Threatened and Endangered Species,
Criterion A Can Not Be Used in
Culebra

For those of you conducting construction or industrial storm water


inspections in Culebra, based on this email from the Fish and Wildlife
Service, Boqueron Field Office, Facilities in Culebra Puerto Rico
submitting Notices of Intent claiming that there are "No federally
listed threatened or endangered species or their designated critical
habitat in the project area" under Criterion A, are unacceptable because

the waters around Culebra are listed as critical habitat.

Murray, a letter should be going out next week. We had provided a


consultant for the project with technical assistance regarding T&E
species
back in 2005. There are none reported for the project area. We did
express concern with erosion and sedimentation affecting the waters
around
Crash Boat and had our doubts about the sedimentation pond they were
proposing.

Also we are a bit concerned with the NPDES general permit, for Culebra
Is.
there should not be any Criterion A compliance since the waters around
Culebra are designated Critical Habitat by NOAA. Also NOAA is in the
process of working with its endangered coral listing, once the areas of
high concentration are designated, then Criterion A would not apply to
them
either.

I am writing a letter to F&R Construction for Storm Water Pollution


Prevention Plan deficiencies. The project is near Crashboat beach, but
up the hill a little bit. I wanted to know if there could be some
problems with turtle nesting, etc. in the area.
