PROCEEDINGS OF THE COUNTY BOARD OF JACKSON COUNTY, MINNESOTA

February 7, 2017

The County Board of Jackson County, Minnesota met in regular session, in the Jackson County
Courthouse Board Room, 405 Fourth Street, City of Jackson, Minnesota, on February 7, 2017. The
following County Board members were present: James Eigenberg, Cathy Hohenstein, Kim Hummel,
Scott McClure and Don Wachal, Commissioners. County Coordinator Steven Duncan and Trish
Schulz, Human Resources Technician, were also in attendance.

CALL TO ORDER

Chair Hummel called the meeting to order at approximately 9:00 a.m. and led the Pledge of
Allegiance.

Motion was made by Commissioner Eigenberg and seconded by Commissioner McClure to adopt
the agenda. Motion carried unanimously.

CONSENT AGENDA

Motion was made by Commissioner Wachal and seconded by Commissioner Hohenstein to


approve the Consent Agenda. Motion carried unanimously.

Board Action 17-027: Approve the January 17, 2017 Board of Commissioner meeting minutes.

Board Action 17-028: Approve all Commissioners disbursements in accordance with Minnesota
Statutes 130.01, subd. 4(b), recorded on warrants numbered 80640 through 80823 in the amount of
$1,249,815.44 - for Revenue Fund, $39,793.64; Road and Bridge, $125,566.53; CIP Bonds,
$238,726.25; Ditch Funds, $725,936.11; Health Insurance, $2,604.00; Insurance Trust, $321.00; TIF,
$100.25; Revolving Loan, $1,827.03; Tax and Penalty, $108,337.34 and Library, $6,603.29. A
detailed list of claims paid is available at the Auditor/Treasurers Office upon request.

Board Action 17-029: Approve appropriation request for the Southwest Initiative Foundation of
$3,080.00.

Board Action 17-030: Approve the appropriation request for the Addiction Prevention Coalition of
$2,000.00.

Board Action 17-031: Approve the appropriation for Family Services Network of $10,000.00.

Board Action 17-032: Approve declaring, as surplus equipment, a KIP 700S wide format
printer/scanner from the Information Systems Department and authorize listing for sale on GovDeals
with a reserve price of $100.

Board Action 17-033: Authorize the issuance of a county credit card to Highway Shop Supervisor,
Kayle Koep with a $1,500 limit.

Board Action 17-034: Approve County Ditch #3 Public Hearing for Redetermination of Benefits for
Thursday, March 30, 2017, at 9:00 a.m., at the Heron Lake Community Center.
Board Action 17-035: Approve the application for exempt permit to the Jackson County Conservation
League with no waiting period for a raffle to be held at the Horse Barn & Hunt Club on March 17,
2017.

LAND MANAGEMENT

Motion was made by Commissioner Wachal and seconded by Commissioner McClure to adopt
Board Action 17-036: Approving the Sale & Transfer of Title of County Vehicle (2012 Dodge
Caravan) to Des Moines Valley Health & Human Services in the amount of $10,000. Motion carried
unanimously.

Motion was made by Commissioner Hohenstein and seconded by Commissioner Eigenberg


to adopt Board Resolution 17-004: Authorizing Rescinding the Commercial Recycling Resolution.
Motion carried unanimously.

RESOLUTION 17-004
Rescinding the Jackson County Commercial Recycling Resolution

WHEREAS, the Jackson County Board passed a commercial recycling resolution in 1998 to allow for
the collection of fees from commercial businesses to assist in the cost of processing recyclables; and

WHEREAS, a $3 per month ($36 per year) Recycling Processing Assessment was placed on all
commercial property taxes; and

WHEREAS, the County required that all County licensed solid waste haulers charge a fee for the
collection of recyclables on all commercial accounts at a minimum rate of $8 or 15% of the garbage
rate per month/collection that would be paid to the recyclable processing facility for the County; and

WHEREAS, it shall be unlawful for any owner or occupant of a commercial building within Jackson
County to generate or deposit for collection mixed municipal solid waste which contains any of the
County designated recyclable material.

