PUBLICTRANSPORTSERVICEACT

AnActtoprovidefortheestablishmentofaPublicTransportServicetooperate
roadandrailtransportfacilitieswithaviewtopromotingthedevelopmentof
roadtransportandtofacilitatingthephasedsubstitutionofroadtransportfor
theexistingrailwaysystem.

PRELIMINARY
2. InthisAct
Chairmanmeansamemberappointedassuchundersection3;
CorporationmeansthePublicTransportServiceCorporationestablishedbysection3;
ViceChairmanmeansthememberappointedassuchundersection3;
existingrailwaysystemmeanstherailway(withinthemeaningofsection2ofthe
RailwaysOrdinance)thepropertyoftheState;
membermeansadulyappointedmemberoftheCorporation;
MinistermeanstheMinisterresponsibleforPublicUtilities;
publicservicevehiclehasthemeaningassignedtoitinsection2oftheMotorVehicles
andRoadTrafficAct;
SecretarymeansthesecretaryoftheCorporation;
StandingOrdersmeansStandingOrdersmadebytheCorporationundersection5(7).

PARTI

ESTABLISHMENTOFCORPORATION
3. (1) ACorporationisherebyestablishedforthepurposesofthisAct,andisa
bodycorporate.
(2) The Corporation shall consist of no fewer than five nor more than nine
members appointed by the President. Of the members, four shall be appointed from
personswhohavespecialqualificationsin,andhavehadexperienceof,mattersrelating
toengineering,accountancy,law,economicsorbusinessmanagement.
(3) ThePresidentshallappointaChairmanandaViceChairmanfromamongst
themembersoftheCorporation.
(4) TheChairmanandmembersoftheCorporationshall,subjecttosubsection
(6),beforsuchperiodasmaybespecifiedintheinstrumentofappointment.
(5) Amembermayatanytimeresignhisofficebynoticeinwritingaddressedto
theChairman,whoshallforthwithcauseittobeforwardedtotheMinister.
(6) Theappointmentofanypersonasamemberandtheterminationofofficeof
any person as such whether by death, resignation, revocation, effluxion of time or
otherwiseshallbenotifiedintheGazette.
(7) Ifamemberisunabletoperformthefunctionsofhisofficeowingtoabsence
fromTrinidadandTobagoortoinabilityforanyreason,thePresidentmayappointsome
otherpersontoactasatemporarymemberduringthetimesuchabsenceorinability
continues.

4. (1) The seal of the Corporation shall be kept in the custody either of the
ChairmanortheViceChairmanoroftheSecretaryastheCorporationmaydetermine
andmaybeaffixedtoinstrumentspursuanttoStandingOrdersortoaresolutionofthe
CorporationandinthepresenceoftheChairmanortheViceChairman,ofoneother
member,andoftheSecretary.
(2) The seal of the Corporation shall be attested by the signature of the
ChairmanortheViceChairman,andtheSecretary.
(3) Alldocuments,otherthanthoserequiredbylawtobeundersealmadeby,
andalldecisionsof,theCorporationmaybesignifiedunderthehandoftheChairman,
theViceChairmanortheSecretary.
(4) ServiceupontheCorporationofanynotice,orderorotherdocumentshallbe
executed bydeliveringthesameorbysendingitbyregisteredpostaddressedtothe
SecretaryattheofficeoftheCorporation.

PROCEDURE
5. (1) TheCorporationshallmeetatsuchtimesasmaybenecessaryorexpedient
forthetransactionofbusiness,andsuchmeetingsshallbeheldatsuchplaceandtime
andonsuchdaysastheCorporationdetermines.
(2) TheChairmanmayatanytimecallaspecialmeetingoftheCorporationand
shallcall aspecial meeting withinsevendaysofthereceipt ofarequisition forthat
purposeaddressedtohimbyanythreemembers.
(3) TheChairman,orinhisabsencetheViceChairman,andtwoothermembers
shallformaquorum.
(4) MinutesinproperformofeachmeetingshallbekeptbytheSecretaryand
shallbeconfirmed bytheChairman ortheViceChairman, atasubsequentmeeting.
Certified copies of such minutes when so confirmed shall, within twentyone days
thereof,beforwardedtotheMinister.
(5) TheGeneralManagershall,unlesstheMinisterotherwisedirects,attendall
meetingsoftheCorporationbutheshallnothaveanyrighttovote.
(6) TheCorporationmaycooptanyoneormorepersonstoattendanyparticular
meetingoftheCorporationforthepurposeofassistingoradvisingtheCorporation,but
nosuchcooptedpersonshallhaveanyrighttovote.
(7) Subjecttothissection,theCorporationmaybyStandingOrdersregulateits
ownproceedings.

6. (1) TheCorporationmayappointcommitteestoexamineandreporttoitonany
matterwhatsoeverarisingoutoforconnectedwithanyofitspowersanddutiesunder
thisAct.
(2) A committee appointed by the Corporation shall consist of at least one
memberoftheCorporationtogetherwithsuchotherpersons,whethermembersofthe
Corporation,ornot,whoseassistanceoradvicetheCorporationmaydesire.
(3) Wherepersons,notbeingmembersoftheCorporation,aremembersofa
committeeappointedunderthissectionorwherepersonsarecooptedundersection5(6),
the Corporation may, with the approval of the Minister, by resolution declare the
remunerationandallowancesofsuchpersons,andsuchsumsshallproperlybesopayable
outofthefundsandresourcesoftheCorporation.
(4) TheCorporationmaybyresolutionrejectthereportofanysuchcommittee
or adopt it either wholly or with such modification, additions or adaptations as the
Corporationmaythinkfit.

