Serious Concerns Raised Over Poolbeg Incinerator Incident

Dublin City Council Manager, Own Keegan, has been called to hold an
urgent meeting after Fianna Fail raised serious concerns following an
incident at the Poolbeg Incinerator.

Eleven people needed medical assistance after the incinerator was lit less than a
week.

Fianna Fa il Dublin City Councillor, Paul McAuliffe said: "I am calling on the City
Manager to urgently arrange a briefing for councillors to ensure that the incident
has no implication on the safety and health of residents, that workers are not
under any further threat and that there has not caused damage to the Dublin Bay
biosphere.

TheGovernment,togetherwiththeDublinCityCouncilofficials
responsibleforoversightofthePoolbegsitemustdowhatisnecessary
toassurethepublicthatanincidentofthisnaturewillnotreoccur.

"HealthandSafetyprotocolsatthesitemustbemadesufficiently
stringenttoprotectthehumanhealthofemployeesattheplant,locals
inthegreaterSouthDublinareaandinparticularlocalresidents."

GreenPartyLeaderandTDforDublinBaySouthEamonRyansaid:
"Thisincidentisextremelyworrying,giventheincineratoronlybegan
operationsthisweek.Ourthoughtsarewiththe11peopleaffected.

"Weareextremelyconcernedatthisincidenthappeningsosoonafter
incinerationbeganatthesite.Theauthoritiesneedtogettothebottom
ofthisassoonaspossible.We'recallingforallactivitiesatthesiteto

LifegoesonasnormalinSandymount,Dublin,wheretheseafrontbustleswithlife,peoplejogging,
childrenrunningaroundonthebeachwhenthetideisout.

Suchabeautifulspectacleofnature,oneyouwouldhardlyfindinanyothercapitalscitycentre.

Butforme,anItalianwhohasbeenanenvironmentalactivistformanyyearsandhasrecentlymoved
tothispartoftheworld,thePoolbegincineratorisaveryominouspresence.Inmycountryincinerators
havebeenaroundforacoupleofdecadesandafewmoreareinthepipeline.Almosteverywhere,the
presenceofincineratorshasgeneratedwidespreadprotestamongthelocalpopulation.Iremember
visitingoneinAcerra,intheSouthofItaly,whileIwasaccompanyingadelegationofinternational
activists.Localprotestorswereescortingus,recountingtheexperienceoftheirfightagainstwhatthey
consideredaseriousdangertotheirhealth.

Theirswasnotanirrationalfear,noranexampleoftheNIMBYsyndrome.Therearenationaland
internationalstudiesthatlinkthepresenceofincineratorstoanincreaseinaseriesofpathologies,
rangingfromrespiratorydiseasestotumours.AstudyconductedinTuscanyconfirmed
theepidemiologicalevidenceonhealtheffectsandtheincreasedriskofcardiovascularandrespiratory
diseases.

Similarstudiesalsoconfirmedincreasedrisksofmiscarriageandpretermbirthsamonglocal
populationsexposedtoincineratorsindifferentsitesinItaly.AccordingtoPatriziaGentilini,an
oncologistwiththeorganizationISDEMediciperlAmbiente(DoctorsfortheEnvironment)thelink
betweenincineratorsandtumourscannotbedenied,especiallyforthosetumoursprimarilyaffecting
womenandchildren.

Thatiswhy,sadly,manyoftheprotestgroupsfightingtheseplantsarecalledMomsagainstthe
incinerators.

Cocktailoftoxicelements

Despitethisincontrovertibledata,incineratorsarepresentedbygovernmentsandlocalauthorities,
desperatetofindasolutiontoagrowingwastedisposalproblem,asthegreenalternativeforabright
future.

Therealityhoweveristhattheyreleaseintotheairacocktailoftoxicelementssuchasarsenic,lead,
cadmium,nickel,chromium,andevenmoreworryinglydioxinsandfurans,whoseeffectsonhuman
healthcanbetransmittedtofuturegenerations.Dioxinsinparticulargetintothesoilandwater,
enteringthefoodchain,andtakedecadestobeeliminatedfromtheenvironment.Itisestimatedthat
theyremaininthesoilfor100yearsandinthehumanbodyforsevenyears.

TheproblemofincineratorsandtheconflictstheyhavegeneratedisinnowayconfinedtoItaly.The
caseofDetroit,thelargestsolidwasteincineratorintheUnitedStates,isoneofthemost
iconicenvironmentalandsocialjusticefightsin
thecountry.InFrance,theAssociationforResearch
andTreatmentsAgainstCancer(ARTAC)hasalsolinkedincineratorstocanceranditsPresident
DominiqueBelpommeevenwentasfarasdescribingenvironmentalpollution,includingchemicalair
pollution,asacrimeagainsthumanity.

Graveconcern

AllthisexplainsmytotaldismaywhenIfoundout,accidentally,thatanincineratorhadbeenbuiltin
thecentreofDublin.IfeltevenmoredismayedwhenIrealisedhowlittleawarenessexistsinIreland
aroundthedangersofincinerators.Ifoundouttherehadbeensomeprotestsbeforetheplantwas
builtbutnowthatitissettobefullyoperationalbyAugustandwillstartburningsomewastenext
month,theprevailingattitudehasbecomeoneofresignation,afeelingthatnothingcanbedone.

Thisisfarfromtrue.ThereareaseriesofissuessurroundingthePoolbegincineratorthatshouldbea
gravecauseforconcernforbothresidentsandthewiderpopulation.

Firstly,theissueofemissionscontrols.Atthemoment,Covanta,thecompanythatrunstheincinerator,
hasagreedtopublishthefollowingdataonitsownwebsite:FurnaceTemperature,TotalDust,Total
OrganicCarbon(TOC),HydrogenChloride(HCL),SulphurDioxide(SO2),NitrogenOxide(NO2),
CarbonMonoxide.However,nocontinuouspublicationsondioxinandfuranlevel,themostdangerous
particles,willbeprovided.

Independentmonitoringneeded
Secondly,thereneedstobeanindependentbodyinchargeofthemonitoring,abodythathasyettobe
appointed.Strangelyenough,theEPAlicenceallowsthecompanyitselftoappointindependentbodies
inchargeofmonitoringemissionsandverifyingtheirengineeringintheplant.Howindependentcan
thesebodiesbeiftheyareappointedbythepotentialpolluter?ThelocalSocialDemocratshaveasked
foranindependentmonitoringsitetobeopenedatPoolbegwithanemphasisonthemonitoringof
furansanddioxins,butsofartheyhavenotreceivedanyconcreteassurancefromtheEPA.

