1/62: Reply to request for goods on approval.
Dear Mr. Turner
I have now received satisfactory references and am pleased to be able to send you a wide/ generous
selection of our waterproof garments as requested in your letter of 12 March.
This selection includes several new and attractive models/ items in which the water-resistant qualities
have been improved by a special process. Due to economy/ effectiveness in our method of
manufacture, it has also been possible to reduce our prices which are now lower than those for
imported waterproof garments of similar quality.
When you have an opportunity to inspect/ see the garments, please let us know which you have decided
to keep and arrange to return the remainder/ rest/ balance as early as possible.
I hope this first selection will meet your requirements. If you would like a further selection, please do
not hesitate to let me know.
Yours sincerely

2/ 62: Reply to request for sole distribution rights

Dear Mr. Sanderson

Thank you for your letter of 8 April enquiring about our BELLTONE radio and television products.

This range has been discontinued and replaced by the CLAIRTONE. You will see from the enclosed
catalogue that the new models are attractively designed and include the latest technical improvements.
Although rather more expensive than their predecessors, the CLAIRTONE models have already been
well received and good sales are being reported regularly from many areas.

As part of our efforts to reduce manufacturing costs, I am sure you will understand that we must
increase sales by distributing through as many dealers/ outlets as possible. Dealers in other areas appear
to be well satisfied with their sales under this arrangement, and it appears to be working very well.
I hope we can look forward to receiving your orders soon, and will be glad to include your name in our
list of approved dealers, with your permission.

I look forward to your early reply.

Yours sincerely

3/ 63: Reply to request for special terms

Dear Ms. Denning

I was glad to learn from your letter of 18 July of your interest in our products. As requested our
catalogue and price list are enclosed, together with details of our conditions of sale and terms of
payment.
We have considered your proposal to place orders for a guaranteed annual minimum number of
machines in return for a special allowance. However, after careful consideration we feel it would better
to offer you a special allowance on the following scale basis:
On purchase of exceeding an annual total of:
1,000 USD but not exceeding 3,000 USD 3%
3,000 USD but not exceeding 7,500 USD 4%
7,500 USD and above 5%

No special allowance could be given on annual purchases below 1,000 USD.

I feel that an arrangement in these lines would be more satisfactory to both our companies.
Orders will be subject to usual trade reference.
I look forward to working with you and hope to hear from you soon.
Yours sincerely

5/116: A decline to an order for TV

Dear Mr. Chan

We were pleased to receive your order of 2 November for 6 Atlantis TVs. However, since you state the
firm condition of delivery before Christmas, we deeply regret that we cannot supply you on this
occasion.

The manufacturers of these goods are finding it impossible to meet current demand for this popular Tv.
We placed an order for 24 sets one month ago, but were informed that all orders were being met in
strict rotations. Our own order will not be met before the end of January.

I understand from our telephone conversation this morning that your customers are unwilling to
consider other makes. In the circumstances I hope you will be able to meet your requirements from
some other suppliers/ sources. May I suggest that you try Television Services Ltd of Leicester? They
usually carry large stock/ quantity and may be able to help you.

Yours sincerely

COMPLAINTS AND CLAIMS

I) Gap filling:
1. Complaint about damage

Dear Mr. Harrison

I am writing to complain about a shipment of tubular steel garden furniture we received

yesterday against invoice No. G 3190/1.

The crates were damaged on the outside, and looked as if they had been roughly handled.
When we unpacked them, we found that some of the chair legs were bent and rusty, and the
fabric on the seating torn, or showing signs of wear.

Two further crates from the consignment have not arrived yet, so we have not had the
opportunity of inspecting them. I have told the shipping company that we can not accept this
consignment from you, and they have contacted your insurers.

As we will be unable to retail this consignment in our stores, we are returning the shipment
to you carriage forward, and we shall expect a full refund?

Yours sincerely,
C. R. MNDEZ
Managing Director

2. Complaint of wrong goods

Dear Sirs
Our order No. TL 2643

We acknowledge the receipt of full documents and the consignment under the above
mentioned order on arrival of SS. White Queen at Saigon port on 5th December 20-

On first account everything appeared to be correct and in good condition except case No.
13. When we have this case opened, it has been found that it contained quite different
articles; and we can only presume that a mistake was made and the contents of this case
were for another order.

As we are in urgent need of the articles we ordered to complete our sales to our own
customers, we must ask you to arrange the dispatch of replacement as soon as possible.

We enclose the Survey Report issued by local Vinacontrol and the list of contents of case
No. 13, and shall be glad if you will check with our order and your copy of the invoice.
In the meantime, we are holding the above mentioned case at your disposal. Please let us
know what you wish us to do with it.

Yours faithfully

3. Complaint concerning quality

Dear Sir/ Madam

We have recently received several complaints from customers about your fountain pens. The
pens are clearly not giving satisfaction, and in some cases we have had to refund the
purchase price.

The pens complained about are part of the batch of 500 supplied against our order number
8562 dated 28 March. This order was placed on the basis of a sample pen left by your
representatives. We have ourselves compared the performance of this sample with that of a
number of the pens from this batch, and there is little doubt that many of them are faulty
some of them leak and others blot (chy mc) when writing.