7. SubjecttothisAct,andtothepriorapprovaloftheMinister,theCorporation
maydelegatetoamemberoracommittee,powerandauthoritytocarryoutonitsbehalf
suchdutiesandfunctionsandtoexercisesuchpowersastheCorporationmaydetermine,
sohoweverthatanysuchdelegationshallberevocableatwillandshallnotprecludethe
Corporationfromactingfromtimetotimeasoccasionrequires.

GENERALPOWERSANDDUTIES
OFTHECORPORATION
8. (1) SubjecttothisAct,itshallbethedutyoftheCorporationtocarryonthe
businessofoperatingpublicservicevehiclesunderthisAct,soastoensuretheprovision
ofasafe,adequate,economicandefficientpublictransportationsystem,adaptedtothe
needsofthecountry;andforsuchpurposetheCorporationshallhaveandexercisesuch
functions,powers andduties as areconferredandimposedonitbythis Act,andin
particular,theCorporationshallhavepower
(a) tocarrygoodsandpassengersbyrailandroad;
(b) tostoregoods;
(c) toconsigngoodsonbehalfofotherpersonsfromanyplaceinTrinidad
andTobagotoanyotherplacetherein;
(d) toprovidesuchamenitiesandfacilitiesforpassengersandotherpersons
makinguseoftheservicesprovidedbyitasappearstoitrequisiteor
expedienttoprovide.
(2) The duty imposed on the Corporation by subsection (1) includes
responsibilityforestablishingsufficientroadtransportfacilitiesasintheopinionofthe
Corporationarenecessaryordesirableforthepurposeofprovidingtransportationfor
schoolchildrenandforpersonsrequiringpublictransportforrecreationalpurposesand
forsupplyingsuchinstitutionalneedsasmayberequired.
(3) Subject to this Act, the powers conferred by subsection (1) are to the
exclusionofanyright,powerorauthorityinanyotherpersonorauthorityandinclude
powertodoallthings,whichintheopinionoftheCorporationarenecessaryorexpedient
tofacilitate thepropercarryingonofthebusinessoftheCorporationunderthesaid
subsection(1),andinparticular
(a) to construct, manufacture, purchase, maintain and repair anything
requiredforthepurposeofanyoftheactivitiesoftheCorporation;
(b) toholdinquiriesandconductstudiesrespectingeconomyandefficiency
inthetransportservice.
(4) Nothinginsubsection(3)shallapplytothecarryingofpassengersbyroadin
ahiringcar(withinthemeaningoftheMotorVehiclesandRoadTrafficAct)adaptedto
carrylessthansixpassengersandusedforplyingorstandingforhireinastreet,ortothe
carriageofgoodsbyanyotherpersonforhireorrewardorotherwise,buttheCorporation
may,inits discretion,authoriseanypersontooperatepublicservicevehicles ofany
specialclassordescriptionuponsuchtermsandconditions,includingpaymentofany
suchfeethereforasmaybeprescribed,inanyareaordistrictwheretheCorporationon
economicoranyothergroundsdoesnotconsideritsuitableorexpedienttooperateits
ownservice.
(5) Anypersonwhocontravenesorfailstocomplywiththeprovisionsofthis
sectionorwiththerequirementsofanytermsorconditionsunderwhichheisauthorised
tooperatepublicservicevehiclesundersubsection(4),isliableonsummaryconviction
toafineofsevenhundredandfiftydollarsortoimprisonmentforthreemonthsandin
thecaseofacontinuingoffencetoafurtherfineofonehundredandfiftydollarsorto
imprisonmentforthreemonthsforeachdayonwhichtheoffencecontinuesafterconvic
tiontherefor.

9. Intheexerciseofitsfunctions,powersanddutiesunderthisActoranyother
writtenlaw,theCorporationshallactinaccordancewithanyspecialorgeneraldirection
giventoitbytheMinister.