ThethirdissueisCovantastrackrecord.Lastyear,thecompanyhadtoshut
downoneoftwoofits
stacksatitsplantinDurhamYorke,Canada,asthedioxinsreleasedintheairhadsurpassedthelimits
by13timesthelegallimit.ThecompanydefendeditselfbysayingthattheCanadianlawsintermsof
emissionsaretoostringent.TheonessetbyDublinCityCouncilontheotherhandarealmostcertainly
tooloose,whichmeansthatifpressuredoesnotmount,thecompanycouldeasilyreleasethe
sameamountofdioxinsintheairwithnolegalconsequences.

Iwouldliketobelievethatthiswonthappen,butmyownexperiencesuggeststhatwithouta
movementofcitizensthatforcestheauthoritiesandthecompanytobetransparentandaccountable,
thesemeasuresareveryunlikelytohappenspontaneously.Iamnotcomfortablewiththeideaofan
incineratorsittinginthemiddleofacity,inadenselypopulatedareaandrightacrossfromanareawith
aclusterofschools.

Ithinkthereisenoughinternationalevidenceagainsttheseplants,butevenforthosewhoremain
sceptical,theprecautionaryprincipleshouldbeenough.Theprecautionaryprincipledictatesthat,
unlessprovenotherwise,thingsthatcanbedangerousforhumanhealtharetobeavoided.Therisk
offindingouttoolatethatthesubstancesreleasedintheairarehighlytoxicistoobigarisktotake.

CovantalastMayhadtocloseoneofthetwoboilersorstacksatitsnewlybuiltDurhamYork
incineratornearTorontoafteremissionsexceededthelimitssetbytheCanadianministryof
environmentfordioxinsandfuransby13times.

Dioxinsandfuransaretoxicbyproductsthatcanresultfromburningwaste.

Concerns

Concerns have been raised by Dublin City Councils environment committee


about the implications of the Canadian plants failures for Poolbeg, which is due
to start operations by the end of next year.

JoeMcCarthy,aphysicistandmemberoftheenvironmentcommittee,saidtheproblemsatthe
Canadianplantshowedthevalidityofconcernsoveremissionsfromincineratorsandthequalityof
testing.

Whatfrightensmeaboutthis,isitisfirsttimewevebeenabletogetrealinformationonareal
problemthatisinherentintheincineratorindustry.

IamconcernedthetestingregimeatPoolbegwillnotbesufficientlystringenttoprotecthuman
health.

MrMcCarthy,aSandymountresidentwhohadappealedtoAnBordPleanlanottoapprovetheplant,
saidtheplannedtestingregimeforthePoolbegplantshouldimmediatelybemadepublic.

Badlywrong

What happened in Canada was that Covanta got it badly wrong and they got it
badly wrong in spades.

AntiAusterityAlliancecouncillorandmemberoftheenvironmentcommitteeMichaelOBriensaidhe
hopedpublicawarenessofCovantasperformanceinCanadawouldstopthedevelopmentofthe
Poolbegplant.

IputittotheDublinCityCouncilofficialsresponsibleforoversightofthePoolbegprojecttobroach
thissituationwithCovantaandtodowhatisnecessarytosatisfytheDublinpublicthattheflawsbuilt
intotheDurhamYorkIncineratorarenotbeingreplicatedinPoolbeg.

Theprojecthadbeenopposedbyalmostallcouncillorshesaid.

AspokesmanforCovantasaidwhileoneunitattheCanadianplantdidexceedtheverystringent
emissionlimitfordioxinsandfuransthisdidnotrepresentarisktohumanhealthorthe
environment.
HesaidtherewerenoimplicationsforthedevelopmentofthePoolbegplant.

Thecitycouncildidnotrespondtoqueriesonthematteryesterday.

UnsustainableGreenhouseGasEmissions

Section8andAppendix8oftheEIS.

TheEISstatesinSection8.4.2ofAppendix8.2thatburningthewasteintheproposedincinerator
producesmoregreenhousegasemissionsthantreatingthesamewasteusinglandfillwithanaerobic
digestion(AD).Thedifferencebetweenthetreatmentsis551,000tonnesofCO2equivalentoverthe
lifeoftheproposedplant.(Table8.11)

Onpage21ofthenontechnicalsummaryoftheEIStheapplicantstates:

9.3.1.AnassessmentwasundertakenoftheimpactoftheFacilityonclimate,inparticularthe
greenhousegasemissionsfromtheFacilitywerequantifiedandcomparedwiththealternativeof
landfillingthesameamountofwaste.TheFacilitywasfoundtohavemarginallylessgreenhousegas
emissionsthanthelandfillingalternative.

Thisstatementiswrong.TheapplicantsdetailedanalysisstatestheoppositeatSection8.4.39onpage
8.29wherewefind:

However,landfillinginconjunctionwithanaerobicdigestionoffersasmallnetsavingsover
incinerationoftheorderof0.03%ofthetotalgreenhousegasemissionsinIrelandin2012(seeFigure

EpidemiologicalStudiesonHumanHealth

TheBoardgaveanopiniontotheapplicantontheinformationtobecontainedintheEIS.This
requiredthattheassessmentbytheapplicantoftheproposeddevelopmentonhumanbeingsshould
haveregardtorecentepidemiologicalstudiescarriedoutinternationally.TheEIScontainsno
referencetorecentstudiesandisthereforeincomplete.

Section13.3.34onpage1311hasthefollowingextractfromtheHRBreport(2003):

Epidemiologicalstudiesofthehealtheffectsoflandfillingandincineration
Asthereisapaucityofliteraturerelatingtomodernlandfillandincinerationsites,nearlyallofthe
studiesidentifiedinthisreportrelatetooldertechnologies.Itcanbeassumedthatasemissioncontrols
improverisksofadversehealtheffectsdiminish.

TheHRBreportitselfstatesonpage13:
WorkcommencedonthisprojectinDecember2001andtheliteraturesearchwascompletedattheend
ofFebruary2002.

