ANSWER

COMES NOW, defendant MANGGA HUTAY, by undersigned

counsel and in answer to herein complaint in the aforementioned entitled
case, unto this Honorable Court most respectfully states that:

1. Defendant ADMITS the averments in paragraphs 3, 4, and 5 of the

complaint;
2. Defendant DENIES parts of paragraph 6 of the complaint. The truth
being that after payment of the Fifty Thousand Pesos (P50, 000.00),
defendant wanted to pay One Hundred Thousand Pesos (100, 000.00)
in addition to the previous payment but complainant was repeatedly
not available when defendant contacted her. That after defendants
mothers operation, defendant opted to pay complainant One Hundred
Fifty Thousand Pesos but complainant did not receive said amount.
That defendant did not receive any form of demand letter from
complainant nor her counsel.
3. Defendant DENIES paragraph 8 of the complaint. The truth being
that defendant was able to attend the first conference but asked to
move the next dates of conciliation because he will be going to Tagum
City, Davao to attend to some personal matters. The certification
allegedly issued by the Lupon is forged, proved by a certification
issued by the same Lupon that it has not issued one in favor of
complainant, as evidenced by the attached document hereto as
ANNEX A.

WHEREFORE, the defendant respectfully prays that the complaint

be dismissed with costs against the plaintiff.

Other relief and remedies as may be deemed just and equitable under
the premises are likewise prayed for.