VESTINGOFPROPERTYINTHECORPORATION
10. (1) Subjecttotheprovisionsofsubsection(2),thefollowingprovisionsofthis
subsectionshallhaveeffectasfrom7thMay1965:
(a) all land and other property of every kind including things in action,
vestedimmediatelybeforethecommencementofthisPartintheStateor
intheRailwayBoardunderanywrittenlaworbyanyotherrightortitle
relatingto
(i) railways;
(ii) road transportation service for the carriage of passengers,
includingthepropertyvestedintheGovernmentundertheMotor
OmnibusConcessions(AcquisitionofUndertakings)Act1964,
arevestedintheCorporation;
(b) all the rights, privileges and advantages, and all the liabilities and
obligations relating to the matters referred to in paragraph (a) that,
immediatelybeforethecommencementofthisPart,theGovernmentor
the Railway Board were entitled or subject to, are transferred and
conferredorimposedupontheCorporationforthepurposesofthisAct;
(c) areferenceinanydeed,contract,bondorsecurityorotherdocumentto
theGovernmentortotheRailwayBoardinrelationtoitsrights,titles
andobligationsconcerninganyofthemattersreferredtoinparagraph
(a)or(b)shallbeconstruedasareferencetotheCorporation;
(d) legal proceedings pending immediately before 7th May 1965 the
commencementofthisPartbyoragainsttheGovernmentortheRailway
Boardinrelationtothemattersmentionedinparagraph(a)or(b),may
becontinuedonorafter7thMay1965byoragainsttheCorporationas
thepartytotheproceedingsinsteadoftheGovernmentortheRailway
Board,asthecasemaybe;
(e) in this subsection, Railway Board means the statutory authority in
whomthemanagementandcontrolofthethenexistingrailwaysystem
wasvestedpriorto7thMay1965.
(2) Asfrom24thDecember1974[thatis,thedateofcommencementofthe
PublicTransportService(RevestingofProperty)Act1974]
(a) all the land, other than the several parcels of land described in the
Schedule, that was vested by subsection (1) in the Corporation are
revestedintheState;
(b) all the rights, privileges and advantages and all the liabilities and
obligationsinrelationtothelandtowhichparagraph (a) applies,that
immediatelybefore24thDecember1974theCorporationwasentitledor
subjectto,aretransferredtoandconferredorimposedupontheStatefor
thepurposesofthisAct;
(c) areferenceinanydeed,contract,bondorsecurityorotherdocumentto
theCorporation,inrelationtoitsrights,titlesandobligationsconcerning
thelandtowhichparagraph(a)applies,shall,onorafter24thDecember
1974,beconstruedasareferencetotheState.

MISCELLANEOUS
11. The Corporation shall, subject to the approval of the Minister pay to each
member in respect of his office such remuneration and allowances, if any, as the
Corporation thinks fit, and, subject to the like approval, to the Chairman and Vice
Chairmaninrespectofhisoffice,suchremunerationandallowances,ifany,inaddition
toanyremunerationorallowancestowhichhemaybeentitledinrespectofhisofficeas
amember,assubjecttothelikeapproval,maybesodetermined.

12. (1) Amemberwhoisinanyway,whetherdirectlyorindirectlyinterestedina


contractorproposedcontractwiththeCorporation,shalldeclarethenatureofhisinterest
atthefirstmeetingoftheCorporationatwhichitispracticableforhimtodoso.
(2) A member shall not take part in any deliberation or decision of the
CorporationwithrespecttoanycontractorproposedcontractwiththeCorporationin
whichheisinanywayinterested,whetherdirectlyorindirectly.
(3) Thissectionshallnotapplyto
(a) aninterestinacontractorothermatterwhichamembermayhaveas
oneofagroupofpersonsmakinguseofanyroadtransportfacilities
providedoncharterbytheCorporation;or
(b) toaninterestinanymatterrelatingtothetermsonwhichtherightto
participateinanyserviceprovidedbytheCorporationisofferedtothe
public.
(4) Forthepurposesofthissection,aperson
(a) who,oranynomineeofwhom,isashareholderorpartnerinacompany
orotherbodyofpersons(otherthanastatutoryauthority);or
(b) whoisanemployeethereof,
shallbetreatedashavingindirectlyapecuniaryinterestinacontractorothermatter,if
such company or such other body of persons is a party to the contract or proposed
contractorhasapecuniaryinterestinsuchothermatterunderconsideration.
(5) Nothinginsubsection(4)shallapplytoanypersonwho,butforthesaid
subsection(4),wouldnotfalltobetreatedashavingindirectlyapecuniaryinterestina
contractorothermatter,ifthetotalvalueofhisshareholdingorotherinterestdoesnot
exceedsuchamountofthetotalnominalvalueoftheissuedsharecapitalofthecompany
orbodyastheStandingOrdersoftheCorporationprovides.
(6) Apersonwhofailstocomplywiththeprovisionsofthissectionisliableon
summaryconvictiontoafineofsevenhundredandfiftydollarsunlessheprovesthathe
did not know that a contract, proposed contract or other matter in which he had a
pecuniaryinterestwasthesubjectofconsiderationatthemeeting.

13. (1) AnydocumentrequiringtobeexecutedbytheCorporationshallbedeemed


tobedulyexecuted
(a) if signed by the Chairman or the ViceChairman and the General
ManagerortheSecretary;or
(b) ifsigned,whetherwithinorwithoutTrinidadandTobagobyapersonor
personsauthorisedbyresolutionoftheCorporationsotosign;butsuch
anextractoftheresolutioncertifiedbytheChairmanorViceChairman
andtheSecretaryshallbeattachedtoandformpartofthedocument.
(2) Anycheque,billofexchangeororderforthepaymentofmoneyrequiringto
beexecutedbytheCorporationshallbedeemedtobedulyexecutedifsignedbyaperson
orpersonsauthorisedbythisActorbyresolutionoftheCorporation.

14. TheCorporationshallmakeanannualreportofitsproceedingstotheMinister
whichshallbelaidbeforeParliament.

PARTII

*ADMINISTRATION
PERSONNEL

15. (1) TheCorporationmayappointonsuchtermsandconditionsasitthinksfit,a


GeneralManagerandsuchotherofficersandstaffforthepurposeofmanagingitsrail
androadtransportationservicesrespectively,andsuchotherofficersandemployeesas
maybenecessaryandproperforthedueandefficientadministration,managementand
performancebytheCorporationofitsdutiesunderthisAct.
(2) Anannualsalaryinasumthatisequivalenttoorexceedstheannualsalary
of nine thousand six hundred dollars or such greater amount as the Minister may
prescribeshallnotbeassignedtoanypostunderthissectionwithoutthepriorapprovalof
theMinister.
(3) TheGeneralManageristhechiefexecutiveofficeroftheCorporationandis
responsible for the carrying out of the decisions of the Corporation; and in the
performanceofhisdutiesissubjecttothecontroloftheCorporation.

