped and signed by a certain Denisa O. Faustino, which
was previously marked as Exhibit G)

A17: Yes.

Q18: How do you know this document?

A18: This tax declaration was also issued by the City


Assessors Office and a copy of it is secured in our records.
As Head of the Assessment Records Management Division I
am the custodian of the original copy of this document.

Q19: In this tax declaration, there appears to be a stamp


with the name DENISA O. FAUSTINO certifying said
document to be a true photocopy of the original on April 16,
2012, do you recognize this stamp?

A19: Yes, I do.

Q20: Madam witness, again, there appears to be a


signature above the name Denisa O. Faustino, LAOO V, Chief,
ARMD, whose signature is this?

A20: It is my signature, maam.

Q21: Why does your signature appear on this document?

A21: Because as mentioned, it is part of my duty to


certify that the said tax declaration is a true photocopy of
the original one in the City Assessors files and records.

Q22: Based on your records, whose name are indicated as


registered owners in this tax declaration?

A22: Based on records, Tax Declaration No. D-046-09652 is in


the name of Calixto D. Bancolita and Marissa G. Bancolita,
maam.
Q23: Based on your records, when is the effectivity date of
the assessment on the said Tax declaration?

A23: Based on our records, the effectivity date of the


assessment of the said tax declaration is in 1997.

Q24: Based on your records and this tax declaration effective


in 1997, what is the declared address of registered owners,
Calixto D. Bancolita and Marissa G. Bancolita?

A24: Based on our records, the address indicated is #69


Basa St., SFDM, Quezon City.

Q25: After 1997, were there any changes in the address of


declared owners, Calixto D. Bancolita and Marissa G.
Bancolita?

A25: No Maam

Q26: Is this the last known address of the registered owners?

A26: Yes. This is the address on our records up until


today.

Q27: Who updates the postal address on the City


Assessors Records?

A27: It is the registered owner, maam.

Q28: What is to be done by the registered owner if there is a


change in their address?

A28: They have to request for a change of the address or the


information in the City Assessors Office for such change to
reflect on their Tax Declaration.
Q29: Based in your records, was there a change of address
by the registered owners of Tax Declaration No. E-046-06920
and Tax Declaration No. D-046-09652?

A29: No Maam, there was none. It is still #69 Basa St.,


SFDM, Quezon City.