NOW, THEREFORE, BE IT RESOLVED, that Jackson County will rescind the Jackson County
Commercial Recycling Resolution that was passed on December 28, 1998 because it is no longer
necessary to collect the fees associated with the materials processing; and

BE IT FURTHER RESOLVED, that Jackson County will no longer require licensed solid waste
haulers to charge for the collection of recyclable materials on their monthly garbage bill to assist with
the associated processing fees; and

BE IT FURTHER RESOLVED, that Jackson County will no longer charge the $3 per month ($36
per year) Recycling Processing Assessment on commercial parcels within the County; and

BE IT FURTHER RESOLVED, Jackson County made commercial recycling mandatory on January


1, 1993 by adopting Section XV Subd. 2 of the Jackson County Solid Waste Ordinance, and

BE IT FURTHER RESOLVED, that Jackson County will review commercial recycling on an as


needed basis.

PUBLIC WORKS

Motion was made by Commissioner Eigenberg and seconded by Commissioner Wachal to adopt
Board Action 17-037: Approving the purchase of a 2017 GMC Sierra 1500 Pickup from State Contract
#118209 for $34,190.82 & from Ranger Chevrolet of Hibbing, Minnesota, and declaring as surplus a
2009 Chevrolet 1500 pickup. Motion carried unanimously.

Motion was made by Commissioner Hohenstein and seconded by Commissioner McClure


to adopt Board Resolution 17-005: Approving the Five-Year Bridge Priority Plan. Motion carried
unanimously.

removal within the next five (5) years, and;

WHEREAS, Local roads play an essential role in the overall state transportation network and
local bridges are the critical component of the local road systems, and;

WHEREAS, State support for the replacement or rehabilitation of local bridges continues to be
crucial to maintaining the integrity of the local road systems and is necessary for the County and
townships to proceed with the replacement and rehabilitation of the high priority deficient bridges
described above, and;

WHEREAS, Jackson County intends to proceed with replacement or rehabilitation of these


bridges as soon as possible when State Transportation Bond Funds are available;

BE IT RESOLVED, that Jackson County commits that it will proceed with the design and
contract documents for these bridges immediately after being notified that funds are available in order
to permit construction to take place.

SOUTHWEST REGIONAL DEVELOPMENT COMMISSION

Motion was made by Commissioner Wachal and seconded by Commissioner Hummel to adopt
Board Action 17-038: Authorizing the Jackson County Revolving Loan Fund Committee to pursue a
modification of Revolving Loan Terms. Motion carried unanimously.

Motion was made by Commissioner Hohenstein and seconded by Commissioner McClure to


adopt Board Action 17-039: Approving the Revolving Loan Fund Guidelines for the Jackson County
Revolving Loan Fund Committee Members. Motion carried unanimously.
COUNTY COORDINATOR

Motion was made by Commissioner McClure and seconded by Commissioner Wachal to adopt
Board Action 17-040: Approving acceptance of a 67%/33% ownership split between the City of
Jackson & Jackson County for the bus storage facility. Motion carried unanimously.

Motion was made by Commissioner Eigenberg and seconded by Commissioner Hohenstein


to adopt Board Action 17-041: Appointing the Public Works Director to act as the
Manager/Administrator of the Public Works Campus (per the City of Jackson/Jackson County Joint
Powers Agreement for Public Works Facility). Motion carried unanimously.

Motion was made by Commissioner Wachal and seconded by Commissioner Hohenstein to adopt
Board Action 17-042: Approving the Revised Purchasing & Procurement Policy (F075) to establish
Federal Awards guidance. Motion carried unanimously.

BOARD REPORTS

Commissioner Wachal reported on meetings/events involving the Joint Facilities Committee, SW


Regional Development Commission (SRDC) & SRDC orientation, SW Regional Solid Waste
Commission and Rural Minnesota Energy Board.

Commissioner McClure reported on meetings/events involving the Assoc. of MN Counties (AMC)


new commissioner training, Revolving Loan Fund Advisory (RLF) Board and SRDC orientation.

Commissioner Hohenstein reported on meetings/events involving the Jackson County Library Board,
Plum Creek Library Governing Board, Historical Society annual meeting, SRDC orientation and
Southern Prairie Community Care.

Commissioner Eigenberg reported on meetings/events involving SRDC orientation and AMC new
commissioner training.

Commissioner Hummel reported on meetings/events involving the Joint Facilities Committee.

Motion was made by Commissioner Eigenberg and seconded by Commissioner Wachal to


adjourn the meeting. Motion carried unanimously.