ThusitisclearthatnoreferenceslaterthanFebruary2002havebeenmadedirectlyorindirectlyinthe
EIS.

DrAStaineshaswrittenacritiqueoftheEIS.Hisconclusionstates:

Theproposeddevelopment,inmyprofessionalopinion,requiresaproperHIAtoensurereasonable
considerationofhumanhealthissuesintheplanningandlicensingprocesses.Thematerialprovidedin
theEISfallsfarshortofanyreasonableestimateofwhatisrequired.ThepeopleofDublinandthe
localcommunitydeservebetter.

Theconstructioncostoftheincineratorhasbeenputat350millionbyCovantaandtherevenue

TheCombinedResidentsAgainstIncineration(CRAIwhichincludesresidentsofRingsend,
Irishtown,andSandymount)handedover3,000objectionsonMondayafternoontoAnBordPleanala.
ThesignatureswerecollectedfrompeopleacrossDublin,includingmembersoftheCrumlinand
BallyfermotAntiBinTaxcampaigns,againsttheproposedincineratorforDublinBay.

CRAIopposesthesitingofanincineratoronthePoolbegpeninsulaongroundsofhealthfearsand
trafficandenvironmentalconcerns.Theyarecallingforalternativestoincinerationsuchaspublic
recyclingandfordemocracyinplanninganddevelopment.

DublinCityCouncilalongwiththeotherDublinLocalAuthorities,DunLaoghaireRathdown,Fingal
andSouthDublinCountycouncilshaveappliedtoAnBordPleanalaforapprovalonthePoolbeg
Peninsulaofanincineratorthatwillburn600,000tonnesofhousehold,commercialandindustrial
wasteperannum.

TheincineratorisnotjustaRingsendorSandymountissuebutonethatwillatsomepointimpacton
everyoneinDublinthrougheitherdioxinsinthewind,furtherincreasedwastechargesortraffic.

ThePublicPrivatePartnershipmodelhasbeenprovenwiththeSewerageTreatmentPlanttobemore
expensiveforthetaxpayeranddetrimentaltothehealthofpeopleinthearea.Serioustraffic,health
andsafetyandcostissuesrelatingtotheplantremaintobeexplainedbyDublinCityCouncilandthe
Government.DublinCityCouncilhavealreadygiven10milliontoprivateconsultantsforthe
incinerator.

Mostofthelocalpoliticianshaveexpressedtheiroppositiontotheincinerator,includinglocalPDT.D.
MichaelMcDowell.However,despitethis,DublinCityCouncilhavegonefullsteamaheadfor
approval.AmotionwasputtotheDailrecentlybytheGreenandLabourpartiesinstructingthe
MinisterfortheEnvironment,DickRoche,todroptheplanstobuildtheincineratorbutFiannaFail
andthePDsvotedfortheincinerator.

TherewasnosignofSinnFeinandtheLabourPartyortheGreensatthecommunityorganisedevent
today.Apparantlytheyorganisedtheirownseperatephotoshootstogetthemostpoliticaladvantage
forthemselveswhilethecommunitiesonthegrounddidmostoftheworkincollectingthe3000
objections

Ratherthangettingincinerationandoverdevelopmentthepoolbegpeninsulashouldbedeveloped
accordingtowhatisdecidedbythepeopleofthearea.Moreappropriatewouldbeanaturepark,light
impactcommunityrecreationfacilities(walks,pitchandputt)andlimitedhousingratherthanthe
proposedincineratorandmassivehighriseFabriziadevelopment.

Thecampaigntoensuretheenvironment,communitiesandpeopleareprioritisedoverdeveloper's
profitwillcontinuewithpeoplepowerandmoreproteststostepupthepressureonpoliticiansto
ensuretheincineratorandothernoncommunityfriendlydevelopmentsdonotgoahead.

Pressure is to be put on politicians - if this incinerator is not stopped they will


lose votes (next year or early 2016 is a general election)
We need to highlight and get people of Dublin involved - this is a Dublin
incinerator that will affect whole of Dublin and Ireland.

The Minister for Environment Alan Kelly can stop this incinerator if he gives the
power back to Dublin City Councillors to make decisions about waste
management.
We are asking people to join in our protest on Wednesday 22nd October -
meeting at Ringsend church at 5pm and marching to the Dail. Stop the

Jailedforanoncrime.

ThismanhasspentovernineMonthsinvariousPrisonsthroughouttheCountry,foranoncrime.

TipperaryFarmerTomKennedyrotsinMountjoyTrainingUnittodayforanoncrime.Likemany
otherPeopleprotectingtheirLand,hewasjailedunderacontemptOrderinFebruary2003byJudge
OliveButtimeroftheNenaghCircuitCourtfornotvacatinghisLandalthoughheboughtitfromhis
deceasedBrotherintheearlyseventiesandhasfarmedtheLandfor25years.

TheLandisnowoccupiedbySolicitorOwenHarrahillwhorefusestovacatetheLandafterTom
succeededinobtainingaHighCourtOrderbyJudgeGilliganin2005.

ThreeHabeascorpusattemptstodatehavefailedinthereleaseofTomKennedyalthoughhewas
deniedrightofAudienceanddueprocesswhenrepresentinghimselfinCourtinfrontofButtimerin
2003.

HisFundementalrightsunderArticle40weredemolioshedfromtheBench.
HehasbeenincarceratedwithoutaHearing.

Contempt is a 'Judge Made' law. This means that it was never before the
Oireachteas nor indeed was it before the President of Ireland.

There is a law (which is particularly embraced by ECHR) that states that 'no man
may be a judge in his own cause.' In most instances of contempt, including the
alleged contempt exhibited by Mr. Kennedy, the Judge is the injured party.
Therefore, in my opinion, the honourable Buttimer J. acted as a judge in her own
cause.

More law states that nobody can be incarcerated except in circumstances as


provided for by law. Every human being accused of a crime has a right to defend
themselves in a trial specifically convened to try the actual crime that is alleged
to have been committed. ECHR is very clear on this and Irish law accepts and
applies ECHR, indeed, even if ECHR didn't exist, Irish law embraces this principle.
But not in this case (and in many others), again in my opinion. There has not
been a trial that has accepted and has pronounced Mr. Kennedy's guilt, so I'm
very confident in my opinion here.

