JUDICIAL AFFIDAVIT OF SANJI DE GUZMAN

I, Sanji de Guzman, 45 years of age, engineer, married, and a
residence of Blk25 Lot10 Cebu St., Kassel City Subd., Tacloban City, witness
for the defendant in this case, states under oath that:

PRELIMINARY STATEMENT
The person examining me is Atty. Niel A. Montallana with address at

4 floor New Bldg. cor. Real and Imelda Avenida St., Tacloban City. The
examination is being held at the same address. I am answering his question
voluntarily to the best of my knowledge and fully conscious that I do so
under oath and may face criminal liability for false testimony and perjury.

PURPOSE
This affidavit/testimony of witness Sanji de Guzman is being offered
to prove the validity of the conditional sale and to prove the signature of
Julia de la Cruz the vendor in the sale.

Q1. Please state your name and other personal circumstances for the
record.
A1. I am 45 years of age, engineer, married, and a residence of Blk25 Lot10
Cebu St., Kassel City Subd., Tacloban City.

Q2. Do you know Ashton Pamintuan the defendant in this case?

A2. Yes Sir, he is my classmate in college.

Q3. How about Julia de la Cruz?

A3. Yes Sir, Julia is the sister my wife Nami de Guzman.

Q4. Last time you told me that Mr. Pamintuan is your classmate in college.
Please tell me what you know about him.
A4. Ashton is a friendly person that you can trust and can share your
problem. He is honest, generous, a good father of the family and a God
fearing.

Q5. Please tell me about Julia de la Cruz.

A5. Julia is so kind and a caring sister. She wants her family to be always
happy.

Q6. Mr. Sanji where were you on April 20, 2011?

A6. I am at the house of Julia de la Cruz.

Q7. Why you are there?

A7. My family is invited for Julia home coming.

Q8. Showing to you this document, can you identify it?

A8. Yes Sir, this document is a conditional sale which Ashton and Julia
entered into. And I am one the witness in this sale.

Q9. Is this is the signature of Ashton Paminutan below the name of Julia de
la Cruz?
A9. Yes Sir.

Q10. Above the name of Ashton Pamintuan whose signature is this?

A10. It is the signature of Julia de la Cruz my wife sister.

Q11. Why did you say it is the signature of Julia de la Cruz?

A11. It is her signature because I am present when she signed this
document. In fact, she is the one who let me signed this document as one
their witness in the sale with Nico Robin the friend of Ashton Pamintuan.

Q12. Is Julia de la Cruz fully conscious and voluntarily signed the document
without any threat, intimidation, or fraud by Ashton Pamintuan.
A12. Yes Sir, she signed it voluntarily and consciously.