16. (1) Anofficerinthepublicservicemay,withtheapprovaloftheMinister,be


transferred tothe service ofthe Corporation, andupon suchtransfer shall become a
memberofthePensionSchemereferredtoinsection18,and,ifsuchofficerstransfer
becomeseffectivebeforetheestablishmentofthatScheme,heshallbecomeamember
withinoneyearofitsestablishment.
(2) Atransferdescribed insubsection (1)shallbeonsuchterms asmaybe
acceptabletothePresident,theCorporationandtheofficerconcernedandthepensionor
superannuationrightsaccruingtotheofficeratthetimeofhistransfershallbepreserved.

17. (1) Subjecttosubsection(2),anyofficerinthepublicservicemay,withthe


approvaloftheMinister,betransferredonsecondmenttotheserviceoftheCorporation
orfromtheserviceoftheCorporationtothepublicservice.
(2) Whereatransferonsecondmentcontemplatedbysubsection(1)iseffected,
thePresidentortheCorporation,asthecasemayrequire,shallmakesucharrangements
asmaybenecessarytopreservetherightsoftheofficersotransferredtoanypension,
gratuityorotherallowanceforwhichhewouldhavebeeneligiblehadheremainedinthe
serviceoftheGovernmentoroftheCorporation,asthecasemaybe.
(3) Aperiodoftransferonsecondmentshallnotinanycaseexceedthreeyears.

18. TheCorporationshallwithinaperiodofthreeyearsofitsestablishment,byrules
confirmedbytheMinister,providefortheestablishmentandmaintenanceofaPension
Scheme or Provident Fund for the benefit of the officers and employees of the
Corporation.

19. Without prejudice to the generality of section 18, the Pension Scheme may
enabletheCorporationto
(a) grant gratuities, pensions or superannuation allowances to, or to the
widows,familiesordependantsof,itsemployees;
(b) establish contributory and superannuation schemes, and establish and
contributetosuperannuationfundsforthebenefitofitsemployees;
(c) enterintoandcarryintoeffectagreementswithanyinsurancecompany
or other association or company for securing to any such employee,
widow,familyordependantsuchgratuities,pensionsorallowancesas
arebythissectionauthorisedtobegranted;
(d) give donations or subscriptions to charitable institutions, sick funds,
benevolentfundsandotherobjectscalculatedtobenefititsemployees.

20. PrescribedpublicofficersandotheremployeesoftheGovernmentinconnection
withtheexistingrailwayorwiththeroadtransportationservicereferredtoinsection10
shall,wheresuchpublicofficersoremployeesarenoteligibleforanincreaseofpension
underregulation11ofthePensionsRegulations1938,bepaidbytheGovernmentsuch
compensationforlossofofficeoremploymentasmaybeprescribed,if
(a) suchemployeesarenotemployedbytheCorporationorwithsuchother
personsorauthorityprescribedbythePresidentwithinthreemonthsof
thecommencementofthissection;or
(b) inthecaseofpublicofficers,donotcontinuetobepublicofficers.

21. (1) All officers charged with the receipt, accounting for, or disbursement of
moneys orwiththecustodyordeliveryofstores,orotherpropertybelongingtothe
Corporationshallbeindividuallyresponsibleforthedueandefficientdischargeoftheir
respective duties, and for the exercise of proper supervision of the accounts kept or
controlledbythemandofallpropertyentrustedtotheircare,andforthedueobservance
of all rules and regulations, and of all orders and instructions prescribed for their
guidance.
(2) TheCorporationmayrequireanyofficerorservantinitsservicetogive
securitytoitssatisfactionforthedueexecutionofhisduties.

FINANCIALPROVISIONS
22. (1) TheCorporationshallsoexerciseandperformitsfunctionsastoensurethat
itsrevenuesaresufficientto
(a) cover operating expenses, including taxes, if any, and to provide
adequate maintenance and depreciation, and interest payments on
borrowings;
(b) meetperiodicrepaymentonlongtermindebtednesstotheextentthat
anysuchrepaymentexceedstheprovisionsfordepreciation;
(c) createreservesforthepurposeoffuturedevelopment,
andthesumsrequiredforanyofthepurposesoftheCorporationshallbemetoutofthe
fundsandresourcesoftheCorporation.
(2) Subject to subsection (1), the Corporation may in such manner as is
consideredappropriate,butsubjecttotheapprovaloftheMinisterofFinanceborrow
sums required by it for meeting any of its obligations and discharging any of its
functions.

23. ThefundsandresourcesoftheCorporationshallconsistof
(a) suchamountsasmaybeprovidedbyParliament;
(b) allsumsfromtimetotimereceivedbyorfallingduetotheCorporation
inrespectofitsoperations;
(c) sumsborrowedbytheCorporationforthepurposeofmeetinganyofits
obligationsordischarginganyofitsfunctions;and
(d) allothersumsorpropertythatmayinanymannerbecomepayabletoor
vested in the Corporation in respect of any matter incidental to its
powersandduties.

