Respected Sir,
Sub: Restriction on the shift changes while there is acute shortage of
manpower, our concerns — Reg.
We would like to bring to your notice the issue of unnecessary restriction
imposed on shift changes. The shift changes are mutually beneficial to the
employees and the management as well to cover the shift complement
particularly when there is a manpower shortage.
‘There has been acute manpower shortage in the refinery. Leaving alone
the leave coverage, there are many vacancies in the schedules. Such
shortage in the three rota shift positions are being covered on overtime
basis. Most shift changes happens mostly because of shortage in the shift
schedule and to cover the shift complement. And the present shift
schedule pattern leads to double group in a shift every in a week. During
such doubling shift schedules are so adjusted to cover the shortage in the
other shifts to avoid unnecessary overtime generation.
Now itself, even with such prudent manpower planning we are constrained
to work much more overtime hours than those prescribed in the Factories
Act that is FIFTY OVERTIME HOURS per a Quarter subjected to sixty
working hours per week including overtime hours. In fact engaging
workman on overtime needs specific permission from the Inspectorate of
Factories. Kindly share with the Unions, if any, such permission is
obtained. The overtime hours are to be intimated to the FactoriesDepartment and at the same time overtime slips are to be provided to the
workman with the reasons for such overtime recoded in it. But in practice,
such things are not being followed.
While there is a shortage of manpower in non-management positions in
many places, the non management employees are being utilized in the
acting assignment or to cover extra jobs in the day shift. This is eventually
burdening the non management with more overtime hours.
At this juncture, we request to deploy the manpower to cover the all shift
positions so as to minimize the overtime hours before putting restriction
on the shift changes. Otherwise such restriction adversely effect the
service conditions of the workman. Hence in the interest of industrial
harmony, we request you to liberally allow the shift changes till the
manpower including leave coverage is deployed. Otherwise we feel
constrained to move the issue to the concern statutory authorities.