Nine months in jail, being moved around a lot and being put at considerable risk
(regarding Mr. Kennedy's age and considering the company he's forced to keep)
seems somewhat unfair, to understate it considerably, again in my opinion, for
allegedly offending (and allegedly in a deceitful fashion - afterall the truth is
neither an act of contempt nor a tort) a fellow citizen. Rapists have been known
to have an easier time of it (in recent memory too).

All in all, I wish Mr. Kennedy and his family all the best for Mr. Kennedy's next
visit to the High Court. And I hope for justice to manifestly be seen to be done.

includesfindingdiscrepanciesbetweenwhattheplanningpermissionwasgrantedbyAnBordPleanala
andtheEPAincludesandwhatthecontractisfornowe.g.changingfrom25to45yearsandnow
includingwastefromalloverIrelandandnotjustDublin.

Pressureistobeputonpoliticiansifthisincineratorisnotstoppedtheywilllosevotes(nextyearor
early2016isageneralelection)
WeneedtohighlightandgetpeopleofDublininvolvedthisisaDublinincineratorthatwillaffect
wholeofDublinandIreland.

CityCouncillorstomakedecisionsaboutwastemanagement.

The unelected Dublin City Council executive management have announced


that they have given the private multinational Covanta the permission to
start construction on the 600,000 tonne Poolbeg/Dublin Incinerator which
will be located at the heart of the beautiful Dublin Bay in Dublin's South
Inner City.

The Council signed a 45 year contract which will see Covanta make hundreds of
millions in profit while the health of Dublin people is destroyed.

The local community has campaigned for almost 10 years against this toxic
incinerator.

If the incinerator (which will be the largest in Europe) goes ahead it will destroy
their health (and those of all Dublin), clog the roads with traffic, damage the
climate, reverse recycling rates, and result in toxic ash being transported around
Dublin and Ireland.

The elected representatives of the Dublin people - the Dublin city councillors -
recently voted 50 to 2 against the decision of City Council Manager to go ahead
with the contract with Covanta.

This incinerator is anti-health, anti-climate and anti-democratic.

Construction is only weeks away from starting on site.

We need people power from across Dublin, Ireland and international to stop this
incinerator gong ahead.

If the councillors are given back the powers over waste management by the
Minister for Environment then they can vote to stop the Poolbeg/Dublin
Incinerator.

Please sign the petition calling on the Minister for Environment, Alan Kelly to
transfer responsibility for decision making waste management away from the
unelected City council executive and back to democratically elected councillors in
Dublin City Council so they can stop the Poolbeg/Dublin toxic incinerator.

other large industrial projects and provisions governing the removal of
important archaeologi=al sites. The Commission is happy to announce that

operation document agreed between Ireland a=d the United Kingdom on
combating illegal waste exports.

TheCommissionwelcomestheadoptionofacooperation=20documentaimedatstrengthening
contactsbetweenIreland=ndtheUnitedKingdomtocombatillegalwasteexports.In20=4,the
CommissioncontactedbothMemberStatesafterbecomin=awareofsignificantillegalwasteexports
fromIrelandt=NorthernIreland.Followingthis,bothStatesworkedtoge=hertodealwiththeproblem
andhaveagreedonacooperatio=document.

LegalProcess

Article226oftheTreatygivestheCommissionpowers=otakelegalactionagainstaMemberState
thatisnotrespectingitsobligations.

IftheCommissionconsidersthattheremaybeaninfringementofEUlawthatwarrantstheopeningof
an=infringementprocedure,itaddressesa"LetterofFormal=20Notice"(firstwrittenwarning)tothe
MemberStateconce=ned,requestingittosubmititsobservationsbyaspecifiedd=te,usuallytwo
months.

Itisimperativethatincinerationremainsclassifiedasdisposalratherthanrecovery.Incinerationisa
wasteofenergynotawastetoenergyprocessastheincinerationlobbygroupwouldlikeusto
believe.Therearevastamountsofcarbontiedupinwastethancanberecoveredbyfarmore
favourabletechnologies.Burningitandreleasingitintotheatmosphereisnotaloneawasteof
resourcesbutrecklessintermsoftheamountsofexcesscarbondioxidebeingreleasedbackintothe
atmosphere.Wasteincinerationreleasesmoreharmfulgasesintotheenvironmentthantheburningof
fossilfuels

Itisnottruethatincinerationwithenergyrecoveryisagreeneroptionthanlandfill.Thetwomaterials
thatsupplyasignificantcalorificvalueinmunicipalwasteareplasticsandcardboard.Plasticsconsist
mostlyofoil.IntermsoftheimpactonclimatechangeandourresponsibilityundertheKyoto
Agreement,burningplasticsisequivalenttoburningfossilfuels.Intermsofresourceandenergy
recovery,itisfarmoreefficienttorecyclepaperthanburnit.

ForeachtonneofwastethatisburntthereisapproximatelytheequivalentamountofCo2releasedto
theatmosphere.ThishashugeimplicationsintermsofGlobalwarmingandtheSternReporthas
clearlywarnedGovernmentsofthedangerofignoringtheimportanceofreducingourCO2emissions.
ThepenaltiesthatIrelandwouldincurinCarbontaxeswillbeenormousanditiswethetaxpayersthat
willbefootingthebill

Itmustthereforebestressedthatwasteincinerationshouldcontinuetobeclassedasdisposalrather
thanrecovery,evenifitisusedtoproducealimitedamountofenergy.

Wewouldthereforeaskyoutosupportthefollowingamendments:

Amendments578585and244,whichreintroduceEuropeanCourtofJusticecriteriafor
energyrecoveryfromwasteincineration;

Amendment242,inwhichincinerationisonlydefinedasrecoverywhenitispreferableto
substitution;

Amendment480or481,whichencouragemoreenergyefficiencyinMSWincineration.

Overalllongtermobjectives

Aclear5stepwastehierarchywillensurethattheobjectivesoftheDirectiveremainbeneficialtothe
environmentinthelongterm.Thiswillstresstheimportanceofprevention,reuseandrecyclingof
wasteoverincinerationandlandfill,whileencouragingthephaseoutoflandfillandincinerationof
materialswhichcanberecycled.

Pleasealsosupportthefollowingamendments:

Compromiseamendment1,whichensuresaflexible5stepwastehierarchy;

Compromiseamendments3,4and5whichclearlydefineeachofthestepsinthewaste
hierarchy.