24. (1) TheTreasurymayguaranteeinsuchmannerandonsuchconditionsasit


thinksfitthepaymentoftheprincipalandinterestinrespectofanyborrowingofthe
Corporationundersection22(2).
(2) WheretheMinisterofFinanceissatisfiedthattherehasbeendefaultinthe
repaymentofanyprincipalmoneysorinterestguaranteedunderthissection,heshall
directtherepaymentoutofthegeneralassetsandrevenueofTrinidadandTobagoofthe
amountinrespectofwhichtherehasbeensuchdefault.
(3) TheCorporationshallmaketotheTreasury,atsuchtimeandinsuchmanner
astheMinisterofFinancemaydirect,paymentsofsuchamountsasmaybesodirectedin
ortowardsrepaymentofanysumsissuedinfulfilmentofanyguaranteegivenunderthis
section,andpaymentsofinterestonwhatisoutstandingforthetimebeinginrespectof
anysumssoissuedatsuchratesastheMinisterofFinancemaydirect,anddifferentrates
ofinterestmaybedirectedasregardsdifferentsumsandasregardsinterestfordifferent
periods.

25. (1) TherevenueoftheCorporationforanyfinancialyearshallbeappliedin


defrayingthefollowingcharges:
(a) the remuneration, fees and allowances of the members or of any
committeeoftheCorporation;
(b) thesalaries,fees,remunerationandgratuities(includingpaymentsfor
the maintenance of the Pension Fund authorised by this Act) of the
officers, agents and servants, andtechnical and other advisers of the
Corporation;
(c) workingoperationsandestablishmentexpensesandexpenditureon,or
provisionfor,themaintenanceofthepropertyoftheCorporation,and
the insurance of the same and the discharge of the functions of the
Corporationproperlychargeabletorevenueaccount;
(d) interestonanydebentureordebenturestockorothersecurityissuedor
onanyloanraisedbytheCorporation;
(e) sumsrequiredtobetransferredtoasinkingfundorotherwisesetaside
forthepurposeofmakingprovisionfortheredemptionofdebenturesor
debenture stock or other security or the payment of other borrowed
money;
(f) suchsumsasitmaybedeemedappropriatetosetasideinrespectof
depreciation onthe property of the Corporation having regard tothe
amountsetasideoutoftherevenueunderparagraph(e);
(g) any other expenditure authorised by the Corporation and properly
chargeabletorevenueaccount.
(2) ThebalanceoftherevenueoftheCorporationshallbeappliedtothecreation
ofreservefundstofinancefuturedevelopment.

26. FundsoftheCorporationnotimmediatelyrequiredtobeexpendedinthemeeting
ofanyobligationsorthedischargeofanyfunctionsoftheCorporationmaybeinvested
fromtimetotimeinsecuritiesapprovedbytheMinisterofFinanceforinvestmentbythe
Corporation.

27. (1) ThefaresandotherchargestobechargedbytheCorporationforthecarriage


ofpassengersandgoodsandotherservicesshallbeinaccordancewithsuchfaresand
chargesasmay,fromtimetotime,befixedbyorunderthisActoranyotherenactment.
(2) Subsection(1)doesnotpreventtheCorporationfromchargingotherfares
andchargesbyspecialagreementunderthisAct.

28. (1) All decisions, orders, rules and regulations relating to the financial
operationsoftheCorporationandauthorisedbythisActshallbemadebyresolutionof
the Corporation at a meeting thereof and shall be recorded in the minutes of the
Corporation.
(2) TheaccountsoftheCorporationshallbeauditedbytheAuditorGeneral.
(3) AftertheendofeachfinancialyearoftheCorporation,theCorporationshall,
as soon as the accounts of the Corporation have been audited, cause a copy of the
statementofaccounttobetransmittedtotheMinisterofFinance,togetherwithacopyof
anyreportmadebytheAuditorGeneralonthatstatement orontheaccounts ofthe
Corporation.
(4) The MinisterofFinance shall causea copyofeverysuchstatement and
reporttobelaidbeforeParliament.

29. (1) AllmoneysoftheCorporationaccruingfromitsoperationsunderthisAct


shallbepaidintotheprescribedbank,andsuchmoneysshall,asfaraspracticable,be
paidintothebankfromdaytoday,exceptsuchsumsastheaccountsofficerofthe
CorporationmaybeauthorisedbyrulesoftheCorporationtoretaininhishandstomeet
pettydisbursementsforimmediatepayments.
(2) AllpaymentsoutofthefundsoftheCorporationexceptpettydisbursements
notexceedingsuchsumstobefixedbytherules,shallbemadebytheaccountsofficer,
oronhisbehalfbyanyotherofficerappointedbytheCorporation,inaccordancewiththe
rules.
(3) Cheques againstanybankingaccount requiredtobekeptorwithdrawals
fromanysavingsbankaccountandbillsofexchangeorordersforpaymentofmoney
shallbesignedbytheaccountsofficeroronhisbehalfbyanofficerappointedbythe
CorporationandcountersignedbytheChairmanoftheCorporationoranymemberofthe
CorporationoranyofficeroftheCorporationappointedbyresolutionoftheCorporation
forthepurpose;andacopyofanysuchresolutionshallbecertifiedbytheChairmanand
forwardedtothebankorbanksconcerned.

