BRIEF STATEMENT OF SUBJECT MATTER, ACTION TAKEN AND RELEVANT


INFORMATION GATHERED:

After a series of Committee Meetings since receipt of a communication from the Office
of the City Mayor Richard I. Gomez addressed to the Vice Mayor Leo Carmelo L. Locsin, Jr,
City Vice Mayor & Presiding Officer of the 14th Sangguniang Panlungsod ng Ormoc dated
August 17, 2016 requesting for the enactment of an ordinance establishing an Ormoc City North
Transport Terminal, imposing fees, prescribing routes and providing penalties therefor; a Public
Hearing was called by the Chairman of the Committee on Laws and Ordinances, SP Member
Benjamin S. Pongos, Jr., and the Chairman of the Committee on Transportation and
Communication, SP Member Rolando M. Villasencio, relative to the proposed Ordinance
entitled: AN ORDINANCE ESTABLISHING THE ORMOC CITY NORTH TRANSPORT
TERMINAL AND IMPOSING FEES, PRESCRIBING ROUTES, AND PROVIDING
PENALTIES THEREFOR, AND FOR OTHER PURPOSES.

During the series of Committee Meetings, the Committees on Laws & Ordinances and
Transportation & Communication discussed the Ordinance draft furnished by Robinsons
Corporation. Robinsons Corporation stressed that Dumaguete City is also using a transport
terminal constructed by Robinsons and that they have enacted an Ordinance which is tailored fit
to their City. It was discussed and agreed upon by the Body that the Departure Fees be increased
from the existing rates since this has been long overdue.

In the Public Hearing, SP Member Pongos explained to the body and to the guests that
said hearing was conducted for the purpose of complying with the requirement of the law that
whenever the Sangguniang Panlungsod enacts an ordinance that intends to increase revenues
such as fees and charges, a public hearing must be conducted, and in said public hearing the
stakeholders must be notified duly and must be accorded sufficient or adequate opportunity to air
out their comments, feedbacks or whatever inputs that they would like to share with the
Sangguniang Panlungsod with regards to the proposed ordinance. He then further explained a
brief background of the proposed ordinance wherein it aims to impose changes in the terminal
fee and departure fee charges and that the concept of such terminal is that the area and building is
owned by Robinsons Corporation and that it will be operated by the City Government.

SP Member Pongos then explained that the proposed increase in departure fees in the said
ordinance is timely since the basis of the existing rates would be Tax Ordinance 2000-01, hence
the need to update said fees.

After an inquiry on the assignment of bays and the proposed increase in departure fees
for Multicabs, SP Member Pongos explained that the Terminal Management will be given the
discretion and responsibility to decide on such matters. It was also agreed that a provision be
added regarding the unloading of cargo in the City but no picking up of passengers.

Comments were raised about the departure time interval wherein SP Member Pongos
explained that the Terminal Management Office shall be given the authority and discretion to
adjust, as the need arises, and prescribe another set of departure time intervals to adjust to the
demand of commuters and practicability for operators in the said Terminal.

FINDINGS AND CONCLUSIONS:

The Committees, after careful and thorough review of the proposed ordinance, finds it
desirable and necessary to enact the same as to address the needs of the commuting public and at
the same time, address the need to regulate public utility vehicles in the City to aid in traffic
decongestion. Hence, the Committees find no objection or opposition to the approval of the said
Ordinance, and in fact, manifests its prompt and full support of the same.

RECOMMENDATION:

It is recommended that after the necessary revisions and corrections made during the said Public
Hearing, the corresponding Ordinance be passed establishing an Ormoc City North Transport
Terminal, imposing fees, prescribing routes and providing penalties therefor.