IncinerationshouldhavenoplacetoplayinIrelandsWasteManagementStrategy.Itispossibleto
meettheLandfillDirectivewithoutitandutilisesourceseparation,preventionandaflexiblepickand
mixoptionwhichwillcontributetotheeconomic,socialandenvironmentalgoalsofsustainable
development.

Iwouldurgeyoutodoallinyourpowertoensurethatincinerationremainsclassifiedasdisposal.

Paid-for Arup Spin on 450 Million Ringsend Glass Bottle Site


Outstanding spin from Arup seems to claim the Ringsend Glass Bottle site
lands are in a satisfactory state and that space created under(!) car-
parking spaces and other services would create a wide and ventilated
physical barrier between polluted lands and the future habitable spaces of
the new development.
Unpaid Expert Opinion
Former EPA expert Malcolm Doak warned that 30 per cent methane gas
levels exist on the lands and that a significant gas risk still remains on-
site.

Paid-for Arup Spin on 350 Million Poolbeg Incinerator


Arup said the environmental impact statement found the Poolbeg waste-to-
toxins incinerator would not significantly impact the environment and "no
residual negative impacts are anticipated" from the construction or
operation of the plant.
Unpaid Expert Opinion
Prof Staines, a medical doctor and academic, said it was "at best careless,
and more realistically reckless, to proceed with a major development
without considering methods of minimising harm and maximising benefits
to the local community" and said the execution of a Health Impact
Statement on such projects was common practice internationally.

In relation to the environmental impact statement, undertaken by Arup


Consulting Engineers on behalf of the council, Prof Staines claimed that "in
no case is there any serious consideration of the actual impacts of the
estimated emissions on people in the local community or on human health".

DDDDA has been a poster boy for rampant multi-dimensional conflicts-of-interest. Ex: Seanie and Lar at the

DDDA's newest chairman, N.Brennan, is spun as a governance expert by advertising dependent newspapers.
N.Brennan was appointed by Mr J Gormley in a closed-door recruitment process. N.Brennan was a director
for Ulster bank when it financed Zoe Developments large Fabrizia site on Sandymount Strand (Zoe now has a
negative net value of -900,000,000, plus or minus an acre of occupied public footpath).

How can Arup not anticipate any negative impacts given operator Covanta's curious record?

The Seanie & Lar culture at DDDA-Anglo was the catalyst for the 490,000,000,000 banker bailout and the
proving ground for NAMA's 90,000,000,000 developer bailout. Is there any pattern which shows the
rampant multi-dimensional conflicts of interest at the 450,000,000 Glass Bottle site will not be repeated
at NAMA?

Both NAMA and DDDA combine closed-door autocratic control over planning permits.

Both NAMA and DDDA have the same executive sponsors - the Galway Tent cartel.

Why is a city councillor who claims to be a doctor and "specialist in


chemical pathology" not doing his utmost to prevent Covanta
operating in Ireland?

By supporting lawbreaker Covanta, Dr Tormented is supporting the


export of 900 Million to Covanta in Luxembourg or in
the Caribbean. And he supports the potential billions in health
damage done to the people of Dublin. Luckily any health damage
and premature deaths caused by an environmental lawbreaker
create a lucrative market for health care professionals.

Its widely reported that a Covanta agent in Ireland legally used The
Galway Tent K Club Golf Tournaments to route undisclosed sums
of cash to Fine Gael. Before the 2011 general election Covanta
met with soon-to-be ministers Quinn and Hogan. So is it any
surprise that Fine Gael's Dr Tormented, a lowly FG councillor, is on
board with Covanta's needs?

"we [Fine Gael?] are continually exhorting them [Covanta]


to resume construction but it is unlikely that it will
happen till next year."- Dr Tormented's Blog.

Everyone knows that international banks and Covanta are mighty


fine corporate citizens. Dr Tormented seems to claim that Covanta
needs to be helped in its desperate need to borrow cash from these
banks and indicates that FG's Hogan will re-write Irish laws to
create "certainty" for Covanta and these international banks in
the proposed Poolbeg waste-to-toxins scam.

Since 2011 Fine Gael has been implementing the traitorous FF


policy of bankrupting Ireland by exporting Irish taxpayers money to
bail out German, American, Dutch, UK and French banks. These
banks gambled by investing 520 Billion with Seanie's Anglo-Irish,
Allied-Irish, First-National and the rest of the inbred cabal. The
international banks know that corrupt Irish governments will always
bail them out. So where is the alleged business risk for Covanta
bankers?

Does this mean the Fabrizia owner has no problem with illegal development? Can
legally built architectural masterpieces be removed on a whim? Can illegally built

build outlaw causeways across beaches? Can public officials provision banks with

Why has Dublin Docklands Developers Authority (DDDA) not been shut down
yet?

North Quay Investments Ltd (NQI) is apparently controlled by a builder named


Liam Carroll who also appears to control a site on Sandymount Strand beside the
foreshore referred to as 'Fabrizia'. Following recent court judgements NQI
appears to have built an outlaw building on the north bank of the Liffey.

The proposed chief tenant at the NQI site is bankruptcy-challenged Anglo-Irish Bank which favours removing
financially effective preventative medical care from pensioners while from the other side of its synapse it begs for
literally billions of cash support from taxpayers national pension funds, apparently.

The Fabrizia site is beside the IGB site in which DDDA is both speculator and planning authority, a site which is now
stress-testing Anglo-Irish Bank to the tune of say 288 million in vaporised market value, not to mention shady
dealings, in the Google Sketchup sense of course.
One company, Bloomburg, lost 75m in less than two years on Irish
stockmarket investments.

Carroll spent about 170m acquiring 21.57% in Greencore in 2006 and


subsequently increased his stake to 29.5%. That stake was worth 41.7m
on Friday.

Carroll gets extra funds from Bank of Scotland

Developer Liam Carroll has secured additional funding facilities from Bank of
Scotland (Ireland) in recent weeks, industry sources have told the Sunday
Tribune.

The developer, who owns thousands of apartments and the 400-acre


Cherrywood site in south Dublin, regularly uses the bank or its rival AIB to fund
his developments.

