The fortification of constitutional rights in a European level has always
been a matter of specific interest for the course or European fulfillment. Ever
since the foundation of the European Community, the most important sources,
according to the case law of the European Court of Justice, for the protection and
security of these rights have been the common constitutional practices of
member states as well as the European Convention of Human Rights, signed in
1950 by the Council of Europe. The insertion of the Charter of Fundamental
Rights, a first attempt to compose a full catalogue of the constitutional rights
acknowledged by community law, in the Reform Treaty of Lisbon brings back the
prospect of the creation of a European constitutional order.
