283Provisionsastosentencesoffine

(1)Whereanyfineisimposedundertheauthorityofanylawforthetimebeinginforce,then,intheabsenceofanyexpressprovisionrelatingtothefineinsuchlawcontained
followingprovisionsshallapply

(a)wherenosumisexpressedtowhichthefinemayextendtheamounttowhichtheoffenderisliableisunlimited,butshallnotbeexcessive
(b)ineverycaseofanoffenceinwhichtheoffenderissentencedtopayafinetheCourtpassingthesentencemay,initsdiscretion,doalloranyofthefollowingthings:

(i)allowtimeforthepaymentofthefine
(ii)directpaymentofthefinetobemadebyinstalments
(iii)issueawarrantforthelevyoftheamountbydistressandsaleofanypropertybelongingtotheoffender
(iv)directthatindefaultofpaymentofthefinetheoffendershallsufferimprisonmentforacertainterm,whichimprisonmentshallbeinexcessofanyother
imprisonmenttowhichhemaybesentencedortowhichhemaybeliableunderacommutationofsentence:

Providedthatwheretimeisnotallowedforthepaymentofafineanorderforimprisonmentindefaultofpaymentshallnotbeissuedinthefirst
instanceunlessitappearstotheCourtthatthepersonhasnopropertyorinsufficientpropertytosatisfythefinepayableorthatthelevyofdistress
willbemoreinjurioustohimorhisfamilythanimprisonment

(v)directthatthepersonbesearchedandthatanymoneyfoundonhimwhensosearchedorwhich,intheeventofhisbeingcommittedtoprison,maybe
foundonhimwhentakentoprison,shallbeappliedtowardsthepaymentofsuchfine,thesurplus,ifany,beingreturnedtohim:
ProvidedthatthemoneyshallnotbesoappliediftheCourtissatisfiedthatthemoneydoesnotbelongtothepersononwhomitwasfoundorthatthelossof
themoneywillbemoreinjurioustohimthanhisimprisonment

(c)theperiodforwhichtheCourtdirectstheoffendertobeimprisonedindefaultofpaymentoffineshallnotexceedthefollowingscale:

(i)iftheoffenceispunishablewithimprisonment:

exceeding one thousand ringgit but does not exceed five oneyear
thousandringgit

(e)theimprisonmentwhichisimposedindefaultofpaymentofafineshallterminatewheneverthatfineiseitherpaidorleviedbyprocessoflaw
(f)if,beforetheexpirationofthetimeofimprisonmentfixedindefaultofpayment,suchaproportionofthefineispaidorleviedthatthetimeofimprisonmentsufferedin
defaultofpaymentisnotlessthanproportionaltothepartofthefinestillunpaid,theimprisonmentshallterminate
(g)thefineoranypartthereofwhichremainsunpaid,maybeleviedatanytimewithinsixyearsafterthepassingofthesentence,andifunderthesentencetheoffenderis
liabletoimprisonmentforalongerperiodthansixyearsthenatanytimeprevioustotheexpirationofthatperiod,andthedeathoftheoffenderdoesnotdischargefromthe
liabilityanypropertywhichwouldafterhisdeathbelegallyliableforhisdebts.

(2)AwarrantforthelevyofafinemaybeexecutedatanyplaceinMalaysia,butifitisrequiredtobeexecutedoutsidetheStateinwhichitisissueditshallbeendorsedforthatpur
byaJudgeorbyaFirstClassMagistratehavingjurisdictionintheStateinwhichitistobeexecuted.