Bank of Scotland (Ireland) also acted as the security trustee which holds
securities on behalf of creditors when Carroll's Dunloe Ewart agreed a finance
deal in December 2005. Next month Dunloe Ewart is due to appear in court in
relation to a dispute with the company's former executive chairman Noel Smyth.

In New Jersey, the Covanta company has been REPEATEDLY fined for releasing
excessive amounts of dioxin and other toxic emissions from its Essex County
plant.

In the past year, New Jersey regulators have ordered Covanta to pay more than
$112,000 in fines for violations at ALL three of its waste-to-energy plants in
the state.

The Rutgers Environmental Law Center at Rutgers University in New Jersey has
filed a notice of its intent to sue Covanta over repeated Clean Air Act violations at
the Essex plant, the state's largest garbage incinerator.

ABOUT70residents,whoattendedapublicmeetingrecentlyinIrishtown,plantofightthe
constructionofa600,000tonneincineratoratPoolbegthroughthecourts.
CllrDermotLacey(Lab),CllrClaireByrne(GP),CllrChrisAndrews(SF)andDeputyRichardBoyd
Barrett(PBP),attendedthemeetingwithCombinedResidentsAgainstIncineration(CRAI).
Theresidentsopposethefacilityonthegroundsthatitmaycauseserioushealthproblemsduetothe
creationoftoxicash,andhaveanegativeimpactontheenvironment.
Theysaythe600,000tonneplantwouldcreate200,000tonnesofashandthatnoplanhasbeen
forthcomingonwaysandmeanstodisposeofit.
TheyarenowrefusingtotakemoneyfromtheCommunityGainLiaisonFundCommittee,setupto
contribute3%ofthecouncilestimated346mcapitalcostsoftheproject.
CRAIsaidtheprojectscapitalcostwascloserto500m.AspokespersonforDublinCityCouncilsaid
thefundwasincludedinanenvironmentalimpactstatement,whichsetoutthecalculationat3%ofthe
projectsconstructioncosts,estimatedat346m.This3%willamountto10.38m.
TheDublinwastetoenergyprojectatPoolbeggottheallclearlastSeptember,17yearsafteritwas
firstproposed.
ConstructionbeganlastOctoberonwhatisapublicprivatepartnershipbetweenthefourDublin
councilsandCovanta,aUSincineratoroperator.
TheincineratorwouldcoverasmuchgroundasCrokeParkandbeastallasLibertyHall.
Followinglegaladvice,theconcernedresidentsbelievetheyhaveasolidlegalbasistotakethecouncil
andCovantatocourtonanumberofplanningissues,includingalackofclarityonhowresidualash
fromtheplantwillbedisposedof.
SecretaryofCRAIFrancesCorrtoldTheGazette:Therewasaunanimousvotetorejecttakingpartin
thecommunitygainfundconsultation.Avotewasalsotakentoinstructthe14citycouncillorsinthe
southeastareatoboycottitaswell.
Thegrouphasdecidedtoraisefundstofighttheincineratorprojectincourt.Corrsaystheyhavea
verygoodcaseonbreachofplanning.
CllrLaceysaid:IamnotinfavourofboycottingthecommitteeandIsaidthatMyviewisthatI
waselectedtogetstuckinandworkforthecommunity.Boycotting/abstentionismisnothowIsee
doingmyjobresponsibly.

bysaying:Ihavereservationsinrelationtothesuitabilityofapublicmeetingasameansof

Greens Call For Kelly To Outline Position On The Poolbeg


Incinerator
The Green Party is calling for Minister for the Environment, Community
and Local Government, Alan Kelly, to outline why he is choosing to go down
the Poolbeg incinerator route.

Green Party Leader, Eamon Ryan, said the Managers of the four Dublin
authorities need to await government direction before signing any contract for
the Poolbeg incinerator.

He said: "An international study into Irish waste policy, published in 2009, made
it clear that the move towards the introduction of any national facilities, such as
the new proposal for the Poolbeg incinerator, would require a change in the 2004
Waste Management act, which currently only authorises a regional approach.
"The Da il needs to debate and approve this project, if it is to have any democratic
mandate. The vast majority of local councillors in Dublin have voted against the
latest proposal. Minister Kelly needs to outline why we are going down this
incineration route, when the Labour Party position has been to promote waste
reduction and recycling. The Minister also needs to outline what the potential
financial risks are for every householder in the country, as they're the ones who
are going to have to pay back the 500 million the developers are spending on
this project."

Glan Agua To Build New Water Treatment Plants In Goldrum

Glan Agua has been awarded a contract to build new water treatment
plants in Goldrum, Co Donegal.

Irish Water is to invest 19 million in improving the quality of water supplied to


over 40,000 people served by the Letterkenny and Creeslough Water Supply
Schemes.

Construction is expected to start this summer and last for approximately 20


months.

The project also includes the replacement of 4.5km of raw water main from
Lough Keel to the new plant at Goldrum, upgraded pumping stations at Lough
Keel and Lough Greenan, the construction of 1.5km of trunk water main and
1.1km of distribution main from Goldrum WTP. Once completed the works will
lead to the decomissioning of the old Letterkenny and Creeslough water
treatment plants.
Pipeline interconnectors with the Pollan (Illies), Cranford and Milford water
supply schemes, which form part of the overall plan for the regions water supply,
are continuing through the design and planning stages. In addition, pipeline
connections to Rathmullen and Church Hill are currently at construction which
will allow for the decommissioning of those two water treatment plants, while
there are also plans to replace large sections of the trunk and distribution mains
along the N56 between Goldrum and Mountain Top.

EDF Energy Buys Imtech UK And Ireland

EDF Energy has purchased Imtech UK and Ireland from Endless LLP.

The deal is a joint venture between EDF Energy and Dalkia and completion is
subject to merger control clearance from the European Commission.

EDF Group will enable Imtech UK and Ireland to continue to deliver services for
new and existing clients and support its growth across all its business, including
low carbon solutions, a key part of both Imtech and EDF Group strategies.

Within EDF Energy Services Imtech will retain its operational autonomy and will
continue to run the business with its management team.

servicesandpublicrelationsatthePoolbegincineratorinwhichspendingoverranbymorethan20m.

Thecontractwasoriginallyestimatedat8.3mbutendedupcostingaround30m.