30. For the purpose of regulating and controlling its financial operations, the
CorporationmaywiththeapprovaloftheMinisterofFinancemakerulesinrespectof
thefollowingmatters:
(a) the manner in which and the officers by whom payments are to be
approved;
(b) thebankorbanksintowhichmoneysoftheCorporationaretobepaid,
thetitleofanyaccountwithanysuchbank,andthetransferoffunds
fromoneaccounttoanother;
(c) theappointmentofamemberoftheCorporationoranofficerofthe
CorporationtocountersignchequesonbehalfoftheChairmanorinthe
absenceoftheChairman;
(d) the sum to be retained by the accounts officer to meet petty
disbursementsandimmediatepaymentsandthemaximumsumthatmay
besodisbursedforanyonepayment;
(e) themethodtobeadoptedinmakingpaymentsoutofthefundsofthe
Corporation;and
(f) generallyastoallmattersnecessaryfortheproperkeepingandcontrol
ofthefinancesoftheCorporation.

PARTIII

RAILWAYS
31. (1) SubjecttothisActitshallbethedutyoftheCorporationtodispose,within
suchtimeasisreasonablypracticable,ofallsuchpropertyheldbyitforthepurposeofso
muchofitsundertakingrelatingtothecarriageofgoodsandpassengersbyrail,asthe
Ministermaydirect.
(2) Intheperformanceofitsdutiesundersubsection(1),theCorporationshall
have due regard to the needs of any industry or community with regard to railway
transport;andpendingthedisposalofthepropertymentionedinsubsection(1),itshallbe
thedutyoftheCorporationtocarryontheexistingrailwayserviceinsuchmanneras
appearstoittobeexpedientforthepurposesofenablingthesaidpropertytobedisposed
ofwithoutdelayandonthebesttermsavailableandwithoutavoidabledisturbanceofthe
transportsystemofthecountry.

32. (1) Forthepurposeofdisposingofthepropertyreferredtoinsection31(1),the


Corporationshallfromtimetotimebypublicnotice,invitetendersforthepurchase,on
specifiedconditions,of
(a) oneormorespecifiedrailwayengineandotherrollingstock;and
(b) suchotherproperty,asmaybespecified,
andthespecifiedconditionsmayincludeconditionswherebythepurchasertakesover
suchrightsandobligationsoftheCorporation,whetherundercontractorotherwiseas
maybespecified,beingrightsandobligationsconnectedwiththesubjectmatterofthe
purchase.
(2) Inthecaseofeachsuchinvitation,thepropertywhichistobethesubjectof
thepurchase,andtheconditionsofthepurchase,shallbesuchas,intheopinionofthe
Corporationiscalculatedtoresultintheminimum inconveniencetomembers ofthe
publicmakinguseoftheservicesprovidedbytheCorporation.
(3) Thepropertyforwhichpersonsareinvitedtotendershallbedeterminedwith
a view to securing that the property held by the Corporation for the purpose of the
existingrailwaysystemfetchesintheaggregatethebestpossibleprice.

33. (1) Where the Corporation disposes of any railway engines or rolling stock
under this Part and thereby reduces or discontinues its passenger traffic on some
particularpartofitsrailwaysystem,theCorporationshall,wheneveritisnecessaryto
meetthedemandforpassengertransportonsuchpartoftherailwaysystem,introducethe
requisiteroadtransportvehiclestomeetsuchdemand.
(2) Nothinginsubsection(1)shallbeconstruedasrequiringtheCorporationto
introduceanyroadtransportvehiclestomeetsuchdemandifthereisatanytimeafter
such reduction or discontinuance of its said passenger traffic a sufficient passenger
transportationservice,providedbywayofpublicservicevehiclestomeetsuchdemand.

34. (1) TheCorporationshall,withinthirtydaysofthedisposalofanypropertyof


whichtheCorporationisauthorisedtodisposebysection31(1),aswellasuponreceipt
ofthepurchasepriceoranyinstalmentthereof,submittotheMinisterofFinanceparticu
larsoftheconditionsonwhichthepropertywasdisposedof,aswellasastatementof
accountrespectingthepaymenttherefor,respectively.
(2) Theproceedsofthesaleordisposal(includingeveryinstalmentinrespectof
the property) less any expenses properly incurred and disbursed shall be paid, upon
submittingthestatementsofaccountsrequiredbysubsection(1),intotheConsolidated
Fund.

