AFFIDAVIT

I, RACHEL GUMABAY PINGAD, of legal age, married, Filipino and a resident of

Atulu, Iguig, Cagayan, after having been duly sworn to in accordance with law, hereby
depose and state that:

1. In the early morning of June 13, 2017, my husband Miguel Pingad, Jr., (also
known as Bong for brevity), left our house together with our second child, Kiel
Ian G. Pingad (Kiel for brevity), a grade 6 pupil of Malabbac Elementary School
to bring him first there before fetching me at our residence and subsequently to
attend his duties as a Traffic Enforcer;

2. I waited for Bong inside our house, but I was surprised when I saw my son Kiel
running towards our house crying;

3. I asked Kiel why he is crying and even asked him if he is in trouble. However, he
told me that: Mommy mommy wag na tayong papasok kasi si Daddy hinuli. I
asked further what would be the reason why he was caught and he told me: Si
Daddy may baril daw kahit wala;

4. Kiel further told me that after Bong was able to place the railings (street signage)
on the street, several armed men arrived and immediately apprehended and
handcuffed Bong for no apparent reason;

5. I was shocked when I heard what he told me. I immediately proceeded to the
Iguig Police Station at around 7:30 in the morning to check on my husband;

6. Upon arrival at the Police Station, I was able to talked to him and ask him if the
allegations thrown against him were true, Bong denied the allegations and he
told me that he do not know what could be the reason why he was apprehended;

7. They brought him to the PNP Regional Office particularly at the PNP Crime
Laboratory for the alleged conduct of drug testing and for other procedure;

8. Before Bong left our house, I was with my husband inside our room when he
changed his clothes and there was nothing he brought with him aside from the
money that shall be used for purchasing our lunch. He was with his uniform when
he left our house;

9. He never had in his possession a gun or any contraband that would possibly
make him criminally liable;

10. I am executing this affidavit to attest to the truth of the foregoing and for whatever
legal purpose it may serve.