InaletterwrittenbytheEUCommissioninAprilofthisyear,andseenbyRT,thecommission
describedthecontractualarrangementasan"illegalsituation".

NeitherDublinCityCouncilnorthemainbeneficiariesofthecontractconsultancyfirmRPS
haverepliedtoquestionsfromRTaboutwhetherthecontractwasstillinforce.

However,thecontractcontinuedtobeinfullforceasrecentlyasJulyofthisyear,accordingtoa
replygivenbythecitymanagertoaquestionaskedinthecouncilchamberbyFineGael
councillorPaddyMcCartan.

Spendingbythecouncilonsocalledclientservicesandpublicrelationsaccountsforaroundone
thirdofthe90mspentonthestalledPoolbegprojecttodate.

WiderangingcomplainttotheCommission

Theincineratorremainsunbuiltdespitebeinggrantedplanningpermissionbackin2007.

ThelettercallingfortheterminationofthecontractwaswrittenbyalawyerattheEUCommission
fortwoSandymountresidents,JoeMcCarthyandValerieJennings.

MrMcCarthyandMsJenningshavemadeawiderangingcomplainttotheCommissionabout
procurementaspectsofthePoolbegincinerationproject.

TheletterdetailstheviewoftheEUCommission'sinternalmarketandservicesdirectoratethatthe
contractappearedtohavebeenmodifiedinamannerwhichdidnotconformwithEUlaw.

TheCommission'sletterstatesitraisedthematterwiththecouncilbutthatthelocalauthority"didnot
addressalltheconcernsoftheCommissionservices".

Itcontinues:"Therefore,theCommissionservicescalledupontheIrishauthoritiestoterminatethe
contract",accordingtotheletter,dated2Aprilofthisyear.

Laterintheletter,theCommissiondescribedthecontractasan"illegalsituation"butitsaidthatthis
allegedillegalitywouldceaseoncethecontractwasterminated.

TheCommissiondoesnothavethelegalpowertoforcealocalauthoritytoterminateanycontract.
TheEUCommissiondeclinedtospecifytheirconcerns,whenaskedbyRTlastweektoelaborateon
thecontentoftheletter.

Accordingtotheletter,theCommissionhaslargelydismissedothercomplaintsmadebythelocal
Sandymountresidents,whoalsocomplainedaboutallegedchangestothesizeandscaleofthe600,000
tonneincineratorandtheinvolvementofUSwastegiantCovantaasthelocalauthority'sjointpartner
intheproject.

AspokesmanfortheCommissionsaidthattheycouldnotcommentonmattersthatwerethesubjectof
ongoinginvestigation.

TheCommissionsaidtheycontinuetobeindialoguewiththecouncil.

TheclientrepresentativeandpublicrelationscontractbetweenRPSandDublinCityCouncilwasalso
examinedlastyearbytheLocalGovernmentAuditService,whichfoundthatthecontractwasnotre
advertisedeventhoughitexceeded50%ofitsoriginal2005tendervalue.

"Thecontinuedappointmentoftheclientrepresentativeshouldhavebeenreviewedasfarbackas2005
inaccordancewithprocurementguidelines,"theLGASreportfound.

ItconcludedthatfinancialmanagementoftheentirePoolbegincineratorprojectwas"weak".

Statusupdate

InJuly,FineGaelcouncillorPaddyMcCartanaskedthecitymanagerforanupdateonthestatusofthe
contractandthepaymentsmadetoRPSandCOWI,itsDanishpartner.

CityManagerOwenKeegansaidthecouncilwasinacontractualpositionforclientserviceswith
RPS/COWI.

be given up to 26 million in extra fees- above their already over-
sized 21 million, going on 32 million fees being paid for by Dublin
Corporation.

The European Union has hierto not yet fully deliberated on the
vexed procurement issues surrounding how Elsam and another
became Dong and Covanta and that during the time of the current
discussions (over the last three years) the Dublin Poolbeg Incineration
project has leapt from 267 million yo 410 million (according to the
American Press.) And that they are now seeking a currency price
adjustment to be implemented to the project to guarantee that the
Government of Ireland does not default on the tenets of the payment
profile - the costs to treat the waste per year!

Surely Ladies and Gentlemen in Ireland you have not missed the issue for even
from here in Bulgaria it stares you in the face.

The Dublin Poolbeg Incinerator Project was tendered for correctly but
awarded ILLEGALLY TO AN ORGANISATION THAT WAS NOT PARTY
TO THE ORIGINAL BID.

It is ILLEGAL to use the term PUT OR PAY for a Service like this when it
is in effect a SUBSIDY.

It is also ILLEGAL for this PUT OR PAY principal then to be used as a


means to EXACT FURTHER SUBSIDIES IN LOWER THAN EXPECTED OUTPUTS
IN ELECTRICITY AND HEAT which inevitably follows.

It is ILLEGAL for the CONSULTING ENGINEERS RPS (FORMERLEY MC


O'SULLIVANs) to have been awarded a contract to determine the
PRE_ORDAINED OUT_COME AND NEED FOR THE DUBLIN INCINERATION
PROJECT.

It has always been ILLEGAL PRACTICE UNDER THE Services


DIRECTIVE OF THE EUROPEAN UNION TO CONTINUE WITH THE
APPOINTMENT OF CONSULTING ENGINEERS ON A PROJECT WHEN
THEIR FEES HAVE INCREASED (BE IT FROM ADDITIONAL WORK, OR FROM
NEW WORKs) WHICH SO MATERIALLY INCREASE THE VALUE (OF THE
ORIGINAL SERVICE CONTRACT) BY OVER 30%!
DUBLIN CORPORATION IS IN ITS OFFICERS CULPABLE OF THIS
MISMANAGEMENT AND NOW THE EU NEEDS TO STEP IN AND SERVE
NOTICE OF REDRESS.

In these items therefore the EU should also take note that the VARIOUS
ACTS OF COERCIAN CURRENTLY BEING ADOPTED BY DUBLIN
CORPORATION TO FORCE THE WASTE INDUSTRY TO SUPPLY ITS FREELY
COLLECTED AND CONTRACTED WASTE OBLOGATIONS TO THE
INCINERATION PLANT (SHOULD IT EVER GET BUILT) IS A MOVE AGAINST
THE CONSTITUION OF THE EUROPEAN UNION IDENTIFIER ON TRADE AND IS
A RESTICTIVE PRACTICE BANNED IN LAW UNDER BOTH EU AND IRISH
STAUTES.