35. (1) SubjecttothissectiontheCorporationandahighwayauthoritymayagree


thatanypartoftheexistingrailwaysystembeinglandthepropertyoftheCorporation
may,uponsuchtermsasmaybeagreed,beusedforthepurposeoftheconstructionofa
publichighway.
(2) Whereitisproposedthatthehighwaywithrespecttotheconstructionof
whichtheCorporationandahighwayauthorityproposetomakeanagreementunderthis
sectionistocontinueintothedistrictofanotherhighwayauthority,theagreementshall
not be made without the consent of that other highway authority who may give its
consentuponsuchtermsasitthinksfit,savethatsuchahighwayauthorityshallnot
unreasonablyrefusetoenterintoanagreementforthepurposesofthissectionorinsist
unreasonably upon terms unacceptable to the other parties, and any question arising
underthissectionastowhetherornotsuchahighwayauthorityisactingunreasonably
shallbereferredtotheMinisterresponsibleforRoads,andtheMinistermayhimself
referthemattertothePresidentwhosedecisionshallbefinal.
(3) Inthissectionhighwayauthoritymeans,inthecaseofahighwayorpart
thereof that willbecomemaintainable at publicexpense,theChiefTechnical Officer
(Works),andinanyothercase,theauthorityorpersoninwhomthehighwaywillbecome
vestedorwhowillbecomeresponsibleforthemaintenancethereofor,ifnoauthorityor
personwill become responsible therefor, theowners ofthesoil ofthehighway,and
landincludesanyinterestorpartthereofinlandandanyeasementorrightin,toor
overland.
(4) Forthepurposesofsubsection(3),theexpressionhighwayorpartthereof
thatwillbecomemaintainableatpublicexpensemeansthatthehighwaywillbecomeso
maintainableattheexpenseofthepublicgenerallyandnotattheexpenseofaparticular
portionofthepublic,whethertheexpensewillbemetwhollyorpartlyoutofpublic
fundsorotherwise;andahighwayorpartthereofinanyothercaseshallbeheldto
continuesotobe,notwithstandingthattheexpenseofthemaintenancethereofwillbe
metwhollyorpartlyoutofpublicfundsorotherwise.

PARTIV

GENERALANDMISCELLANEOUS
36. (1) Subjecttosubsection(2)andtosection37,theCorporationmay,onthesale
of a ticket or the making of any contract, restrict or otherwise limit its liability for
negligenceoranyotherwrongfulactoromissionoritsliabilityforbreachofcontractin
anywaywhatsoeverarising.
(2) Notwithstandinganyruleoflawtothecontrary,butsubjecttosection37,in
anyproceedingsuponthesaleofaticketorthemakingofacontractwiththeCorporation
forthecarriageofpassengersorgoodsorofbothsuchpassengersandgoods,orforthe
storageorconsignmentofgoods,itshallbeheldtobesufficientnoticeofthetermsand
conditionsthereof,ifitisprovedthattheCorporation,beforethesaleoftheticketorthe
makingofthecontract
(a) published,inatleastonenewspapercirculatinginTrinidadandTobago,
noticeofthetermsandconditionsonwhichthesaleofticketsorother
contractswithitmaybemade;and
(b) affixedacopyofsuchnoticetoaconspicuousplaceatitsheadofficeor
onanyvehicleorplacewheretheticketwassoldorthecontractwas
made.

37. Acontractfortheconveyanceofpassengersinanypublicservicevehicleshall,
sofarasitpurportstonegativeorrestricttheliabilityofapersoninrespectofaclaim
whichmaybemadeagainsthiminrespectofthedeathorbodilyinjuryto,thepassenger
whilebeingcarriedin,enteringoralightingfromthevehicle,orpurportstoimposeany
conditionswithrespecttotheenforcementofanysuchliability,isvoid.

38. (1) Subjecttotheprovisionsofsections39to41,itshallnotbelawfulforthe


Corporationoranyotherpersontouse,orcauseorpermitanyotherpersontouse,a
motorvehicle, theproperty oftheCorporation, onaroadunless thereis inforcein
relationtotheuserofthevehiclebytheCorporationorthatpersonorthatotherperson,
asthecasemaybe,suchapolicyofinsuranceorsuchasecurityinrespectofthirdparty
risksascomplieswiththerequirementsofsections39to41.
(2) Anypersonwhoactsincontraventionofthissectionisliableonsummary
convictiontoafineofsevenhundredandfiftydollarsandtoimprisonmentforthree
months.
(3) Apersonchargedwithusingamotorvehicleincontraventionofthissection
shallnotbeconvictedifheprovesthathewasusingthevehicleinthecourseofhis
employmentandthatheneitherknewnorhadreasontobelievethattherewasnotin
forceinrelationtothevehiclesuchapolicyofinsuranceorsecurityasismentionedin
subsection(1).
(4) WheretheCorporationisconvictedofanoffenceagainstthissection,every
personwhoatthetimeofcommissionoftheoffencewasamemberorGeneralManager
orSecretaryoftheCorporationshallbedeemedtobeguiltyofthatoffenceunlesshe
provesthatheexercisedallduediligencetopreventthecommissionoftheoffence.

39. (1) Inordertocomplywiththerequirementsofthissectionandsection40,a


policyofinsurancemustsatisfythefollowingconditions.
(2) Thepolicymustbeissuedbyanauthorisedinsurer,thatistosay,apersonor
bodyofpersonscarryingonmotorvehicleinsurancebusinessinTrinidadandTobago.
(3) Thepolicy
(a) mustinsuretheCorporationinrespectofanyliabilitywhichmaybe
incurredbyitinrespectofthedeathoforbodilyinjurytoanyperson
causedby,orarisingoutof,theuseofthevehicleonaroad;
(b) mustalsoinsureitinrespectofanyliabilitywhichmaybeincurredbyit
undertheprovisionsofsection41relatingtopaymentforemergency
treatment;
(c) must cover liability in respect of the death of, or bodily injury to,
personsbeingcarriedinorupon,orenteringorgettingontooralighting
from,thevehicleatthetimeoftheoccurrenceoftheeventoutofwhich
theclaimsarise;and
(d) mustcoverliabilityinrespectofthedeath,arisingoutofandinthe
course of his employment, of a person in the employment of the
Corporationorofbodilyinjurysustainedbysuchapersonarisingoutof
andinthecourseofhisemployment.