The complaints we have received relate only to pens from the batch mentioned above. Pens
supplied before these have always been satisfactory.

We, therefore, wish you to accept return of the unsold balance, amounting to 377 pens, and
replace them with pens of the quality our earlier dealings with you have led us to expect.
Please let us know what arrange you wish us to make for their return.
Yours faithfully

4. Complaint of frequent late deliveries

Dear Mr. ...

We ordered 6 filing cabinets from you on 2 July on the understanding that they would be
delivered within one week. However, these were not received until this morning.

Unfortunately, there have been similar delays on several previous occasions, and their
increasing frequency in recent months compels us to say that business between us cannot
continue on conditions such as these.

We have felt it necessary to make our feelings known since we cannot give reliable delivery
dates to our customers unless we can count on understanding given by our suppliers.

We hope you will understand our position in this matter, and trust that from now on we can
rely on punctual delivery of our orders.

Yours sincerely

5. Reply
Dear Mr. ...
Your letter of 18 July regarding delays in delivery came as a surprise, as the absence of any
earlier complaints led us to believe that goods supplied to your orders were reaching you
promptly.

It is our usual practice to deliver goods well in advance of the promised delivery dates, and
the filing cabinets to which you refer left here on 5 July. We are very concerned that our
efforts to give punctual delivery should be frustrated by delays in transit. It is very possible
that other customers are also affected, and we are taking up this whole question with our
carriers.

We thank you for drawing our attention to a situation of which we had been quite unaware
until you wrote to us. Please accept our apologies for the inconvenience you have been
caused.

Yours sincerely

Letter 2: Complaint of shortage, damage:

Dear Sirs

We are writing to inform that your last delivery does not match our order No. 2315TL dated
which arrived at our port on June 25, 20

According to the survey report No. issued by SGS, the shipment contains only 136 units.
To be specific, the status of goods is as follows:

each, numbered from 08 to 15, making a total of 14 units.

Letter 3: Complain about missing information of ETA:
Dear Ms.

We are writing to you with reference to the contract No. TL. in which we would like to
purchase a new concrete pump B3500 HDR - 20 at the cost of $200,000, which is to be
delivered at the latest April 15, 20 at Saigon port.

Today, it is May 7, 20 when we havent received any advice from you concerning the
machine mentioned in the contract above.
In negotiating contracts as well as previous correspondence about purchasing this machine,
we did make it clear that this was a machine that we entrust a construction company in HCM
City for their repair and expansion of a maternity hospital in Hoc Mon district. This project
was planned to start in the early May 20 Without this machine, it would be impossible for
them to carry out the construction.

Another separate contract between us also clearly specifies that we will rent a machine to
ensure their construction schedule if delayed delivery occurred. Thus, on April 29, 20 we
had to lease a concrete pump from another business at the cost of $200 a day for two weeks,
leading to the damages in this case up to 2400 dollars.

The two contracts mentioned above are being enclosed below, requiring an advanced
compensation credited into our account at Vietcombank, HCM City.

Could you let us known as soon as possible when the shipment will arrive at the port of
Saigon.

Due to the delayed delivery referred to above, a deduction will be implemented to the
contract price on a pro rata basis (phn chia theo t l) of actual delivery lateness/tardiness.
However, if the cargo does not reach Vietnam before May 30, 2016, pursuant (chiu theo) to
the terms termination of contract due to delayed delivery mutually made and signed in the
contract, we have no better alternative than cancelling the contract and a refund of upfront
must be reimbursed together with all other costs and expenses incurred.

We would like to receive your earliest responses as we ourselves never expect such a
situation to occur, which has negative affects on our long term business relationship.

Yours faithfully,

Letter 4: Complain about gas cookers and request payment return
Dear Mr. Suzuki

I am writing to you to complain about the shipment of gas cookers (3000 typed ZM 304 and
2000 ZM 340) under the order No. TTN/012, carried by Orient, arrived at Saigon yesterday.

However, on the customs clearance at the port, it has been found that only 1500 sets of gas
stoves ZM 340 was delivered, short of 500 units. Out of 3000 gas stoves ZM 304 received,
200 sets have badly damaged beyond our repair. This case is found and recorded by
Vinacontrol. According to the Survey Report No. , the main cause of the short and
damaged goods came from the negligence (s cu th) of the Seller in loading the goods at
the warehouse.

Please examine the matter and settle the trouble without delay. Moreover, it is urgent that
amount of $120,000 must be credited to our account by telex through Foreign Trade Bank,
Vietnam as soon as possible, but not later than , as compensation for the short and
damaged goods.

We look forward to your earliest reply.

Letter 5: Complaint of white cement and ask for compensation without replacement
Dear

I received a consignment of white cement under the order No. 777 yesterday, May 27, 20
However, in the inspection of the goods, it was discovered that 70 bags were opened with
estimated 700 kg loss without being restored to the original purpose. The cause of the
damage was concluded to originate from below standard packaging.

We are to be compensated for the lost goods and the inspection costs and expenses incurred
without accepting any replacement.

We are looking forward to your early response to this case.