In the previous items I have just scanned it seems that the premise for taking
the Waste to Ringsend-Poolbeg is flawed under the EIS EIA rules of the
EU in that there has been no comparable study done to suggest that the waste
could not have been transferred to the existing Land Fill Site by the Ring Road. If
that had been done the concerns over the option for shipping waste through the
most densely populated area of Dublin would have been eliminated in its entirety.

Likewise and I return to the issue of the day, Incineration does not do what it is
supposed to do. Professor Michael H Hayes (at the University of Limerick)
and Dr Daniel H Hayes (of the Carbolea Institute at the same University of
Limerick) have both shown that the best option Environmentally is the conversion
of the Biomass in the Waste to the Biofuel for Transport Ethanol - after
separation of the Recyclables and the Inert materials (these last two are also
not included within the incineration option.) This position has also been verified by
Dr Dominic Hogg of Eunomia and now it seems many others including many in
Denmark Sweden Norway and Finland as well as in the UK China Korea Vietnam
and India - all of whom are adopting this system.

WHY? Simply put it solves the Environmental issues as well as being as much as
60% cheaper in Capital costs and in operations and maintenance costs.

Again earlier in these items we read that the Waste to Ethanol process can be
effected at a treatment cost which can be set lower than Land Fill Costs -- I think I
read 30 per tonne was proposed for Dublin. Further I also read that there would
be no treatment cost after 6 years from the start. Further it does not need the
illegal subsidies of a Put or Pay base structure to survive!

Why then does the Government dilly dally with this? There is no contest.

Incinerator Still Inflames Community


As many as 500 construction jobs may be in doubt as the building of a highly
controversial 600,000 tonne waste incinerator in Dublin's Poolbeg continues to
be debated.

It has now emerged that any so-called interference with the project could leave
the Irish State facing a multimillion euro compensation bill.
Dublin City Manager John Tierney has warned that stopping construction work
on the plant - which is now being built in the face of opposition from the Minister
for the Environment John Gormley and the local community - would breach civil
rules.

He said that Mr Gormley's bid to cancel the project had "fundamental flaws" as
the Minister "must be aware" that the council had a statutory obligation to go
ahead with the incinerator.

Mr Tierney was speaking for the first time against the sustained criticism from
Mr Gormley of the planned incinerator.

The four Dublin local authorities had entered into a contract to build the
incinerator because of Government policy, Mr Tierney said.

In the region of 120 million of public money had already been spent on the
incinerator as a direct result of this policy, he said.

Financial liabilities could arise if the contract was terminated or if policies were
enacted to make it void, he added.

Mr Gormley has for several years been one of the most vociferous opponents of
the incinerator which is located in his constituency of Dublin South East.

As a Green Party TD he made a submission to An Bord Pleana la against the city


council's application for permission for the facility.

However on becoming Minister for the Environment in 2007 he was legally


precluded from interfering in a statutory process that had already begun.

After the incinerator was granted permission, Mr Gormley initiated an


international review of waste management policy.

Published in November, the review suggests measures to limit the amount of


waste available for incineration.

But, Mr Tierney said: "The Dublin local authorities believe that there are
fundamental flaws in the international review which is being used by the
Minister as the basis for his reform of current policy."

He insisted the council, on behalf of the four Dublin local authorities, entered into
the contract with the developers of the consortium, Covanta/Dong, precisely
because of Government policy.

The 350 million project is to employ up to 500 people on site at peak


construction and approximately 60 others in permanent jobs at the plant when it
opens.

Dublin City Council said the plant is part of "a long term integrated plan for the
management of the city's waste" and will generate heat and electricity from up to
600,000 tonnes of waste that would otherwise go to landfill, generating enough
electricity for up to 50,000 homes as well as district heating potential for the
equivalent of up to an additional 60,000 homes.

Late last year another Dublin politician also called on Dublin City Council and
Dublin Waste to Energy Ltd to cease all construction on the site.

Dublin South East Deputy Lucinda Creighton said John Gormley had failed to act
in time, suggesting a now mooted review was pointless as work had allready
started.

She added: "The Minister's failure should not be reason enough for this
unnecessary and unwanted project to go ahead."

ALLEGATIONS of a conflict of interest at the Poolbeg incinerator have
prompted the European Commission to order an investigation into the
100m project.

TheCommissionhassaiditwillwritetoDublinCityCouncilcallingforaninvestigationafter
receivinganumberofcomplaintsfromresidentsinthearea.

CLAIMS

Theallegationsrelatetotheroleplayedbyaseniormanageratoneofthecompaniesthatadvised
DublinCityCouncilontheproject.Thesameindividuallaterjoinedoneofthefirmsthatsuccessfully
bidtocarryoutthedevelopment.

TheCommissionwasrespondingtotwoclaimsbyresidentsinthePoolbegareaandsaidthismatter
shouldbe"investigatedbythenationalcompetentauthorities"inIreland,accordingtoanRTEreport.

Thecommissiondocumentgoesontosaythatit"intendstocalltheattentionoftheIrishauthoritiesto
theneedtoprovideadequatefollowuponthismatterandtoinformtheCommissionoftheoutcomeof
theiractions".

TheindividualinquestionhadbeenemployedbyengineerconsultancyfirmCOWIwhichwasoffering
advicetothecouncilatthetime.COWIwasoneoftwocompaniesprovidingsuchinformationto
DublinCityCouncilandwashiredin2001.

TheseniormanagerleftCOWIoneyearlaterafterbeingappointedtoaseniorrolewithDanish
companyElsam,justmonthsbeforethecompanybidforthecontracttobegindevelopmentand
subsequentlyoperatethePoolbegincinerator.

ItisunderstoodthattheCommissiondoesnotsayitagreeswiththeallegationsmade,butthatitwillbe
askingthecounciltoexaminetheissueandreportbackitsfindings,accordingtoreports.

LastnightaspokespersonforDublinCityCouncilsaidshewasnotinapositiontomakeanycomment
onthematteroutsideofwhatwascontainedinajointOireachtassubmissionbythecouncillastmonth.

Previously,DublinCityManagerOwenKeeganhassupportedcallsforanindependentinvestigation
intotheincinerator.
