Joe O'Brien, a licensed peace ofcer in the State of Minnesota, make

Court for a warrant to search the premises described below, for the
property and thing(s)
described below.

I know the content of this application and afrm that the statements contained
in this
application are true based on my own knowledge, or are believed to be true.

I believe that the following described property and thing(s), namely:

Blood
Hair and/or fibers
Biological samples consisting of saliva swabs
Trace evidence including but not limited to: blood, hair, fibers, fingerprints, bodily
fluids, powder residue, cartridge cases, and items of identification.
Firearms, or firearms components, holsters
Ammunition
Knives and/or sharp instruments
Gloves, masks, boots, and shoes
Clothing which may contain suspected blood or body fluids
Writings which may indicate motive and assist in identification of suspect.
Any and clothing including but not limited to trousers, shirts, sweaters,
all
sweatshirts,
jacket, shoes or boots or other items that would have blood residue on
them.
Papers and documents that would assist with the investigation and
identification
Court authorization to photograph, video tape and process for physical evidence
using
acceptable forensic evidence gathering techniques, searching for evidence to
include
but not limited to: latent fingerprints, fibers, hairs and bodily fluids, including
trace
evidence.
Controlled Substances as defined by M55152
In and all vehicles included on the property including law
enforcement vehicles.
Cell phones located on premises and/or near deceased and all
data relevent to 911

0 The property or things above-described was used as means of committing a crime.
- The possession of the property or things abovedescribed constitutes a crime.
- The property or things above-described is in the possession of a person with intent to

such property as a means of committing a crime, or the property or things so
intended to
be used are in the possession of another to whom they have been delivered for
the
purpose of concealing them or preventing their being discovered.

crime.

The facts establishing the grounds for issuance of a search warrant are as follows:

Affiant is a licensed peace officer under Minnesota Statutes and has


been so licensed from
2008 to 2014 and again in 2016 to present. Affiant is a Special Agent with the Minnesota
Bureau of Criminal Apprehension assigned to the metro homicide section. Affiant holds a
masters degree in Forensic Science. Affiant has served numerous search warrants
with
successful prosecutions.

On July 15, 2017


approximately 11:30 pm, Minneapolis PD received a 911 call from
at
a
women requesting police respond to 5024 Washburn Ave S, Minneapolis for a female
screaming at this location. Approximately 10 minutes later, a female called 911 again
to
check the status of police arrival at this address. Moments later, Minneapolis PD arrived on
scene. Upon police arrival, a female slaps the back of the patrol squad.

After that, it is unknown


BCA agents what exactly happened, but the female became
to
deceased by the alley in the 5100 block of Washburn Ave S with trauma to her torso that
could be a gunshot wound. Minneapolis PD has not elaborated on the circumstances of
this
incident, but requested the BCA to investigate an officer-involved shooting regarding
this
incident. The officer(s) involved have retained legal representation and will not provide a
statement at this time.

The MN
BCA will be investigating this incident as an officer-involved shooting. No further
information was made to BCA at this time.

A nighttime search outside the hours of 7 am. to 8 pm. is


necessary to prevent the loss,
destruction or removal of the objects of the search or to
protect the searchers or the public
because Police were called to this residence during the night
ofJuly 15, 2017 because ofa
report of a female screaming from this residence. A
delay of executing the warrant at a later
time could result in the delayed medical care of anyone inside
the residence and the possibility
of losing fragile evidence because of destruction or environmental
circumstances

NOW, THEREFORE, the Court nds that probable cause exists for the issuance of a search
warrant upon the following ground(s):
