ORDINANCE NO. 2001-005

AN ORDINANCE AMENDING SECTION 13 OF THE CITY ORDINANCE NO. 97-092,

ENTTILED: AN ORDINANCE REGULATING THE OWNERSHIP, CARE AND UPKEEP OF
ANIMALS IN THE CITY OF NAGA, BY ADDING SECTION 13-A AS ADDITIONAL PENALTY
AND SECTION 13-B ON BARANGAY INITIATIVE IN THE IMPLEMENTATION OF
PENALTIES AND SANCTIONS THEREIN:-

Be it ordained by the Sangguniang Panlungsod of the City of Naga, that:

SECTION 13. - PENALTY CLAUSE. - Any person who shall violate any of the
provisions of this ordinance shall be penalized with a fine of not less than Two Thousand
(P2,000.00) Pesos or imprisonment of not less than Thirty (30) days, not more than six
(6) months, or both fines and imprisonment at the discretion of the court. The fine shall
be imposed in accordance with the provisions of ADMINISTRATIVE FINES AND
PENALTIES or City Ordinance No. 95-093.

SECTION 13-A. - In addition to the penalty given in Section 13 above, any

household owner, more particularly the head of the family whose dog or cat is
apprehended and caught and impounded at the City Pound, he/she shall be fine ONE
THOUSAND (P1,000.00) PESOS for the first offense and if found insolvent shall suffer a
subsidiary imprisonment of not less than thirty (30) days and not more than six (6)
months at the discretion of the court. This penalty of fine shall be doubled during the
subsequent apprehensions.

SECTION 13-B. - BARANGAY INITIATIVE. - It shall henceforth be mandated

that the initiative of forming a Dog Pound Catching Team shall reside in each Barangay
Council and the implementation of all provisions in this ordinance be entrusted to said
Team, the composition of which shall be the responsibility of the said Barangay Council.

SECTION 13-C. - Proceeds herein of the fines and penalties after being paid to
the City Treasurer shall be shared on a fifty-fifty basis by the Barangay concerned and
the City of Naga, the share of the Barangay to be drawn by the Barangay Treasurer from
the City Treasurer and spent solely for the operation of the Dog Pound Catching Team.
