APPLICATION: Reinstatement of proceedings; termination

In a decision dated February 4, 2013, this Board ordered the proceedings administratively

closed. The respondent moves to reopen proceedings to allow the respondent an opportunity to

pursue adjustment of status before DHS, Citizenship and Immigration Services (CIS). The

Department of Homeland Security (DHS) has not opposed the motion. Thus, it will be deemed

unopposed. 8 C.F.R. 1003.2(g)(3). Considering the circumstances presented, the unopposed

motion will be granted.

ORDER: The motion is granted, the Board's February 4, 2013, order is vacated, and these

proceedings are reinstated and terminated without prejudice.