40. (1) Inordertocomplywiththerequirementsofthissectionandsection39,a


securitymustsatisfythefollowingconditions.

(2) Thesecuritymustbegiveneitherbyanauthorisedinsurerorbysomebodyof
personswhichcarriesoninTrinidadandTobagothebusinessofgivingsecuritiesofa
like kind and has deposited and keeps deposited with the Treasury the sum of one
hundredthousanddollarsinrespectofthatbusiness.

(3) Thesecuritymustconsistofanundertakingbythegiverofthesecuritytomake
good,subjecttoanyconditionsspecifiedtherein,anduptotheamountofnotlessthan
twohundredandfiftythousanddollars,anyfailurebytheCorporationdulytodischarge
any liability which may be incurred by it, being a liability required under the last
foregoingsectiontobecoveredbyapolicyofassurance.

41. (1) Wheremedicalorsurgicaltreatmentorexaminationisimmediatelyrequired


asaresultofbodilyinjury(includingfatalinjury)toapersoncausedby,orarisingoutof,
theuseofamotorvehicle,thepropertyoftheCorporation,onaroad,andthetreatment
orexamination sorequired(inthissectionandsection39referredtoasemergency
treatment)iseffectedbyalegallyqualifiedmedicalpractitioner,thepersonwhowas
usingthevehicleatthetimeoftheeventoutofwhichthebodilyinjuryaroseshall,ona
claim being made in accordance with Regulations made by the Minister, pay to the
practitioneror,whereemergencytreatmentiseffectedbymorethanonepractitioner,to
thepractitionerbywhomitisfirsteffected
(a) theprescribedfeeinrespectofeachpersoninwhosecasetheemergency
treatmentiseffectedbyhim;and
(b) suchsum,inrespectofanydistanceinexcessoftwomileswhichhe
mustcoverinordertoproceedfromtheplacewhenceheissummoned
totheplacewheretheemergencytreatmentiscarriedoutbyhimandto
returntothefirstmentionedplace,asisprescribed.
(2) Whereemergencytreatmentisfirsteffectedinahospital,theprovisionsof
theforegoingsubsectionwithrespecttopaymentofafeeshall,sofarasapplicable,but
subject(asregardstherecipientofapayment)totheprovisionsofanyregulationsmade
by the Minister, have effect with the substitution of references to the hospital for
referencetoalegallyqualifiedmedicalpractitioner.
(3) Liability incurred under this section by the Corporation shall, where the
eventoutofwhichitarosewascausedbythewrongfulactofanotherperson,betreated
forthepurposesofanyclaimtorecoverdamagesbyreasonofthatwrongfulactasdam
agesustainedbytheCorporation.

42. Any sum that the Corporation is entitled to recover for fares, charges or
impositionsmayberecoveredeithersummarilyasacivildebt,orasasimplecontract
debtinanyCourtofcompetentjurisdiction.

43. (1) TheMinistermaymakeRegulationsforthepurposeofcarryingthisActinto


effect,includingprescribinganythingrequiredbythisActtobeprescribed,aswellas,
subjecttoanyotherwrittenlaw,prescribingthescaleoffaresandchargesexigiblebythe
Corporationinrespectofitsservices.
(2) Such Regulations may contain provisions for imposing on any person
contravening the Regulations, a fine, recoverable on summary conviction, of seven
hundredandfiftydollars inrespectofeachoffenceand,inthecaseofacontinuing
offence, afurtherfineofseventyfive dollars foreachdayduringwhichtheoffence
continuesafterconvictiontherefor.

44. Legalproceedingsmay,inanyCourtofsummaryjurisdiction,beconductedon
behalfoftheCorporation
(a) bytheSecretaryortheGeneralManager;or
(b) byanyotherofficeroftheCorporationauthorisedtodosobyresolution
oftheCorporation,acopyofwhichpurportingtobecertifiedunderthe
handoftheSecretaryshallbesufficientevidenceofthecontentsthereof.

45. (1) Notwithstandinganyruleoflawtothecontrary,thePresidentmaybyOrder


exempttheCorporationinwholeorinpartfromthepaymentofanytaximposedbyor
underanywrittenlaw.
(2) Inthissectiontaxincludesassessments,fees,charges,impositionandsuch
otherleviesasformpartorareintendedtoformpartofthegeneralrevenue.

46. ThePresidentmaybyOrder,subjecttonegativeresolutionofParliament,make
such incidental, consequential and supplemental provisions as may be necessary or
expedientforthepurposeofgivingeffect
(a) tothetransferbysection10(1)ofanyproperty,rightsandliabilities,
includingthesubrogationoftheCorporationtoanysuchrightsofthe
GovernmentandthetransfertotheCorporationofanysuchliabilitiesof
the Government in connection with the property acquired by the
Government under the Motor Omnibus Concessions (Acquisition of
Undertakings)Act1964;and
(b) tothetransferbysection10(1)ofanyrights,privilegesandadvantages
andanyliabilitiesandobligationsontheCorporationforthepurposesof
thisAct
